CITY OF LAKEVILLE
PLANNING COMMISSION MEETING MINUTES
September 16, 2021
Chair Witte called the meeting to order at 6:00 p.m. in the Council Chambers at City Hall. The
Pledge of Allegiance to the flag was given.
Members Present: Chair Jeff Witte, Vice Chair Jenna Majorowicz, Brooks Lillehei, Karl Drotning,
Christine Zimmer, Scott Einck, Patty Zuzek, Ex-Officio Melissa Field
Members Absent: Jason Swenson, Pat Kaluza
Staff Present: Daryl Morey, Planning Director; Zach Johnson, City Engineer; Frank Dempsey,
Associate Planner; Penny Brevig, Recording Secretary
3. Approval of the Meeting Minutes
The September 2, 2021 Planning Commission meeting minutes were approved as presented.
4. Announcements
Planning Director Daryl Morey stated the following was handed out at tonight’s meeting:
1. Amended stipulation for Agenda Item 7, Boise Building Solutions IUP.
5. City of Lakeville
Chair Witte asked City Engineer Zach Johnson to present the 2022-2026 Capital Improvement
Plan (CIP).
City Engineer Zach Johnson reviewed the objectives of the CIP and indicated that the CIP’s
components include transportation, utilities, environmental resources, parks and recreation,
facilities, equipment and technology for the years 2022-2026. The proposed project
descriptions, locations, revenues and expenditures are included in the draft CIP.
Mr. Johnson stated that the 2022-2026 CIP public hearing will be held at the October 4, 2021
City Council meeting. He reviewed the CIP map and highlighted the various proposed projects
and the specific year those projects will be completed.

Mr. Johnson stated that the CIP was a city-wide initiative and he thanked City staff for their
contributions and efforts. He stated that staff has reviewed the 2022-2026 CIP and finds it to
be consistent with the 2040 Comprehensive Plan and therefore recommends approval as
presented.
Chair Witte thanked Mr. Johnson for his presentation and asked for comments from the
Planning Commission. Discussion points included:
• Commissioner Zimmer thought it was great that the City is including neighborhood
parks in the CIP.
• Commissioner Drotning liked that the CIP includes annual maintenance of the City’s
infrastructure.
• Chair Witte thanked staff for the planning and vision that goes into preparation of the
draft CIP.
Motion was made by Lillehei, seconded by Drotning to recommend to City Council adoption
of the 2022-2026 Capital Improvement Plan as presented, finding that it is consistent with the
City’s 2040 Comprehensive Plan.

6. City of Lakeville
Chair Witte opened the public hearing to consider an amendment to Section 11-88-9 of the
Lakeville Zoning Ordinance concerning I-3, Airport Industrial District interim uses.
Associate Planner Frank Dempsey presented the TPC planning report. Mr. Dempsey stated
that the City amended the Zoning Ordinance on June 7, 2021 to establish the I-3, Industrial
Airport District designated specifically to include Airlake Airport and the unique operations
occurring upon the airport property.
In relation to the private drive that Dakota County and the City constructed on Airlake Airport
property just south of the Dick’s Sanitation and Boise Cascade properties, MAC has been in
negotiations with Dick’s Sanitation and Boise Cascade to lease them an area within the airport
property to be used for additional outdoor storage that both businesses need.
Mr. Dempsey stated that City staff has initiated this Zoning Ordinance amendment to allow
outdoor storage as a secondary or accessory use within the I-3 District by interim use permit.
The draft ordinance indicates that the interim use permit may include stipulations terminating
the allowance of the secondary or accessory use outdoor storage, along with proposed

performance standards for the secondary or accessory use of airport property for outdoor
storage and also for rail car storage.
Planning Department staff recommends approval of a Zoning Ordinance amendment allowing
outdoor storage within the I-3 District as an interim use as presented.
Chair Witte opened the hearing to the public for comment.
Jim Connelly, APPRO Development
Mr. Connelly indicated that Boise Building Solutions will need to unload rail cars from both sides
of the rail spur that is located on their property and abuts the MAC property.
Motion was made by Lillehei, seconded by Majorowicz to close the public hearing at 6:25
p.m.
Voice vote was taken on the motion. Ayes - unanimous
Chair Witte asked for comments from the Planning Commission. Discussion points included:
• The loading and unloading needs of Boise Building Solutions in relation to the
proposed Zoning Ordinance amendment were discussed.
• Drainage of the Boise Building Solutions property and the proposed storage area on the
MAC property was discussed.
• Negotiations are on-going with Progressive Rail regarding the storage of rail cars on
the MAC property.
Motion was made by Drotning, seconde d by Zimmer to recommend to City Council
approval of the amendment to Section 11-88-9 of the Lakeville Zoning Ordinance concerning
I-3, Airport Industrial District interim uses as presented.

7. Boise Building Solutions
Chair Witte opened the public hearing to consider the application of APPRO Development on
behalf of Boise Building Solutions for an interim use permit to allow open and outdoor storage
as a secondary use related to a non-airport operation in the I-3, Airport Industrial District,
located south of 215th Street (CSAH 70) and west of Highview Avenue on Metropolitan
Airports Commission (MAC) Airlake Airport property.

Jim Connelly from APPRO Development, along with David Stone and Patrick Hall from Boise
Building Solutions were in attendance at tonight’s meeting. Mr. Connelly presented a brief
overview of their application. Boise Building Solutions intends to lease storage area from MAC
on MAC property located adjacent to the south. Mr. Connelly indicated that he has been
working with the FAA, the City’s engineers and MAC regarding their application.
Associate Planner Frank Dempsey presented the planning report. Mr. Dempsey stated that
representatives of Boise Building Solutions have submitted an application and plans for an
interim use permit for a secondary outdoor storage yard on property owned by MAC and
adjacent to the Boise Building Solutions property at 8714 – 215th Street.
The Zoning Ordinance amendment under Agenda Item 6 would allow Boise’s proposed
outdoor storage yard on MAC property with the approval of an interim use permit and
compliance with nine stipulations, which are listed in the September 10, 2021 planning report.
The plans submitted with the Boise Outdoor Solutions IUP application will comply with these
stipulations .
The amended Stipulation #7, which was distributed at tonight’s meeting and recommended by
the City Attorney, will read:
7. The interim use permit shall terminate upon the earlier of the following: i) termination of
the lease with MAC; ii) a change of building occupancy for the Boise Building Solutions
property located at 8714 – 215th Street, Lakeville, MN, as determined by the City’s Building
Code; or iii) the abandonment of the outdoor storage area for more than one year.
Planning Department staff recommends approval of the Boise Building Solutions interim use
permit, subject to the eight stipulations listed in the September 10, 2021 planning report, as
amended, and approval of the Findings of Fact dated September 16, 2021.
Chair Witte opened the hearing to the public for comment.
There were no comments from the audience.
Motion was made by Lillehei, seconded by Einck to close the public hearing at 6:39 p.m.
Voice vote was taken on the motion. Ayes - unanimous
Chair Witte asked for comments from the Planning Commission. Discussion points included:
• Clarified that the rail spur that Boise would use to unload their rail cars is not on MAC
property, so there should not be an issue with unloading from both sides of the rail car.
The restriction on loading and unloading of rail cars is for the outdoor storage of rail

cars provision of the Zoning Ordinance amendment, not for the secondary outdoor
storage provision.
• Commissioner Zuzek asked if this would bring more jobs to Lakeville. As they grow
their business, Mr. Stone indicated that it would not be substantial, but yes it would
bring in approximately 10-12 new jobs.
• Mr. Connelly stressed that it was imperative that Boise will be able to unload from both
sides of the rail cars. He also clarified the lease will be written with MAC that the rail
cars that come into this rail spur are only for Boise’s purposes.
Motion was made by Zimmer, seconded by Majorowicz to recommend to City Council
approval of the Boise Building Solutions interim use permit to allow open and outdoor storage
as a secondary use related to a non-airport operation in the I-3, Airport Industrial District,
located south of 215th Street (CSAH 70) and west of Highview Avenue on Metropolitan
Airports Commission (MAC) Airlake Airport property subject to the following eight
stipulations listed in the September 10, 2021 planning report, as amended, and approval of the
Findings of Fact dated September 16, 2021:
1. Approval of the interim use permit is subject to City Council approval of the Zoning
Ordinance amendment to allow outdoor storage as a secondary use related to a non-
airport operation in the I-3, Airport Industrial District.
2. Revised stormwater design plans and information must be submitted and approved by
city staff prior to City Council consideration of the interim use permit.
3. Outdoor storage shall be a secondary use limited to operations accessory to Boise Building
Solutions and any successors and assigns.
4. The outdoor storage area shall be surfaced with asphalt, concrete, or pavers with perimeter
concrete curb for stormwater management purposes, unless exempted by the City
Engineer.
5. All exterior lighting shall be hooded and downcast in compliance with Section 11-16-17
of the Zoning Ordinance.
6. Outdoor storage shall not include any waste material.
7. The interim use permit shall terminate upon the earlier of the following: i) termination of
the lease with MAC; ii) a change of building occupancy for the Boise Building Solutions
property located at 8714 – 215th Street, Lakeville, MN, as determined by the City’s Building
Code; or iii) the abandonment of the outdoor storage area for more than one year.
8. Construction shall comply with all Federal Aviation Administration and Metropolitan
Airports commission requirements.
