HomeMy WebLinkAbout0382 ORDINANCE NO. 382. .CITY OF LAKEVILLE DAKOTA COUNTY, MINNESOTA AN ORDINANCE AMENDING TITLE 5 OF THE LAREVILLE CITY CODE CONCERNING ANIMALS The Lakeville City Council ordains: Section 1. Section 5-1-9A of the Lakeville City .Code is amended to read as follows: 5-1-9A Potentially Dangerous Dogs. 1: As used in this section,..."potentially dangerous dogg means.: a) when unprovoked, inflicts bites on a human or domestic animal on publis or private; property.; b) when unprovoked, chases or .approaches a person upon the streets, sidewalks, or any. public property in an apparentattitude of attack; or ;c) has a known propensity, tendency, or disposition to attack unprovoked, causing injures or otherwise threatening the safety of humans or domestic animals. 2. Ownership of potentially dangerous dogs within the City, .with the exception. of ownership by a, public law enforcement .agency, is subject to the following regulations: a) Leash .and Muzzle.. No person shall permit a potential y' dangerous dog to go outside its kennel or pen unless such dog is securely leashed with a leash no longer than four (4):feet in length. No person shall permit a potentially dangerous-.dog to be kept on a chain,, rope or other. type of leash outside`_its kennel or pen unless a person is in physical control of the leash.. Such .dogs may not be leashedto inanimate :objects such as trees, .posts, buildings. and the like. In-addition,-a11 potentially dangerous dogs on a`leash outside the animal's kennel or penmust`be muzzled by a muzzling device`sufficent to prevent such dog from biting persons or''other animals. b) Confinement. Ala potentially dangerous dogs shall be securely confined indoors or in a securely enclosed and locked pen or kennel, except when leashed and muzzled as above .provided Such pen, kennel or structure must have secure.. sides and a ecure topattached to the sides. All structures used to confine potentially dangerous dogs' r06/06/89 must be locked with a key>or combination lock when such animals are within the'structure. Such structure must have a secure bottom or floor attached to the sides of the pen or the sides of the. pen must be embedded-in the ground no less than two (2) feet. All structures erected to house potentially dangerous dogs must comply with all zoning and`buildng regulations of the. City. All such structures must be adequately lighted and ventilated and: kept in a clean and sanitary condition. c} Confinement Indoors.. No potentially dangerous dog may be kept on a porch, patio, or in any part of a house or structure that would allow the dog to exit .such building on its own volition. In addition, no such dog may be kept in a'house or structure when the windows are open or when screen .windows or screen doors are the. only obstacle preventing the dog from exiting the structure.. d) Signs.; All owners of ..potentially dangerous. dogs within: the City shall within thirty (3,0} days. of the effective date of this ordinance display in a prominentplace.on their premises a sign easily readable. by the public using the"words "Beware of Potentially Dangerous Dog". In addition, a similar sign is 'required to be posted on the kennel or pen of such :animal... e)..Insurance. All owners of potentially dangerous dogs mush within sixty (60)'days of the effective date of this .ordinance provide .proof to the City Clerk of liability insurance in a'sngle incident: amount of $50;,.000:00 for bodily injury to or death of any. person: or persons. or z for damage to property owned by any persons `which. may result from the ownership, keeping 'or .maintenance of uch animal. 3. All potentially dangerous dogs must be registered with the Lakeville. Police Department within sixty (60)-days after the ..effective': date of this ordinance. 4. It shall be unlawful for `the owner of a potentially dangerous dog to 'fail to comply with the requirements and conditions set forth in this ordinance. Any doge found to be the subject of aviolation of this ordinance shall be subject o immediate seizure and impoundment. In addition, failure to comply ;will result in the revocation of the license of such animal: requiring the immediate removal of .the animal from the City.-` Section 2. Ownership of potentially dangerous dogs within the City, with the exception of owner- ship by a public law enforcement agency, is subject to the following regulations: a) Leash and Muzzle. No person shall permit a potentially dangerous dog to go outside its kennel or pen unless such dog is securely leashed with a leash no longer than four (4) feet in length. No person shall permit a potentially dangerous dog to be kept on a chain, rope or other type of leash outside its kennel or pen unless a person is in physical control of the leash. Such dogs may not be leashed to inanimate objects such as trees, posts, buildings and the like. In addition, all potentially dangerous dogs on a leash out- side the animal's kennel or pen must be muzzled by a muzzling device sufficient to prevent such dog from biting persons or other animals. b) Confinement. All potentially dangerous dogs shall be securely confined indoors or in a securely enclosed and locked pen or kennel, except when leashed and muzzled as above provided. Such pen, kennel or structure must have secure sides and a secure top attached to the sides. All struc- tures used to confine potentially dangerous dogs must be locked with a key or combina- tion lock when such animals are within the structure. Such structure must have a secure bottom or floor attached to the sides of the pen or the sides of the pen must be embedded in the ground no less than two (2) feet. All structures erected to house poten- tially dangerous dogs must comply with all zoning and building regulations of the City. All such structures must be adquately lighted and ventilated and kept in a clean and sanitary condition. c Confinement Indoors. All owners of potentially dangerous dogs within the City shall within thirty (30 days of the effective date of this ordinance display in a prominent place on their premises a sign easily readable by the public using the words "Beware of Poten- tially Dangerous Dog". In addition, a similar sign is required to be posted on the kennel or pen of such animal. e) Insurance.
