BACKGROUND
The Planning Department initiates an annual review of the Zoning Ordinance, Subdivision
Ordinance, and/or City Code to address issues identified in the course of ongoing
administration of the City’s development regulations and review of development applications.
The Planning Commission held a public hearing on 20 May 2021 to consider proposed updates
of the Zoning Ordinance and City Code prepared by City staff and reviewed previously by the
Planning Commission and City Council during work sessions. The public hearing was closed and
the Planning Commission made recommendations to the City Council for approval of the
proposed amendments.
The City Council at their meeting on 7 June 2021 adopted the majority of the proposed
amendments as recommended by the Planning Commission, but referred the issue of design
standards for motor fuel facilities back to the Planning Commission after new information was
presented. City staff is also presenting additional language allowing for shared freestanding
signs on abutting properties within commercial zoning districts. Amendment of these sections
of the Zoning Ordinance were previously noticed as part of the public hearing held by the
Planning Commission and no additional notice is required.

ANALYSIS
Shared Signs. The City acquired two abutting lots within the Lakeville Commerce Center plat
located west of I-35 and north of 210th Street (CSAH 70). The lots abut I-35 to the east and
Keokuk Avenue to the west. The City is developing the south lot with a Lakeville Liquors store
and may market the north lot for sale. Administration staff proposed the concept of placing a
freestanding pylon sign on one lot oriented to be visible from I-35 and a second freestanding
monument sign on the second lot oriented to Keokuk Avenue. Each sign is proposed to display
information for the businesses located on each lot.
The Zoning Ordinance currently allows one freestanding sign per property and prohibits off-
premises signage. Section 11-23-15.Q of the Zoning Ordinance also allows abutting commercial
lots to share a single freestanding sign with the same area and height allowances of a single
sign. The Burger King and Amoco at I-35 and CSAH 50 are believed to be the only businesses
that utilized this provision, but have ceased operations and the sign was removed. The premise
of the provision is that it results in a reduction in the number of signs within a given area by
combining two freestanding signs into one while increasing visibility for the businesses.
The situation presented by the City lots is more unique. The double frontage of the lots to I-35
and Keokuk Avenue creates opportunity for visibility from the freeway corridor and the need
for identification from the interior street for directional purposes. We would recommend that
a provision be included in the Zoning Ordinance allowing the two proposed signs requiring that
one be a freeway-oriented sign and the other located adjacent to the street accesses. with
appropriate area and height standards specific to each purpose. The number of signs would
not be reduced through this version of a shared arrangement, but the cumulative height and
area of freestanding signs allowed separately for the two lots would be. The proposed Zoning
Ordinance provision would also include requirements for shared ownership and maintenance
agreements to be recorded with each property as part of the sign permit approval.
This provision is proposed to be limited to properties within the Freeway Corridor District
abutting I-35. And although initiated based on the circumstances of the City owned properties,
the proposed Zoning Ordinance amendment allowing abutting commercial lots to share
freestanding sign structures would apply to all properties within the I-35 Freeway Corridor
District.
Motor Fuel Canopies. The owner of the former Hi-Hi Market, which is a convenience
store/motor fuel facility located at 8333 210th Street, has proposed exterior remodeling as part
of a franchise rebranding that would include LED lighting and colored bands on the canopy.
Section 11-37-3.E and Section 11-37-7.B of the Zoning Ordinance require the exterior finish for
motor fuel facilities utilize earth tone colors. These sections further allow that 10 percent of
the building facade may contain contrasting colors and that the canopy may have contrasting
color bands or accent lines not to exceed an accumulative width of four inches provided they
not be illuminated. Section 11-16-17.B.1.c of the Zoning Ordinance regulating exterior lighting

generally for commercial, industrial, and institutional uses also states that lighting of the
facades of a building may only utilize illuminating devices mounted on top and facing
downward onto the structure.
The Planning Commission initially addressed changes to the Zoning Ordinance recommending
allowing LED lighting to be installed on the canopy provided that it not face abutting residential
properties and that there are controls for the intensity of the lighting. The property owner
presented City staff with plans for the proposed canopy changes on 7 June 2021 just prior to
the City Council meeting. The proposed elevations include the LED lighting but also colored
bands consistent with the branding of this motor fuel facility identity. The proposed color
bands are 26 inches in height and include a 6.5-inch LED lighting stripe mounted on the 36-inch
height of the canopy elevation. The sign plan also illustrates that the canopy supports utilize
contrasting blue color. While the LED lighting would be allowed by the ordinance amendment
as originally drafted, the width of the color bands and LED lighting conflict with the existing
limit of 4-inch stripes for such franchise identification.
The limitation on the use of non-earth tone, contrasting colors was established with the Motor
Fuel Facilities Study completed during the 1990s and subsequent amendments to the Zoning
Ordinance. The basis of the limitations has been that motor fuel facilities used contrasting
color on the exterior elevations of the principal building and canopy for branding identification
essentially as an expansion of signage for the location. Consistent with the purpose and intent
of exterior material requirements and sign ordinance provisions of the Zoning Ordinance,
community aesthetics are to supersede corporate identity.
In consideration of the intent of the color banding on the motor fuel canopy, our office
recommends that the Zoning Ordinance provisions be further modified. Use of contrasting
colors, including LED lighting is to be allowed on the canopy elevations not facing abutting
residential properties. The extent of the contrasting colors and LED lighting would not be
allowed to exceed 75 percent of the canopy elevation that it is affixed to. The existing provision
of the Zoning Ordinance that placement of a wall sign upon the canopy would be in lieu of wall
signs on the principal building would remain. This approach reflects the purpose of the colored
banding for business identification purposes but is consistent with the intent of the exterior
finish and sign provisions of the Zoning Ordinance.
CONCLUSION
The Planning Commission will consider the additional amendments to the Zoning Ordinance at
their meeting on 15 July 2021. City staff recommends approval of the proposed Zoning
Ordinance amendments in the form attached hereto.

AN ORDINANCE AMENDING THE LAKEVILLE CITY CODE.
THE CITY COUNCIL OF THE CITY OF LAKEVILLE, MINNESOTA ORDAINS:
Section 1. Section 11-23 -19.F of the Zoning Ordinance (Signs – District
Regulations) is hereby amended to add the following provisions:
2. Separate commercial uses on properties with a common lot line that abut a
principal arterial roadway may each locate a sign on the allowed freestanding
structure for each lot subject to approval by the Zoning Administrator; provided,
that:
a. Location:
(1) One (1) of the allowed signs shall be located in a yard abutting the
street to which at least one (1) of the lots have access.
(2) One (1) of the allowed signs shall be located in a yard abutting th e
principal arterial right-of-way.
b. The sign in the yard abutting the street to which the lot(s) have access may
not exceed one hundred (100) square feet each side with a maximum
height of twenty feet (20').
c. The sign in the yard abutting the principal arterial right-of-way shall comply
with the following provisions:
(1) Area: The area of a sign may not exceed one hundred fifty (150)
square feet each side, except that the area of a sign for single
occupancy buildings with a gross floor area of one hundred
thousand (100,000) square feet or larger shall not exceed four
hundred (400) square feet.
(2) Height:
(A) The maximum height of the sign shall not exceed thirty feet
(30'), except that the height of the sign for single occupancy
buildings with a gross floor area of one hundred thousand
(100,000) square feet or larger shall not exceed fifty feet
(50').

(B) For convenience food, hotel, motor fuel and restaurant uses
developed on properties with an elevation below that of the
centerline of I-35, measured at the closest distance between
the sign location and centerline of I-35, the height of a
freestanding sign may increase to be not more than thirty
feet (30') above the centerline elevation of I-35 with a total
height not to exceed seventy feet (70').
d. An agreement addressing construction, maintenance, and repair
responsibilities and access rights is established and filed with the Dakota
County Recorder with the titles of the two (2) properties involved in the
collocated freestanding sign(s) prior to issuance of a sign permit with
amendment or cancellation of the agreement allowed only upon written
approval by the Zoning Administrator.
Section 2. Section 11-37 -3.E.6 of the Zoning Ordinance (Motor Fuel Facilities –
Motor Fuel Sales, Not Including Truck Stops or Automobile Repair) is hereby amended to
read as follows:
6. Use of contrasting colors not defined as earth tones:
a. Ten percent (10%) of the principal building facade may contain
contrasting colors. Contrasting colors shall be those colors not
defined as earth tones.
b. The canopy elevation(s) may have contrasting colors bands or
accent lines not to exceed an accumulative width of four inches (4").
The color bands shall not illuminated.as follows:
(1) The contrasting colors shall be located on ly on an elevation
not facing a residential district and shall not be used on the
canopy supports or other elements of the structure.
(2) The area of the contrasting colors and wall sign(s) shall not
exceed seventy-five (75%) of the area of an individual
canopy elevation where it is allowed.
(3) Use of lighting on the canopy elevation shall be limited to
LED sources that is to be shielded and complies with the
provisions of Section 11-23-15.F of this title.
(4) The use of contrasting colors upon the canopy elevations
shall be in lieu of a walls sign(s) mounted upon the principal
building.
Section 3. Section 11-37-3.F.4 of the Zoning Ordinance (Motor Fuel Facilities –
Motor Fuel Sales, Not Including Truck Stops or Automobile Repair) is hereby amended to
read as follows:
4. Canopy lighting shall consist of canister spotlights recessed into the canopy
with no portion of the light source or fixture extending below the bottom

face of the canopy. Total canopy illumination may not exceed the limits
established by subsection 11-16 -17.A of this title. The fascia of the canopy
shall not be illuminated except as allowed by Section 11-37-3.E.6 of this
title.
Section 4. Section 11 -37-7.B.6.f of the Zoning Ordinance (Motor Fuel Facilities
–Truck Stops or Automobile Repair) is hereby amended to read as follows:

–Truck Stops) is hereby amended to read as follows:
