HomeMy WebLinkAboutItem 05 Collin Merrill 1 City of Lakeville Planning Department M emorandum To : Planning Commission From: Frank Dempsey, AICP, Associate Planner Date: August 20, 2021 Subject: Packet Material for the September 2, 2021 Planning Commission Meeting Agenda Item: Collin Merrill Conditional Use Permit Extension INTRODUCTION On September 3, 2019 Collin Merrill, 11103 – 181st Street, received City Council approval of a conditional use permit to allow the construction of a detached accessory building with a total accessory building area greater than 1,500 square feet and height greater than 15 feet in the RS-2, Single Family Residential District. The property is a 5.12-acres in area and the building is 48’ x 52’ for a total of 2,496 square feet. Including the existing 576 square foot attached garage, the total accessory building area will be 3,072 square feet. Last year Mr. Merrill requested and received administrative approval of a one-year extension for the CUP until September 3, 2021 . Additional extensions require Planning Commission review and City Council approval under Section 11-4-13 of the Zoning Ordinance . EXHIBITS A. Aerial Photo B. Survey C. Applicant e-mail requesting extension 2 Collin Merrill has submitted another one-year extension request (Exhibit E). He states that he has not started construction of the accessory building because the cost has increased almost 50% due to a shortage of materials and labor. Section 11-4-13 of the Zoning Ordinance requires that an extension of an approved conditional use permit beyond the one year authorized by the Zoning Administrator shall be considered by the Planning Commission and a recommendation forwarded to the City Council. A public hearing is not required. A copy of Conditional Use Permit 19-10 and the survey and building floor and elevations plans approved with the CUP are attached as exhibits to this report. In his extension request, Mr. Merrill states that he may consider modifying the size of the approved accessory building. This would require submittal of a new conditional use permit application and plans. A new Planning Commission public hearing and recommendation and approval by the City Council would be required. So the issues I have are the cost to build my pole barn has risen By almost 50% in cost, the material availability is minimal and on top of that my contractor is very short staffed. They are very behind schedule from all of these factors. > I am asking for another one-year extension to my conditional use permit due to these conditions the global pandemic has caused. I am hopeful to start sometime next summer. I am also considering modifying original submitted drawing. I want the building al little longer snd wider. Nothing crazy. Let me know. Thanks.
