HomeMy WebLinkAboutItem 07City of Lakeville Planning Department Memorandum To : Planning Commission From: Frank Dempsey, AICP, Associate Planner Date: May 27, 2021 Subject: Packet Material for the June 3, 2021 Planning Commission Meeting Agenda Item: Conditional Use Permit Amendment to allow an adult daycare facility in the C-3, General Commercial District Action Deadline: June 27, 2021 INTRODUCTION Representatives of The Moments of Lakeville have applied for a conditional use permit amendment to allow an adult daycare facility to be located at 16258 Kenyon Avenue within the existing memory care facility building. The adult day care would occupy 1,650 square feet of the lower level of the 64 unit memory care building. The adult daycare is proposed to have a maximum licensed capacity of 20 adults in the daycare space. Chapter 31 of the Zoning Ordinance allows day care facilities by conditional use permit. The State of Minnesota requires that day care facilities obtain a Department of Human Services permit to operate the adult day care facility. The Moments of Lakeville will apply for this license separately. 2 The following exhibits are attached for your information: EXHIBITS A. Zoning and Location Map B. Aerial Photo C. The building in which the day care will be located is the larger recently completed building located at 16258 Kenyon Avenue. The building is designed to house 64 memory care adults as residents of the facility. The daycare facility is proposed in a 1,650 square foot room in the lower level. The adult day care space will include two restrooms. The Moments of Lakeville development has received several approvals for various phases of site development and construction. Below is a summary of the project approvals for the property to date: November 2, 2015 – Preliminary and final plat of Kenyon Retail with two lots, Conditional Use Permit No. 15-17 for more than one principal building, impervious surface area greater than 25%, and a drive-in and convenience food establishment (Lot 1), and Conditional Use Permit No. 15-18 for impervious surface area greater than 25% and a residential care facility (Lot 2) with 32 units. November 20, 2017 – Variance approved for a privacy fence within the required setback to a public street (expired). April 15, 2019 – Conditional Use Permit No. 19-11 to allow the expansion of The Moments onto Lot 1 with an additional 60 care units, building height, and impervious surface area. November 18, 2019 – Zoning Ordinance amendment and Conditional Use Permit No. 19-14 to allow a building connection across the property line between Lots 1 and 2 and a fence within the front yard building setback. January 6, 2020 – Conditional Use Permit No. 20-01 to allow construction of a detached accessory building/outdoor pavilion on Lot 2. October 5, 2020 – Amendment to CUP 20-01 to allow a modified, taller accessory building. 3 May 3, 2021 – Amendments to Conditional Use Permit Nos. 15-18 and 19-11 to allow expanded parking on Lots 1 and 2. Surrounding Land Uses and Zoning North – 162nd Street (CSAH 46) South – Kenyon Avenue and Lakeside Flat apartments (PUD District) East – Interstate 35 West – Kenyon Avenue and commercial uses (C-3 District) Applicant Narrative. The Moments of Lakeville adult daycare will be licensed to allow up to 20 guests per day between the hours of 8:00am and 6:00pm. This service will be available to elderly clients that do not reside at the Moments of Lakeville facility that have similar needs to the Moments of Lakeville residents. Daily clients will have access to a dedicated space in the lower level of the building as well as the rest of the facility for their stay. Sewer and Water. All daycare facilities shall have access to City water and sewer or have adequate private sewer and water to protect the health and safety of all persons who occupy the facility. The existing building is connected to City sewer and water to adequately serve the proposed adult daycare use. Parking. The adult daycare use requires five parking spaces for 20 clients at a rate of one space for each four persons of proposed capacity of the adult daycare space. Lot 1 (the 64 unit site) will soon have 50 parking spaces available upon completion of the parking lot expansion approved by the conditional use permit amendment on May 3, 2021. The adult daycare service may not commence until the parking lot expansion has been completed. Loading. A minimum of one loading space shall be provided for the adult daycare facility. The loading space is located at the south entrance to the building. Days and Hours. The hours for adult daycare will be between the hours of 8:00 am and 6:00 pm. Signage. No signage is proposed for the adult day care facility. State License. The license required from the Minnesota Department of Human Resources to operate the adult daycare facility shall be obtained prior to occupancy of the adult daycare service. 4 RECOMMENDATION Planning Department staff recommends approval of the adult daycare use within The Moments of Lakeville facility located at 16258 Kenyon Avenue subject to the following stipulations: 1. All permits and requirements of the Minnesota Department of Human Services shall be met prior to occupancy of the child daycare facility. 2. Licensed occupancy for the adult daycare facility shall not exceed 20 adults with daily service hours between 8:00 am and 6:00 pm. 3. The adult daycare service may not commence until the parking lot expansion has been completed. 4. A building permit is required prior to commencing any remodeling work associated with the adult daycare use. A sewer access charge determination will be required from Metropolitan Environmental Services prior to issuance of a building permit. The Planning Commission conducted a public hearing on the proposed conditional use permit amendment preceded by published and mailed notice. The applicant was present and the Planning Commission heard testimony from all interested persons wishing to speak. FINDINGS OF FACT 1. The property is located in District No. 1, Interstate 35/County Road 50/Orchard Lake of the 2040 Comprehensive Plan, which guides the property for commercial uses. 2. The property is zoned C-3, General Commercial District. 3. The legal description of the property is: SEE EXHIBIT A 4. Section 11-4-3E of the City of Lakeville Zoning Ordinance provides that a conditional use permit may not be approved unless certain criteria are satisfied. The criteria and our findings regarding them are: a) The proposed action has been considered in relation to the specific policies and provisions of and has been found to be consistent with the official City Comprehensive Plan. Finding: The proposed adult daycare use is consistent with the policies and provisions of Planning District No. 1 of the 2040 Comprehensive Land Use Plan. 2 b) The proposed use is or will be compatible with future land uses of the area. Finding: The proposed adult day care use will be compatible with existing and future land uses in the area. c) The proposed use conforms with all performance standards contained in the Zoning Ordinance and the City Code. Finding: The proposed adult daycare use will conform with the performance standards of the Zoning Ordinance given compliance with the stipulations of the approved conditional use permit amendment. d) The proposed use can be accommodated with existing public services and will not overburden the City’s service capacity. Finding: The property is served with existing public services and the adult day care use will not overburden the City’s service capacity. e) Traffic generation by the proposed use is within capabilities of streets serving the property. Finding: Traffic generated by the adult daycare use can be accommodated by all streets serving the property. RECOMMENDATION The Planning Commission recommends that the City Council approve the conditional use permit amendment conditioned upon compliance with the planning report prepared by Frank Dempsey, Associate Planner, dated May 27, 2021.
