The property is a 1.17-acre parcel located at 16445 Kingswood Court. The proposed attached accessory building is a 1,798 square foot workshop and garage (interior dimensions). This plan in cludes an additional 740 square feet of driveway and walking path area. The application narrative describes the request and the purpose of the proposed use of the accessory building space. The following exhibits are attached for your review: Exhibit A – Location/Zoning Map Exhibit B – Aerial Photo Map Exhibit C – Applicant Narrative Exhibit D – Certificate of Survey Exhibit E – Building Floor and Elevation Plans Exhibit F – List of approved conditional use permits for accessory buildings – 1981 to present 2 PLANNING ANALYSIS Existing Conditions. The subject property is a single-family lot that totals 1.17 acres in area. The existing house is 1,440 square feet in area with a 600 square foot attached garage. An in- ground swimming pool is also located on the property. The existing garage is proposed to be remodeled as living space. The house was constructed in 1977. Adjacent Land Uses. The subject property is zoned RS-1, Single Family Residential District. Adjacent land uses and zoning are as follows: North – Wetland and Single Family Homes (RS-1) East – Kingswood Court and Single Family Homes (RS-1) South - Single Family Homes (RS-1) West – Single Family Home (RS-1) Setbacks. The minimum setback for the home is 30 feet from the front and rear lot lines and 10 feet from the interior side lot line. The existing house and addition comply with setback requirements as follows: Front (east): 93 feet Rear (north): 30.8 feet Side, interior (east): 12.9 feet Side interior (west): 100 feet Side, interior (south): 91.5 feet Total Accessory Building Area. The applicant’s narrative and plans indicate that the proposed new attached accessory building space will be used for vehicle storage in the 1,189 square foot space and personal hobby workshop in the remaining 609 square foot space. This proposes a total attached accessory building area of 1,798 square feet. Exterior Materials: The proposed accessory structure will utilize vertical steel corrugated siding and 8 inch LP Smartside lap siding. These materials comply with Section 11-17-9.C of the Zoning Ordinance. Impervious Surface. The subject property is located in the Kingsley Lake Shoreland Overlay District and shall have a maximum impervious surface area not more than 25% of total lot area. The proposed accessory building space includes 1,890 square feet of impervious surface, as well as 600 square feet in hardcover for the driveway and an additional 140 square feet for the walkway. This additional proposed impervious surface area is 2,630 square feet in total and comprises 5.1% of the total area of the lot. The plans propose to remove 1,270 square feet of 3 impervious surface. Overall, the proposal increases the imperious surface area from 7,700 square feet existing to 9,140 square feet proposed and from 15% impervious surface area to 17.8% impervious surface area. The total proposed accessory building area will be approximately 83% of the floor area of the house and less than 3.7% of the area of the property. The proposed accessory building will be 20 feet or less in height. Screening. The property includes stands of mature trees to the west, east and north that will not be greatly impacted by site grading according to the proposed grading plan. No significant grading is required for the proposed site improvements. Driveway. The proposed driveway will continue to provide access to and from Kingswood Court. 1090 square feet of the existing driveway will be covered over by the proposed addition and 600 square feet of driveway will be added to accommodate access to the new accessory building. The driveway is required to be paved with bituminous, concrete or paver brick. Sanitary Sewer and Water Services. The property has access to City sewer and water located within or adjacent to Kingswood Court. Connection locations will be determined at the time of building permit review. No bathroom fixtures are allowed in the accessory building spaces. CONDITIONAL USE PERMIT ANALYSIS The Zoning Ordinance allows the accessory building area requirement to be exceeded by conditional use permit subject to the following criteria as listed in Section 11-18-5 of the Zoning Ordinance: A. There is a demonstrated need and potential for continued use of the structure for the purpose stated. Properties in the RS-1 District one acre or larger with a principal building finish ed floor area greater than 2,000 square feet above grade allow an attached garage larger than 1,250 square feet by conditional use permit. The property owner has indicated a need for the proposed accessory building area greater than 1,250 square feet to be used for purpose of garage space and personal hobby woodworking shop. B. No accessory building or private garage shall be utilized for all or a portion of a home occupation, for commercial activities or for commercial storage. The applicant indicates that the accessory building will be used as a garage, for personal storage, and as a personal hobby workshop. The applicant has been informed of restrictions on home occupation and noise compliance. The workshop and garage space shall not be used 4 for business purposes, for a home occupation, or for the storage of commercial vehicles or equipment. C. The accessory building has an evident reuse or function related to a single-family residential environment in urban service areas or farm environment in nonurban service areas of the City. The proposed accessory building space will be used for storage and workspace purposes. D. Detached accessory buildings shall be maintained in a manner that is compatible with the adjacent residential uses and does not present a hazard to public health, safety and general welfare. The proposed attached accessory building space will be incorporated into the house design as shown on the building exterior elevations and floor plan and will be compatible with other single family homes in the area. Attached Exhibit G is a list of accessory building conditional use permits approved since 1981. E. The performance standards and criteria of section 11-4-7 of this title shall be considered and a determination made that the proposed activity is in compliance with such criteria. The provisions of section 11-4-7 of the Zoning Ordinance (Conditional Use Permits) have been considered and satisfactorily met. Please refer to the attached findings of fact. RECOMMENDATION Planning Department staff recommends approval of the Scholz conditional use permit to allow a total accessory building area exceeding 1,250 square feet for an attached garage in the RS-1 District located at 16445 Kingswood Court subject to the following stipulations: 1. The total accessory building area (combined attached and detached) on the property shall not exceed 1,898 square feet. 2. The accessory building space shall not be used for the operation of any commercial business or home occupation, or for the storage of commercial materials or equipment. 3. Restroom facilities shall not be installed within any accessory building area. 4. The total impervious surface area shall not exceed 25% of total property area as required for properties in the Kingsley Lake Shoreland Overlay District. The Planning Commission conducted a public hearing on the proposed conditional use permit preceded by published and mailed notice. The applicant was present and the Planning Commission heard testimony from all interested persons wishing to speak. FINDINGS OF FACT 1. The property is located in Planning District No. 1 of the 2040 Comprehensive Land Use Plan, which guides the property for low density residential use. 2. The property is zoned RS-1, Single Family Residential District 3. The legal description of the property is: Lot 5, Block 2, KINGSWOOD ESTATES 4. Section 11-4-3E of the City of Lakeville Zoning Ordinance provides that a conditional use permit may not be issued unless certain criteria are satisfied. The criteria and our findings regarding them are: a. The proposed action has been considered in relation to the specific policies and provisions of and has been found to be consistent with the official City Comprehensive Plan. Finding: The single family home and proposed attached accessory building use is consistent with the 2040 Comprehensive Land Use Plan and District 1 recommendations of the Comprehensive Plan. b. The proposed use is or will be compatible with present and future land uses of the area. 2 Finding: Provided compliance with the conditional use permit, the attached accessory building will be compatible with existing and future land uses in the area. c. The proposed use conforms with all performance standards contained in the Zoning Ordinance. Finding: The attached accessory building will conform with all performance standards contained in the Zoning Ordinance and the City Code as allowed by this conditional use permit. d. The proposed use can be accommodated with existing public services and will not overburden the City’s service capacity. Finding: The subject property lies within in the current MUSA and is served with city sanitary sewer and water systems. The attached accessory building will have no impact on the City’s service capacity. e. Traffic generation by the proposed use is within capabilities of streets serving the property. Finding: The attached accessory building will not overburden the streets serving the property. 5. The planning report dated July 30, 2021 prepared by Ryan Tessman, Planning and Zoning Specialist, is incorporated herein. RECOMMENDATION The Planning Commission recommends that the City Council approve the conditional use permit conditioned upon compliance with the planning report prepared by Ryan Tessman, Planning and Zoning Specialist dated July 30, 2021.
