HomeMy WebLinkAbout0367 CITY-OF LAKEVILLE DAKOTA COUNTY, MINNESOTA ORDINANCE NO. 367 AN ORDINANCE AMENDING THE LAKEVILLE ZONING ORDINANCE ALLOWING VETERINARY CLINICS AS A CONDITIONAL USE IN B-2, B-4, AND CBD-C DISTRICTS THE CITY; COUNCIL OF THE CITY OF LAKEVILLE ORDAINS:. Section-1. Section 2.2 of Ordinance No. 267 is hereby amended by adding the following definition: Veterinary Clinic.:. A clinic operated by a licensed veterinarian exc usvely for. the diagnosis, treatment, correction, relief, or prevention of animal disease, deformity, defect, injury, or other physical or mental conditions; .the performance of obstetrical .procedures for .animals, including determination of pregnancy and correction of sterility or infertility; and the rendering- of advice or recommendations with regard to any of the above. Section 2.- Section 36.4 of`Ordinance.No. 167 is hereby amended by adding subparagraph number 3 to read as follows: 3) Veterinary. clinics provided that:. (a) All areas in which animals are confined, are located indoors, and are. properly soundproofed from adjacent properties. (b) Animal carcasses and wastes ..are properly ::disposed of in a manner not utilizing on-site garbage facilities or incineration, and the carcasses are properly refrigerated during periods prior to disposal. (c) No animals are kept .overnight except for medical observation or surgical recovery. (d) The provisions of Section 4.2(5) of this Ordinance are considered and satisfactorily met. Section 3. Section 38::4 of Ordinance No. 167 is hereby amended by adding.:subparagraphnumber 2 to read `as follows: { 2) Veterinary clinics provided that: (a) All areas in which animals are confined, are ..located indoors, and are properly soundproofed from .adjacent properties. '(b) Animal carcasses and wastes are properly disposed of in a manner not utilizing on-site _garbage facilities or incineration, and the carcasses are properly refrigerated during. periods prior to disposal. (c) No animals .are kept overnight except for medical observation or surgical recovery. (d) The provisions of Section 4.2(5) of this 'Ordinance are considered and satisfactorily met.- Section 4. Section 38:2 of Ordinance No. 167 is hereby amended by deleting subparagraph number 4. Section 5 This Ordinance shall be in full force and effect from and after its publication according to law. The City Council of the City of Lakeville does hereby ordain: Season I. Section 2.2 is hereby amended by the addition of a definition of veterinary clinic to read as follows : 2.2 Definitions. The following words and terms, wherever they occur in this Ordin- ance, shall be interpreted as herein defined: Vstsrinary Clinic. A clinic operated by a li- censed veterinarian exclusively for the di- agnosis, treatment, correction, relief, or prevention of animal disease, deformity, defect, injury, or other physical or mental conditions; the performance of obstetrical procedures for animals, including de- termination of pregnancy and correction of sterility or infertility; and the rendering of advice or recommendations with regard to any of the above. Season 2. Section 36.4 is hereby amended by the addition of number 4 to read as follows: 36.4 The following are conditional uses in a "B-2" District. (Requires a conditional use permit based upon procedures set forth in and regulated by Section 4 of this Ordin- ance). 4) Veterinary clinics provided that: (a) All areas in which animals are con- fined are located indoors and are properly soundproofed from adjacent properties. (b) Animal carcasses and wastes are properly disposed of in a manner not utiliz- ing on-site garbage facilities or incin- eration, and the carcasses are properly re- frigerated during periods prior to disposal. (c) No animals are kept overnight except for medical observation or surgical re- covery. (d) The provisions of Section 4.2(5) of this Ordinance are considered and satisfactori- 1y met. Section 3. Section 38.2 is hereby amended by the deletion of number 4) Animal clinics (with no overnight care). Section 4. Section 38.4 is hereby amended by the addition of number 2 to read as follows: 38.4 The following area conditional uses in a "B-4" District.
