1 City of Lakeville Planning Department Memorandum To: Planning Commission From: Frank Dempsey, AICP, Associate Planner Date: July 29, 2021 Subject: Packet Material for the August 5, 2021 Planning Commission Meeting Agenda Item: Kenwood Trail Business Park 2nd Addition Preliminary Plat BACKGROUND The City of Lakeville has prepared a preliminary plat named Kenwood Trail Business Park 2nd Addition. The preliminary plat will incorporate vacated drainage and utility easements, alleys and street right-of-way as well as Outlots C and G, Kenwood Trail Business Park and a portion of Lot 1, Block 1, Lakeville Elementary 2nd Addition (excess Ames Arena property). The total lot plat area is 3.09 acres. The Kenwood Trail Business Park preliminary and final plat was approved by the City Council on February 21, 2017 and included one lot, seven outlots, and street construction. The City has entered into a purchase agreement with Hypointe Childcare LLC to purchase Lot 1, Block 1, Kenwood Trail Business Park 2nd Addition. Easement Dedication Arena Parcel F. Right of Way and Easement Vacation G. July 24, 2021 Dakota County Plat Commission Letter 2 PRELIMINARY PLAT a. Comprehensive Plan. The subject property is located in Planning District No. 4, Central Lakeville of the 2040 Comprehensive Land Use Plan. Planning District No. 4 guides the subject property for commercial uses. b. Zoning. The subject property is zoned O-R, Office Residential Transition District. Surrounding Land Uses and Zoning: north – Ames Arena (P/OS District) and Lake Marion Elementary School (RS-2 District) south – Kenwood Trail (CSAH 50) and Icenic Way east – Viking Square Townhomes (RM-1 District) west – Ames Arena and City-owned outlots for stormwater purposes c. Existing Site Conditions. The proposed plat includes property acquisitions and consolidations initiated as part of the Kenwood Trail reconstruction project in 2017 and 2018. The property is relatively flat with all utilizes and street access from Icenic Way. d. Administrative Subdivision. City staff will approve an administrative subdivision of the 5,600 square foot triangular portion of property from the southeast corner of the Ames Arena lot to be incorporated into the Kenwood Trail Business Park 2nd Addition final plat. This additional property is not considered usable for the arena property and will improve the buildable area of Lot 1, Block 1, Kenwood Trail Business Park 2nd Addition. e. Lots/Blocks/Outlots. The preliminary plat includes one lot and one outlot. The final plat will also consist of one lot and one outlot. The preliminary plat area is 3.09 acres. The lot in the preliminary plat exceeds the 24,000 square foot minimum lot area and 120 foot minimum lot width requirements for the O-R District. Outlot A will be owned by the City and used as a stormwater management basin. f. Access/Streets. The preliminary plat of Kenwood Trail Business Park 2nd Addition abuts Kenwood Trail (CSAH 50) and Icenic Way. Access will only be allowed from Icenic Way. Kenwood Trail (CSAH 50) – Kenwood Trail is designated as an A Minor Arterial roadway in the City’s Transportation Plan. All right-of-way required for Kenwood Trail was dedicated with the Kenwood Trail Business Park final plat in 2017. An eight-foot wide trail was constructed adjacent to Kenwood Trail along the length of the Kenwood Trail Business Park plat to Ipava Avenue in 2017. 3 Ipava Avenue – Ipava Avenue is a major collector street as designated in the City’s Transportation Plan. No additional right-of-way is required for Ipava Avenue. Icenic Way – Icenic Way is a local street with a 50 foot right-of-way and a bituminous trail on the north side of the street. No additional right-of-way is required for Icenic Way. g. Grading, Drainage, Erosion Control and Utilities. Grading, drainage, erosion control, and utility issues were addressed with the preliminary and final plat of Kenwood Trail Business Park in 2017. Outlot G, Kenwood Trail Business Park was preliminarily graded with utilities and street construction in preparation for development in 2017. No grading is proposed with the preliminary plat of Kenwood Trail Business Park 2nd Addition. Construction details will be reviewed upon submittal of development plans following final plat approval. h. Wetlands. There are no wetlands located in the Kenwood Trail Business Park 2nd Addition preliminary plat. i. Tree Preservation/Landscaping. There are existing trees located along the north and east boundaries of the preliminary plat. The preliminary plat does not include information on future site design, landscaping or screening. Section 11-21-9.A of the Zoning Ordinance requires the future development to provide a 20 foot wide greenspace buffer and row of landscaping designed to provide adequate screening between the commercial use and the residential properties to the east. The future developer of the property will be required to submit a landscape plan in compliance with Zoning Ordinance requirements. j. Public Easement and Right-of-Way Vacation. Exhibits D and F identify the drainage and utility easements and alley and street rights-of-way proposed to be vacated with the Kenwood Trail Business Park 2nd Addition plat. All utility companies with a potential interest in the easement and right-of-way vacation were notified of the public hearing. No comments have been received. k. Dakota County Plat Commission. The Dakota County Plat Commission reviewed the preliminary plat at their July 21, 2021 meeting. The Plat Commission will recommend approval of the preliminary and final plat to the County Board. A copy of the July 23, 2021 Plat Commission letter is attached. The plat is adjacent to CSAH 50 (Kenwood Tr.) and is therefore subject to the Dakota County Contiguous Plat Ordinance. The proposed plat includes one lot and one outlot. The right-of-way needs for a 4-lane divided roadway have been met. Access to the site is via Icenic Way, a city street. Restricted access should be shown on all of CSAH 50 along Outlot A and Lot 1. A quit claim deed to Dakota County is required for restricted access, which should accompany the plat mylars at the time of recording the plat. The Plat Commission has approved the preliminary and final plat, provided that the described conditions are met, and will recommend approval to the County Board of Commissioners on August 10, 2021. Traffic volumes on CSAH 50 are 13,850 ADT and are anticipated to be 19,000 ADT by the year 2030. No work shall commence in the County right of way until a permit is obtained from the County Transportation Department and no permit will be issued until the plat has been filed with the County Recorder’s Office. The Plat Commission does not review or approve the actual engineering design of proposed accesses or other improvements to be made in the right of way. Nothing herein is intended to restrict or limit Dakota County’s rights with regards to Dakota County rights of way or property. The Plat Commission highly recommends early contact with the Transportation Department to discuss the permitting process which reviews the design and may require construction of highway improvements, including, but not limited to, turn lanes, drainage features, limitations on intersecting street widths, medians, etc. Please contact Gordon McConnell regarding permitting questions at (952) 891-7115 or Todd Tollefson regarding Plat Commission or Plat Ordinance questions at (952) 891-7070.
