HomeMy WebLinkAbout02-04 CITY OF LAKEVILLE PLANNING COMMISSION MEETING MINUTES February 4, 2021 Vice Chair Witte called the meeting to order at 6:00 p.m. in the Council Chambers at City Hall. The Pledge of Allegiance to the flag was given. Members Present: Vice Chair Jeff Witte, Karl Drotning, Jenna Majorowicz, Christine Zimmer, Alternate Scott Einck, Ex-officio member Thor Howe Members Absent: Chair Pat Kaluza, Jason Swenson, Brooks Lillehei Staff Present: Daryl Morey, Planning Director; Frank Dempsey, Associate Planner; Penny Brevig, Recording Secretary 3. Approval of the Meeting Minutes The January 21, 2021 Planning Commission meeting minutes and work session minutes were approved as presented. 4. Announcements Planning Director Daryl Morey stated that after a brief break, there is a scheduled work session following tonight’s regular meeting. 5. Luke Hellier Vice Chair Witte opened the public hearing to consider the application of Luke Hellier for a conditional use permit to allow an addition to a legal non-conforming single family home in the RS-3, Single Family Residential District and the Crystal Lake Shoreland Overlay District, located at 10175 Oak Shore Drive. Josie Hellier presented a brief description of the proposed addition to their home. Ms. Hellier stated they are proposing to add a 400 square foot living room addition on the north side of the house and a 260 square foot porch addition to the south (front) side of the house. Associate Planner Frank Dempsey presented the planning report. Mr. Dempsey stated that the Hellier’s expansion plans to the front and rear of the house required a conditional use permit (CUP) because the house is legal non-conforming due to the six-foot side yard setback to the Planning Commission Meeting Minutes, February 4, 2021 Page 2 east property line, where 10 feet is required, and because their home is in the Crystal Lake Shoreland Overlay District. The proposed additions to the house will comply with all setback requirements. Mr. Dempsey stated there are two existing non-conforming conditions that will be remedied with this CUP: the parking area adjacent to the driveway will be paved and set back a minimum of five feet from the west property line, and a boulder garden landscape feature that is located within the Oak Shore Drive right-of-way just west of the driveway can remain with a signed encroachment agreement approved by the City Council. Mr. Dempsey stated that the Department of Natural Resources was notified of the Hellier’s request. The City did not receive a response from them. Planning Department staff recommends approval of the Hellier conditional use permit, subject to the three stipulations listed in the January 13, 2021 planning report, and approval of the Findings of Fact dated February 4, 2021. Vice Chair Witte opened the hearing to the public for comment. There were no comments from the audience. Motion was made by Zimmer, seconded by Drotning to close the public hearing at 6:08 p.m. Voice vote was taken on the motion. Ayes - unanimous Vice Chair Witte asked for comments from the Planning Commission. The Planning Commission discussed the following:  Confirmed that as-built surveys are required by the Zoning Ordinance.  Confirmed that if the Hellier’s planned on constructing a deck off the sliding glass door on the proposed addition, there will be room to construct a deck that meets setback requirements.  Confirmed that the impervious surface area requirements are being met. Motion was made by Zimmer, seconded by Einck to recommend to City Council approval of the Hellier conditional use permit to allow an addition to a legal non-conforming single family home in the RS-3, Single Family Residential District and the Crystal Lake Shoreland Overlay District, located at 10175 Oak Shore Drive, and adopt the Findings of Fact dated February 4, 2021, subject to the following stipulations: Planning Commission Meeting Minutes, February 4, 2021 Page 3 1. The property shall be developed and the building addition constructed in accordance with the survey and building plans approved with the conditional use permit. 2. The parking area adjacent to the driveway shall be paved with bituminous, concrete or paver brick and shall be set back a minimum of five feet from the west property line. 3. The property owners shall enter into an encroachment agreement with the city to allow the raised, tiered boulder planter to remain within the Oak Shore Drive right-of-way, subject to approval by the City Council.
