Action Deadline: August 29, 2021 BACKGROUND Scannell Properties, #510, LLC, on behalf of Robert and Kathleen Ruddle, has applied for a comprehensive plan amendment and zoning map amendment to establish a land use designation and zoning district for recently annexed property to the City of Lakeville. The comprehensive plan amendment would guide the land Warehouse/Light Industrial (W/LI) and the zoning map amendment would establish the I-1, Light Industrial District zoning on the property. The Ruddle property is located west of Dodd Boulevard (CSAH 9) and north of 225th Street. EXHIBITS A. Site Location Map B. Comprehensive Plan Amendment Map C. Rezoning Map 2 PLANNING A NALYSIS COMPREHENSIVE PLAN AMENDMENT On May 17, 2021, the City Council approved the annexation of the Ruddle property. The property is just over 91 acres and is intended for future industrial development. Because it was recently annexed, a land use designation needs to be established on the property. The parcels to the north of the Ruddle property in Lakeville are guided W/LI, Warehouse/Light Industrial. As a part of the Metropolitan Council’s Comprehensive Plan Amendment process, notification of the proposed comprehensive plan amendment was sent on July 7, 2021 to adjacent and affected jurisdictions. At this time, six of the ten adjacent/affected jurisdictions have indicated that they have no comment about the Comprehensive Plan amendment. An amendment to the Comprehensive Plan for the above-referenced actions is required and will be submitted to the Metropolitan Council for their approval following an action by the City Council to approve the amendment. A goal of the 2040 Comprehensive Plan states that the orderly expansion of Lakeville’s industrial parks shall be pursued through the logical extension of utilities to ensure local employment opportunities and a diverse tax base. This site provides additional industrial land along the Dodd Boulevard/215th Street corridor to meet the needs of Lakeville’s growing industrial parks and will be done in a manner consistent with Lakeville’s priorities, compatible with surrounding development and responsive to determined market needs. REZONING An application has been submitted to establish the I-1, Light Industrial District on the property. The adjacent parcel to the north in Lakeville is also zoned I-1 and the remaining area around the parcel is agricultural areas within Eureka Township. The I-1 District is consistent with the proposed Warehouse/Light Industrial land use designation. Findings of Fact for the Comprehensive Plan and Zoning Map amendments are attached. I-1 I-1 215TH ST (CSAH 70) I-1 P/OS OP DODD BLVD (CSAH 9)217TH ST I-1 EXHIBIT C EUREKA TOWNSHIP 1 CITY OF LAKEVILLE DAKOTA COUNTY, MINNESOTA RUDDLE PROPERTY C OMPREHENSIVE PLAN AND ZONING MAP AMENDMENTS FINDINGS OF FACT AND RECOMMENDATION On August 5, 2021, the Lakeville Planning Commission met at its regularly scheduled meeting to consider an application to amend the 2040 Land Use Plan of the Comprehensive Plan to establish the land use of property and to amend the Zoning Map to establish a zoning designation of property located west of Dodd Boulevard (CSAH 9) and north of 225th Street that was recently annexed into the city. The Planning Commission conducted a public hearing on the proposed amendments preceded by published and mailed notice. The applicant was present and the Planning Commission heard testimony from all interested persons wishing to speak. FINDINGS OF FACT 1. The property does not have a land use designation. Per the 2040 Comprehensive Plan, the parcels adjacent to the subject property are located in Planning District 6. 2. The property does not have a zoning district. Per the current Zoning Map, the parcels adjacent to the subject site are zoned I-1, Light Industrial District. 3. Legal description of the property is attached in Exhibit A. 4. The applicant is requesting to amend the 2040 Land Use Plan to guide the property W/LI, Warehouse/Light Industrial and to amend the Zoning Map to zone the property I-1, Light Industrial District. 5. The 2040 Lakeville Comprehensive Plan and Chapter 3 of the City of Lakeville Zoning Ordinance establish criteria by which the Planning Commission is to consider the applications. The criteria and our findings regarding them are: a. The proposed action has been considered in relation to the specific policies and provisions of and has been found to be consistent with the official City Comprehensive Plan. Finding: The site’s location, adjacent to existing industrial development, supports the change to the 2040 Comprehensive Plan and the zoning map. b. The proposed use is or will be compatible with present and future land uses of the area. 2 Finding: The subject site is surrounded by the following existing and planned land uses shown in the table below. The proposed land use will be compatible with existing and planned land uses surrounding the subject site. Finding: Any proposed development for the site must comply with applicable provisions of the Zoning Ordinance, Subdivision Ordinance and City Code. d. The proposed use can be accommodated with existing public services and will not overburden the City’s service capacity. Finding: The parcel is able to be served by nearby utilities located within adjacent parcels. e. Traffic generated by the proposed use is within capabilities of streets serving the property. Finding: The subject site has direct access to Dodd Boulevard (CSAH 9) as well as access to right of way for Jacquard Avenue. Access to the site will be reviewed in conjunction with development plans for the site. 6. The report dated July 28, 2021 prepared by Kris Jenson, Associate Planner is incorporated herein. RECOMMENDATION The Planning Commission recommends that the City Council approve the Comprehensive Plan and Zoning Map Amendments.
