PLANNING COMMISSION MEETING MINUTES
May 6, 2021
Chair Witte called the meeting to order at 6:00 p.m. in the Council Chambers at City Hall. The
Pledge of Allegiance to the flag was given.
Members Present: Chair Jeff Witte, Vice Chair Jenna Majorowicz, Karl Drotning, Jason Swenson,

3. Approval of the Meeting Minutes
The April 22, 2021 Planning Commission meeting minutes were approved as presented.
4. Announcements
Planning Director Daryl Morey stated that the May 5, 2021 Parks, Recreation and Natural
Resources draft motion for the Cordelia preliminary plat was distributed at tonight’s meeting
5. Raising Cane’s Chicken Fingers
Chair Witte opened the public hearing to consider the application of ADA Architects, Inc. on
behalf of Raising Cane’s Chicken Fingers for a conditional use permit to allow the construction
of a Raising Cane’s convenience restaurant with a drive-through service window in the

Timbercrest at Lakeville PUD, located north of 185 Street (CSAH 60), west of Kenrick Avenue
and east of Interstate 35.
Melanie Bagley from Raising Cane’s presented a brief overview of the project via Zoom. She
stated that they have met all the criteria in the Zoning Ordinance. They have worked to
mitigate stacking and queuing issues by proposing a double lane drive through. There will be
two lanes for ordering and they will utilize cameras in the queuing lanes to help determine
when to open the second pickup lane during periods of peak demand.

Associate Planner Kris Jenson presented the planning report. Ms. Jenson reviewed the history
of the property and explained that the owner of the property, Avalon Group, have been
working with Raising Cane’s on the development of a 3,703 square foot convenience restaurant
with a drive-through. It will have seating for 74 indoors with an additional 42 seasonal seats

on the patio. Ms. Jenson commented that in 2019 the Timbercrest at Lakeville 8 Addition
final plat was approved by the City Council but never recorded because Panera opted to not
move forward with the construction of a restaurant on this site. The Timbercrest at Lakeville

8 Addition final plat will need to be recorded in conjunction with the approval of the Raising
Cane’s CUP.
Ms. Jenson reviewed the building setbacks and explained that prior to City Council
consideration of the CUP, the proposed canopy over the menu board area must be adjusted to
meet the 30-foot setback to the north property line. She stated that the Zoning Ordinance
requires 48 parking spaces for a building of this size. The site plan provides 45 parking spaces
and the remaining three spaces will be provided by the shared cross access and parking
agreement with Target Corporation. In addition, a shared access and parking agreement (if

needed) shall be recorded in conjunction with the Timbercrest at Lakeville 8 Addition final
plat between Lots 1 and 2, Block 1.
Ms. Jenson reviewed the Zoning Ordinance performance standards for convenience food uses
with a drive through service window, which are outlined in the April 28, 2021 planning report.
Planning Department staff recommends approval of the Raising Cane’s conditional use permit
subject to the six stipulations listed in the April 28, 2021 planning report.
Chair Witte opened the hearing to the public for comment.
There were no comments from the audience.
Motion was made by Lillehei, seconded by Drotning to close the public hearing at 6:12 p.m.
Voice vote was taken on the motion. Ayes - unanimous
Chair Witte asked for comments from the Planning Commission. Discussion points
included:
Commissioner Drotning commented that the Lakeville site is twice the size of the Apple
Valley Raising Cane’s site and it appears Raising Cane’s has worked hard to address the
stacking issue.
Commissioner Swenson and Chair Witte both commented that the layout of the drive
through lanes and parking spaces looks better than the Apple Valley location.

Commissioner Swenson encouraged the applicant to think about the location of the trash
enclosure for more efficient truck access, although it does meet Zoning Ordinance
requirements.
Commissioner Lillehei asked the applicant to explain in more detail the removable bollards
that are proposed in the drive through lane, which Ms. Bagley did.
Motion was made by Lillehei, seconded by Einck to recommend to City Council approval of
the Raising Cane’s Chicken Fingers conditional use permit to allow the construction of a
convenience restaurant with a drive-through service window in the Timbercrest at Lakeville

PUD, located north of 185 Street (CSAH 60), west of Kenrick Avenue and east of Interstate
35, subject to the following stipulations:
1. The hours of operation shall not exceed 10:00 am to 12:00 midnight, seven days a week.
2. In order to minimize the potential for vehicle stacking for the drive-through extending onto
the private access road from Kenrick Avenue, Raising Cane’s is required to make use of both
menu and pick-up drive through lanes anytime the drive-through stacking lane reaches the
private access road from Kenrick Avenue.
3. Prior to City Council consideration of the conditional use permit, the site plan must be
modified such that the proposed canopy over the menu area meets the 30 foot setback from
the north property line.
4. Landscaping shall be installed consistent with the approved landscape plan. An escrow shall
be submitted with the building permit application to guarantee installation of the approved
landscaping.
5. Prior to City Council consideration of the CUP, the landscape plan must be modified per
the comments of the city Forester as well as to add plantings around three sides of the
ground transformer for screening.
6. Signs must be in compliance with the Timbercrest at Lakeville Architectural Standards and
a sign permit must be issued prior to installation.

6. Cordelia
Chair Witte opened the public hearing to consider the application of Pulte Homes for the

following, located east of Cedar Avenue (CSAH 23) and south of 179 Street (future CSAH 9):
1. Preliminary plat of 171 attached townhome lots to be known as Cordelia; 2. Comprehensive
Plan amendment to re-guide a portion of the property from Medium Density Residential to
Medium/High Density Residential; 3. Zoning Map amendment to rezone a portion of the
property from RM-2, Medium Density Residential District to RM-3, Medium Density
Residential District; 4. Vacation of a roadway, drainage and utility easement; and 5.

Amendment to Section 11-60-21.B.3.a of the Zoning Ordinance regarding exterior building
finish requirements.
Paul Heuer from Pulte Homes presented a brief overview of their project. Mr. Heuer indicated
that Pulte Homes spent a lot of time and effort on the layout of this project. They are very
proud of their design for Cordelia.
Associate Planner Kris Jenson presented the planning report. Ms. Jenson explained in more
detail what Pulte Homes is requesting concerning the comp plan and zoning map
amendments. She also reviewed the preliminary plat requirements and stated that the
proposed unit lots have sufficient area to accommodate attached townhome units, including
decks and patios.

Ms. Jenson stated that at their April 26 work session, the City Council did not support
amending the Zoning Ordinance to alter the current performance standards for multiple
family residential districts pending the outcome of proposed bills at the State Legislature that
would potentially impact the ability of cities to have zoning standards that are not in line with
the State Building Code. She indicated that City staff recommends the Planning Commission
defer any action on the Zoning Ordinance amendment until after the current legislative session
concludes.
Ms. Jenson commented on the existing roadway, drainage, and utility easement and indicated
that the developer is requesting the vacation of the entire easement, which will then be replaced
with a drainage and utility easement of the same width and location with the final plat.
Ms. Jenson stated that staff is recommending deleting the first sentence of Stipulation #4
because the developer has submitted a revised landscape plan that provides landscaping at the
immediate perimeter of each attached townhome unit. Stipulation #4 would be amended to
read:
4. Prior to City Council consideration of the preliminary plat, the landscape plan shall be
revised to provide landscaping at the immediate perimeter of each attached townhome
unit. Landscaping shall meet the requirements of Section 11-60-21.H of the Zoning
Ordinance. A security shall be submitted with each final plat to guarantee installation of
the approved landscaping.
Planning Department staff recommends approval of Cordelia preliminary plat,
Comprehensive Plan amendment, Zoning Map amendment, and roadway, drainage, and
utility easement vacation, subject to the nine stipulations listed in the April 29, 2021 planning
report, as amended.
Chair Witte opened the hearing to the public for comment.

Steve Devney, 5810 212 Street, Farmington
Mr. Devney and his brother are the current property owners. He felt that Pulte Homes has done
a good job on the design of this proposed development and they have been good to work with. He
was available if the Planning Commission had any questions for the him.
Motion was made by Lillehei, seconded by Kaluza to close the public hearing at 6:33 p.m.
Voice vote was taken on the motion. Ayes - unanimous
Chair Witte asked for comments from the Planning Commission. Discussion points
included:
Commissioner Drotning stated that it was unfortunate that the Planning Commission will
table the Zoning Ordinance amendment regarding exterior building finish requirements,
but hopefully once the legislature finishes their work, the Planning Commission can revisit
this request.
Commissioner Lillehei stated this was an excellent use of the site. He recognized that the
townhome development will be close to the park and ride and appreciated the proposed
path that will run through the development to provide pedestrian access to the park and
ride.
Motion was made by Lillehei, seconded by Drotning to recommend to City Council approval

of the following, located east of Cedar Avenue (CSAH 23) and south of 179 Street (future
CSAH 9): 1. Preliminary plat of 171 attached townhome lots to be known as Cordelia; 2.
Comprehensive Plan amendment to re-guide a portion of the property from Medium Density
Residential to Medium/High Density Residential; 3. Zoning Map amendment to rezone a
portion of the property from RM-2, Medium Density Residential District to RM-3, Medium
Density Residential District; and 4. Vacation of a roadway, drainage and utility easement, as
amended, subject to the following stipulations:
1. The recommendations listed in the April 29, 2021 engineering report.
2. An HOA must be established for the ownership of Lot 172, Block 1 and for the maintenance
of Lots 1-172, Block 1.
3. As part of the 429 project to construct Glacier Way, a five foot wide concrete sidewalk shall
be constructed along the west side of Glacier Way, and eight-foot-wide bituminous trails

shall be constructed along one side of Glacier Way and 179 Street, from Glacier Way to
Fulda Trail.
4. Landscaping shall meet the requirements of Section 11-60-21.H of the Zoning Ordinance.
A security shall be submitted with each final plat to guarantee installation of the approved
landscaping.

5. Buffer yard landscaping adjacent to 179 Street shall be installed according to the approved
landscape plan.
6. The Developer shall construct the bituminous trails throughout the common area as shown
on the approved plans.
7. Parallel parking on Roads A, B and C shall not be permitted.
8. Snow will be required to be removed from the site if it cannot be accommodated within the
snow storage areas.
9. Exterior materials for the attached townhome buildings shall meet Zoning Ordinance
requirements.

Chair Witte thanked former Chair Kaluza for his leadership and dedication to the Planning
Commission for the past 3 years while he was Chair.
