HomeMy WebLinkAboutItem 08 South Ryan Addition1 City of Lakeville Planning Department Memorandum To: Planning Commission From: Frank Dempsey, AICP, Associate Planner Date: July 29, 2021 Subject: Packet Material for the August 5, 2021 Planning Commission Meeting Agenda Item: South Ryan Addition Preliminary and Final Plat Action Deadline: September 30, 2021 BACKGROUND Scannell Properties, LLC representatives have submitted preliminary plat and final plat applications and plans for South Ryan Addition, which proposes one lot and one outlot on land totaling 29.53 acres within the I-1, General Industrial District. The property is located south of 215th Street (CSAH 70), east of the recent extension of Jacquard Avenue and north of the southern Lakeville city limits. Lot 1, Block 1 is proposed to include the construction of a 31,360 square foot trans-load facility and 9,408 square feet of office space. The plans include provisions for a future 18,640 square foot building and parking area expansion. A separate 13,824 square foot truck maintenance building and a separate fuel depot is also proposed. The preliminary and final plat plans have been submitted to: 1. The Engineering Division 2. The Parks and Recreation Department 3. The subject property is zoned I-1, Light Industrial District and guided for Warehouse/Light Industrial by the 2040 Comprehensive Land Use Plan. The proposed project is surrounded by the following existing or planned land uses: Direction Existing Use Land Use Plan Zoning North Undeveloped Agricultural Property and 215th Street (CSAH 70) Office Park OP, Office Park District South South City Limits and Eureka Township – Agricultural Property Agriculture (Eureka Township) Agriculture East Amazon Fulfillment Center Warehouse/Light Industrial I-1, Light Industrial District West Undeveloped Agricultural Property Warehouse/Light Industrial I-1 Light Industrial District STAFF ANALYSIS P RELIMINARY PLAT AND FINAL PLAT The developer is proposing to construct a cross-dock trucking and distribution facility that will include semi-truck and trailer loading/unloading and parking areas on the property. The property is just under 30 acres and will be accessed from Jacquard Avenue. The property is immediately west of the new Amazon fulfillment center that is nearing completion of site development and construction. a. Comprehensive Plan. The property is located in Planning District No. 6 of the 2040 Comprehensive Land Use Plan and is within the current Metropolitan Urban Service Area (MUSA) which means that City municipal services, including sanitary sewer service, are available to serve the property. The subject property is guided Warehouse/Light Industrial therefore, the proposed office/warehouse/truck maintenance use is consistent with the 2040 Comprehensive 3 Land Use Plan. The proposed South Ryan Addition preliminary and final plat meets the recommended goals and objectives outlined in Planning District No. 6. b. Existing Site Conditions. The property is moderately sloped (approximately 7.5% to 9%), sloping south from a high point at the north end of the property. Approximately 50% of the property includes a stand of significant trees and the remainder has been used as row crop production. A 100-foot wide Northern Nature Gas Company utility easement runs across the north side of the parent parcel from southeast to northwest. The centerline of the 100-foot wide easement runs along the north property line of Lot 1. No development is proposed over the easement. c. Lot/Block/Outlot. Lot 1 exceeds the minimum lot area and lot width requirements of the I-1, General Industrial District. Outlot A will be deeded to the City for wetland and wetland buffer preservation. The following is a tabulation of the lots as noted on the preliminary plat plans. Lot Area and Lot Width Requirements L1 B1 Outlot A 1 Acre 27.71 acres 1.18 acres 100 feet 463 feet d. Streets. South Ryan Addition abuts Jacquard Avenue, which was constructed this year south of 215th Street (CSAH 70) and west of 217th Street, which was constructed west to Jacquard Avenue with the Amazon site development. Jacquard Avenue is classified as a major collector road in the City’s Transportation Plan. Jacquard Avenue abuts the South Ryan Addition and will provide direct access to 215th Street to the north. A temporary cul-de-sac at the south end of Jacquard Avenue was constructed this year. Jacquard Avenue is planned to be extended to the south when the properties in that area develop in the future. The right-of-way for Jacquard Avenue will extend to the south boundary of the plat. e. Grading, Drainage, Erosion Control and Utilities. City sanitary sewer and water is currently available to the site, which is within the current MUSA. All public utilities will be constructed by the developer to serve the proposed preliminary and final plat following final plat approval. Sewer and water will be available to serve the future development of adjacent properties. Grading and utility plans have been submitted with the South Ryan Addition preliminary and final plat. Grading, drainage, erosion control, and utility review comments are addressed in the engineering report prepared by Alex Jordan, Assist City Engineer and Mac Cafferty, Environmental Resources Manager, dated July 23, 2021. The Engineering Division recommends 4 approval of the South Ryan Addition preliminary plat and the proposed site, grading and utility plans. f. Wetlands. A wetland delineation was completed for the subject property in 2020 and identifies two wetlands on the property. The Engineering Division wetland review and proposed wetland impacts are addressed in the July 23, 2021 Engineering Division report. g. Tree Preservation. Most of the trees will be removed from the site due to existing and proposed topography. No formal tree preservation plan is required. h. Park Dedication, Trails and Sidewalks. The City’s Comprehensive Parks, Trails, and Open Space Plan does not identify any future park land needs in the area of the plat. No public trails or sidewalks are being constructed with the South Ryan Addition plat. Park dedication will be satisfied with a cash fee in effect at the time of final plat approval. Park dedication for industrial zoned properties is calculated a rate of $4,558 per acre (2021 rate) for the net area being final platted. SITE PLAN ANALYSIS The site development and construction plans propose a 31,360 square foot cross-dock freight transfer building with a 9,048 square foot office. The site plan also includes an accessory building for mechanical repair and maintenance, and a motor fuel dispensing facility near the maintenance building. Setbacks. The building setback requirements of the I-1 District are being met with the proposed site plans for Lot 1, Block 1 as follows: Required Setbacks Lot 1 Front Yard -- 40 feet Jacquard Ave. – 465 feet Side Yard (north) - 10 feet Side Yard (south) - 30 feet North – 255 feet South – 268 feet Rear Yard (west)--50 feet 343 feet/Future Expansion 110 feet Parking. The proposed freight transfer building will be 31,360 square feet in area with a proposed 18,641 future expansion. The office area will be 9,408 square feet, and the maintenance building will be 14,200 square feet. The Zoning Ordinance requires a minimum of 82 parking spaces for the proposed office, warehouse, and mechanical/maintenance building uses. The expanded warehouse building will require an additional 17 parking spaces. The site will provide 115 vehicle parking spaces, including five ADA accessible parking spaces. All drive aisles and parking stalls comply with the required aisle width of 24 feet and parking stall dimensions of 9 feet in width and 18 or 20 feet in length depending if they are tandem spaces or overhang a curb. All driveways, loading dock areas and trailer parking spaces are of adequate size to accommodate two-way traffic and backing and turning movements. The driveways provide adequate width and turning radii to accommodate truck turning movements and emergency vehicle access. Access. Access to Lot 1, Block 1 will be from Jacquard Avenue with a single driveway access. Driveway access design to Jacquard Avenue meets Zoning Ordinance requirements for location, setback and width. Fueling Dispensing Area. A fuel dispensing area will be located north of the maintenance/mechanics building. Motor fuel dispensing facilities are allowed by approval of an administrative permit and approval by the Fire Marshal. Truck Scale. A truck scale will be located northeast of the maintenance/mechanics building. Outdoor Storage. The preliminary plat plans propose no outdoor storage on the property other than semi-trucks/trailers used in the process of delivery and pick up of goods. Landscaping/Screening. The landscape plan proposes 146 overstory, evergreen, and ornamental trees as noted in the table below: Landscape Materials 68 Overstory trees (2.5 inch min. diameter) 51 Conifer trees (8 foot minimum height) 27 Ornamental trees (2 inch min. diameter) 257 Variety of Shrubs and perennial plantings 6 All landscaped areas within and adjacent to the parking lot, including landscaped islands, shall be irrigated in compliance with Zoning Ordinance requirements. All areas not planted with trees, shrubs or perennials will be seeded with a natural grass mixture as shown on the landscape plan. The landscape plan shall be amended to identify minimum eight foot tall conifer trees and the minimum required height for shrubs, not container size. A landscape security shall be submitted with final plat approval to guarantee installation of the approved landscaping. The security amount will be determined by the developer’s landscaping contractor prior to City Council consideration of the final plat. Building Exterior. The buildings will be constructed of pre-cast concrete panels accented with narrow pre-finished metal decorative panels. The north and south walls will include dock doors along the entire length of each wall. Both buildings will be painted two tone shades of gray/brown colors. The building exterior materials comply with Zoning Ordinance requirements. Signage. The I-1, Light Industrial District allows one wall sign not to exceed 100 square feet and a freestanding sign not to exceed 100 square feet with a maximum height of 10 feet. A sign permit must be issued by the Planning Department prior to the installation of any signs. Site Lighting. An exterior lighting plan has been submitted and reviewed by staff for compliance with Zoning Ordinance requirements. All site and building wall-pack lighting fixtures are proposed as LED, downcast and cut-off light throw fixtures as required by the Zoning Ordinance. A photometric plan has been submitted indicating not more than one foot-candle of light intensity at any property line. Trash and Recycling Enclosure. A trash enclosure is not identified on the plans. A trash compactor is located near the northeast corner of the freight transfer building, behind the office building, and is not visible from Jacquard Avenue. Any outside trash containers must be within a six-foot tall enclosure constructed of similar materials as the building, including a durable, maintenance free gate. Snow Storage. Snow storage may not take place in required parking spaces. RECOMMENDATION Planning Department staff recommends approval of the South Ryan Addition preliminary and final plat and site development plans subject to the following stipulations: 7 1. Implementation of the recommendations listed in the July 23, 2021 engineering report. 2. All wetland impacts and mitigation areas must be identified and approved prior to commencement of site grading. 3. The site and building for Lot 1, Block 1 shall be developed in compliance with the plans approved by the City Council and Zoning Ordinance requirements. 4. The developer shall submit a security to guarantee installation of the approved landscaping and for the stormwater and infiltration basins and drainageways at the time of final plat approval. The security amount will be determined prior to City Council consideration of the final plat. 5. All landscaped areas adjacent to the building and parking lot shall be irrigated. Trees and shrubs shall not be planted in street right-of-way. 6. All signs shall comply with Zoning Ordinance requirements for the I-1 District. A sign permit shall be issued by the Planning Department prior to the installation of any signs. 7. Snow storage shall not take place in required parking spaces. 8. Site lighting shall not exceed one-foot candle at the property line adjacent to public right-of-way. All exterior light fixtures shall be down-cast design so as not to glare onto public right-of-way. 9. The motor fuel dispensing facility shall require approval of an administrative permit and approval by the Fire Marshal in accordance with Zoning Ordinance requirements. 10. Trash containers shall be stored inside the building or within a six-foot tall enclosure constructed of similar materials as the building, including a durable, maintenance free gate. ! ! ! ! ! ! ! ! ! Jacquard Avenue terminates in a temporary cul-de-sac north of the south property line of the parent parcel. Extension of Jacquard Avenue to the south will require either construction of a bridge or box culverts to span the existing water quality corridor and wetlands to provide an access to the adjacent parcels which are in the process of being annexed into the City. Jacquard Avenue will be required to be constructed and extended to the south property line at the time a final plat is approved for PID No. 130060003090. The Developer shall provide the City a temporary construction easement over the portion of Lot 1, Block 1, South Ryan Addition which would be impacted by the future extension of Jacquard Avenue with the final plat. The temporary easement would expire upon the completion of the roadway improvements. SITE PLAN A Preliminary Site Plan was submitted for Lot 1, Block 1, South Ryan Addition. The Site Plan includes construction of a 31,360 SF LTL Facility including a 9,408 SF office space on Lot 1, Block 1, with plans for a future 18,641 ST building expansion. UUTTIILLIITTIIEESS SSAANNIITTAARRYY SSEEWWEERR South Ryan Addition is located within sub-district SC-10180 and SC-10190 of the South Creek sanitary sewer district as identified in the City’s Comprehensive Sewer Plan. The wastewater from the proposed site will be conveyed by City-owned sanitary sewer facilities to the Elko/New Market interceptor and then to the Empire Wastewater Treatment Plant. The existing City-owned downstream facilities are adequate to convey the wastewater generated by the proposed development. The Developer proposes to extend sanitary sewer from Jacquard Avenue to the west property boundary. The Developer may not connect to the downstream sanitary sewer until it has been tested and accepted by the City. Private sanitary sewer services will be extended from the proposed public sanitary sewer located within an easement for development within Lot 1, Block 1, South Ryan Addition. The Sanitary Sewer Availability Charge has not been collected on the parent parcel and will be collected with the building permit application. Consistent with the City’s Water Plan, the Developer shall extend 12-inch watermain to the west plat boundary from Jacquard Avenue within the City’s Normal Pressure Zone. The Developer will construct a private watermain loop surrounding the proposed building to provide distribution service and fire protection for the proposed improvements. The Developer may not connect to the downstream water until it has been tested and accepted by the City. The private basins will be located on Lot 1, Block 1 and will treat runoff generated from the proposed subdivision. A separate wet sedimentation basin will be constructed offline of the infiltration basin, which will treat the runoff generated from the impervious areas adjacent to the proposed fueling station. The Developer shall construct an impervious liner at the bottom of the basin to reduce to the potential for infiltration of oil from the fueling areas. The Developer shall sign a private maintenance agreement for the basins and dedicate a maintenance easement over the basin area prior to City Council consideration of the final plat. The stormwater management basin design meets all City requirements. Following completion of the site improvements and restoration, the Developer shall conduct double ring infiltrometer tests in the location of the infiltration basin to demonstrate that the design infiltration rates have been achieved. The Developer shall provide a security with the final plat to ensure that this testing is completed. The final grading plan shall identify all fill lots in which the building footings will be placed on fill material. The grading specifications shall also indicate that all embankments meet FHA/HUD 79G specifications. The Developer shall certify to the City that all lots with footings placed on fill material are appropriately constructed. Building Certificates of Occupancy will not be issued until a soils report and an as-built certified grading plan have been submitted and approved by City staff. South Ryan Addition contains more than one acre of site disturbance. A National Pollution Discharge Elimination System General Stormwater Permit for construction activity is required from the Minnesota Pollution Control Agency for areas exceeding one acre being disturbed by grading. A copy of the Notice of Stormwater Permit Coverage must be submitted to the City upon receipt from the MPCA. SSTTOORRMM SSEEWWEERR Development of South Ryan Addition includes the construction of a private storm sewer system. The privately-owned and maintained storm sewer will be located within Lot 1, Block 1, South Ryan Addition and will collect and convey stormwater runoff generated from within the development to the stormwater management basins. The Trunk Storm Sewer Area Charge has not been collected on the parent parcel and must be paid with the final plat. Final locations and sizes of all storm sewer facilities will be reviewed by City staff with the building permit application and final construction plans. FEMA FLOODPLAIN ANALYSIS SSOOUUTTHH RRYYAANN AADDDDIITTIIOONN –– PPRREELLIIMMIINNAARRYY PPLLAATT JJUULLYY 2233,, 22002211 PPAAGGEE 55 OOFF 55 A portion of Outlot A is shown on the Flood Insurance Rate Map (FIRM) as Zone A by the Federal Emergency Management Agency (FEMA). Based on this designation, a portion of the plat is located within a Special Flood Hazard Area (SFHA), as determined by FEMA. WWEETTLLAANNDDSS A wetland delineation report was completed and approved for the site November 23, 2020. The wetland delineation identified two wetlands on the site. Based on the information provided in the report dated September 2020 and site visits, the indicated wetland boundaries have been determined to be acceptable for use in implementing the Wetland Conservation Act. The site grading is impacting Wetland A is a seasonally flooded basins within a crop field (0.1 acres). A wetland replacement plan must be approved prior to impacts to the Wetland A. There are no proposed impacts to Wetland B with the plan. It is the applicant’s responsibility to obtain proper wetland approvals from the U.S. Army Corps of Engineers if needed. TTRREEEE PPRREESSEERRVVAATT IIOONN Due to site grading the majority of the significate trees on the site will be removed with the exception of the trees located within the creek and wetland buffer along Wetland B. EERROOSSIIOONN CCOO NNTTRROOLL The Developer is responsible for obtaining a MPCA Construction Permit for the site as well as developing a SWPPP for the site prior to construction. The permit requires that all erosion and sediment BMPS be clearly outlined in a site’s SWPPP. Changes made throughout construction must be documented in the SWPPP. A maintenance schedule for the first 2 years must be included in the plans. This must include mowing 2 to 3 times, 30 days apart during the first year with the mower deck set about 6-8 inches off the ground. The second year, the pond areas must be mowed once before weeds set their seeds. This will reduce weed establishment and help stimulate the desirable vegetation. This will cut down on maintenance in the long-term. Additional erosion control measures may be required during construction as deemed necessary by City staff. Any additional measures required shall be installed and maintained by the developer.
