AN ORDINANCE AMENDING TITLE 10 AND TITLE 7,
OF TH8 LAR89ILLE CITY CODS 'CONCERNING
STORM WATLR CONNECTION CHARGES
THE CITY COUNCIL OF THE CITY OF LAKEVILLE ORDAINS.:
Section i. Section 7-7-2 of the Lakeville City Code is
amended. in its entirety to read:
Off-Site Storm Water Connection Charges: In accordance with
the City's comprehensive storm water plan, before a building
permit is issued for multifamily dwelling structures
containing four or more dwelling units, commercial,
industrial or institutional bui dings, a connection charge
for the construction of off-site storm water improvements
must be paid, unless the charge was previously"paid in
conjunction with the platting of the property. The square
foot charge shall be established by resolution of the City
Council. The charge shall be based upon the type of use and
square footage. of he parcel on which the building is to be`
constructed. A credit .shall. be given for any on-site storm
water improvement which has been oversized to serve other
property. The charge shall be paid in cash before the
building permit is .issued by the City unless the City and
landowner agree that the charge .may be assessed against the
property.
Section 2. Section 7-7-3 of the Lakeville City Code is
hereby repealed.
Section 3. .Section 10-5-5 of the Lakeville City Code is
amended to read:
Off-Site Storm Water Improvement Construction Charge: In
accordance with the City's comprehensive storm water plan as
a condition of the subdivision approval, subdividers shall
pay a charge for the construction of off-site storm water
.improvement. The square foot charge shall. be established by
resolution of the City Council. The charge shall be based
upon the gross acreage of the subdivision less the area to
be dedicated to the City for ponding, parks, and wetland.
The subdivision will be given a credit for any on-site storm
water improvement which has been oversized to serve property
outside the subdivision. The charge for lots oversized due
to individual on-site sewage disposal and water systems will
be reduced to the-charge that would be imposed on a one-half
(1/2) acre lot. An additional charge will then be imposed if

the. lot is further subdivided less a credit for the charge
previously paid.~The charge shall be paid in cash before the
subdivision is approved by the City unless the City and
subdivider agree that the charge may be assessed against the
property.
. Section 4. Thin ordinance shall be effective immediately
upon-its .passage .and. publication..
ADOPTED.by the City Council of the ..City of Lakeville this
5th day of February , 2990.
