HomeMy WebLinkAbout04-22 CITY OF LAKEVILLE PLANNING COMMISSION MEETING MINUTES April 22, 2021 Vice Chair Witte called the meeting to order at 6:00 p.m. in the Council Chambers at City Hall. The Pledge of Allegiance to the flag was given. Members Present: Vice Chair Jeff Witte, Karl Drotning, Jason Swenson, Brooks Lillehei, Jenna Majorowicz, Christine Zimmer, Ex-officio member Thor Howe Members Absent: Chair Pat Kaluza Staff Present: Daryl Morey, Planning Director; Frank Dempsey, Associate Planner; Penny Brevig, Recording Secretary 3. Approval of the Meeting Minutes The April 8, 2021 Planning Commission meeting minutes were approved as presented. 4. Announcements Planning Director Daryl Morey reminded the Planning Commission about the election of officers that will take place under Agenda Item 7 during tonight’s meeting. 5. Jon Ryan Vice Chair Witte opened the public hearing to consider the application of Tim Johnson representing Jon Ryan for a conditional use permit to allow a second detached accessory th building in the RA, Rural/Agricultural District, located at 12117 – 197 Street. Tim Johnson, from LIVIT Site and Structure LLC, representing Jon Ryan, presented a brief overview of the project. He stated that the Ryan’s are proposing to install an in-ground pool, outdoor fireplace, and the proposed cabana, which requires the CUP. Associate Planner Frank Dempsey presented the planning report. Mr. Dempsey stated that Mr. Ryan is requesting to build a covered, open sided pool cabana to be constructed with an in- ground swimming pool southeast of his house. This will require a conditional use permit (CUP) because the proposed new building will be the second detached accessory building on Mr. Ryan’s property. Planning Commission Meeting Minutes, April 22, 2021 Page 2 Mr. Dempsey showed the plans for the cabana and reviewed the Zoning Ordinance criteria for a CUP for a second accessory building, which are listed in the April 15, 2021 planning report. Planning Department staff recommends approval of the Jon Ryan CUP to allow a second th detached accessory building at 12117 – 197 Street, subject to the five stipulations listed in the April 15, 2021 planning report. Vice Chair Witte opened the hearing to the public for comment. There were no comments from the audience. Motion was made by Zimmer, seconded by Drotning to close the public hearing at 6:06 p.m. Voice vote was taken on the motion. Ayes - unanimous Vice Chair Witte asked for comments from the Planning Commission. Discussion points included:  The proposed second detached accessory building will not adversely impact the neighboring properties due to the size of the subject property and surrounding properties.  Confirmed that there will be no sewer/water service, therefore, no shower being built along with the cabana. Mr. Johnson stated that there will be a foot wash only.  Confirmed that the property cannot be subdivided as currently zoned. Motion was made by Swenson, seconded by Lillehei to recommend to City Council approval of the Jon Ryan conditional use permit to allow a second detached accessory building in the th RA, Rural/Agricultural District, located at 12117 – 197 Street, subject to the following five stipulations: 1. The detached accessory building shall be constructed in the location identified on the certificate of survey prepared by Landform Surveyors and submitted with the conditional use permit application. 2. The detached accessory building shall be constructed with the materials noted on the approved conditional use permit plans. 3. The detached accessory building shall be kept, used and maintained in a manner that is compatible with the existing single family home on the property and shall not prevent a hazard to the public health, safety and general welfare. 4. Sanitary sewer service shall not be provided to the detached accessory building and the detached accessory building shall not be used as a dwelling. 5. No home occupation or other commercial activities shall occur in any accessory building on the property including no storage of commercial equipment or third-party properties or equipment. Dakota Electric Association Vice Chair Witte opened the public hearing to consider the application of Dakota Electric Association for a conditional use permit amendment to allow an expansion of an electric utility substation in the C-3, General Commercial District, located at 17709 Cedar Avenue. Craig Knudson, Land Use Manager from Dakota Electric Association (DEA), presented a brief overview of their project. Mr. Knudson explained that this substation was constructed in the mid-1990s and there has been significant growth in that area since then. He indicated that now is the time to build the substation to its maximum capability. This substation will facilitate the growth in that area but can be used as back up for other stations. Associate Planner Frank Dempsey presented the planning report. Mr. Dempsey stated that DEA is requesting an amendment to CUP No. 94-05 to expand the electrical transmission lines, equipment and compound at the substation located at 17709 Cedar Avenue. The expansion will include moving the security fence to the north and east and moving the existing DEA communications antenna to accommodate the expansion of the substation transmission equipment. A new secondary paved driveway will be constructed within the property to branch south for an alternate maintenance access. Mr. Dempsey indicated that some landscape screening trees will be relocated or replaced as needed. Planning Department staff recommends approval of Dakota Electric Association conditional use permit amendment, subject to the one stipulation listed in the April 15, 2021 planning report. Vice Chair Witte opened the hearing to the public for comment. There were no comments from the audience. Motion was made by Drotning, seconded by Zimmer to close the public hearing at 6:16 p.m. Voice vote was taken on the motion. Ayes - unanimous Vice Chair Witte asked for comments from the Planning Commission. Discussion points included:  Confirmed the location and timeline of the Dodd Boulevard (CSAH 9) realignment adjacent to this site. Planning Commission Meeting Minutes, April 22, 2021 Page 4  Agreed that the amount of growth that Lakeville is experiencing necessitates the expansion of the electrical substations. Motion was made by Lillehei, seconded by Drotning to recommend to City Council approval of an amendment to Conditional Use Permit #94-05 to allow an expansion of an electric utility substation in the C-3, General Commercial District, located at 17709 Cedar Avenue, subject to the following stipulation: 1. The site improvements shall be constructed and completed as identified on the site plan approved with the conditional use permit application. Ayes: Majorowicz, Lillehei, Witte, Zimmer, Drotning, Swenson Nays: 0 7. Election of Officers Motion was made by Lillehei, seconded by Drotning to nominate Vice Chair Witte to the office of Chair and to nominate Commissioner Majorowicz to the office of Vice Chair, effective May 6, 2021, and to close the nominations. Ayes: Lillehei, Witte, Zimmer, Drotning, Swenson, Majorowicz Nays: 0 Mr. Morey thanked Chair Kaluza for his 3 years as Chair and welcomed the new Chair and Vice Chair.
