AN ORDINACE AMENDING ORDINANCE N0. 167, THE ZONING ORDINANCE, BY
AMENDING SECTIONS 40..2 AND 40.4 Tfl ALLOW COMMERCIAL RECREATION FACILI-
TIES AS A_CONDITIONAL USE IN THE B-W, CBD-I, I-1 AND I-2 DISTRICTS.
.THE CITY COUNCIL OF THE CITY OF LAKEVILLE DOES HEREBY ORDAIN:
Section 1.- Section 40.2 is hereby amended to change the following
permitted use to read as follows:
-8) Outdoor civic events conducted by non-profit organizations,
each such outdoor event being limited to fourteen (14) days in
-any calendar year.
Section 2. Section 40.4 is hereby amended by adding subparagraph
number 5 to read as follows:
40.4. The following are conditional .uses in a "B-W' District
(requires a conditional usepermit based upon procedures set forth
in and regulted by Section 4 of this Ordinance).

5) Commercial,. Recreation Facilties,:provded.that:
a) The architectural appearance .and functionplan of the
building and the site shall be designed with a high
standard of architectural and aesthetic compatibility with
surrounding -progerties. Building materials, orientation.,
colors, height, roof design, .lighting, signage'and site
landscaping shall be designed to compliment the surrounding
industrial properties and demonstrate potential. industrial
reuse. A11 sides of the principal and accessory structures
are to have essentially the same or a coordinated,
harmonious exterior finish .treatment.
b} A com~ercisl recreational use shall not be located within a
shared tenancy buildngcontaining a use classified as an
"H" occupancy as defined by Minnesota State`Building. Code,
as may be amended.
c) is multiple occupancy buildings, a Material Safety Data
Sheet {MSDS) shall be requred_indentifyng-all materials
stored or used in the operation of the tenant :businesses.
Any change'in building tenants shall require that the MSDS
be updated, and provided to-all other tenants in the
multi-tenant building..
d) A commercial recreational use in a shared tenancy building
shall. have. its own exterior entrance and exit.
• e) The site must be accessed via a collector street.... Vehicu-
lar access points .shall create a minimum of conflict with.
through traffic movement, shall comply .with. Section 12 of
this Ordinance and shall. be subject to the approval of the
City Engineer.
f) Adequate off-street parking and off-street loading in
compliance with .the requirements of Sections: l2 and 13 of
this Ordinance.
g) The. provisions of Section 4.2(5.) of this Ordinance":are
considered and satisfactorily met.
Section 3. This Ordinance shall become effective immediately upon
its passage and publication.
Adopted by the Lakeville City Council on this 16th day of January
1990.
