HomeMy WebLinkAbout21-142CITY OF LAKEVILLE DAKOTA COUNTY, MINNESOTA RESOLUTION NO. 21-142 RESOLUTION REAPPORTIONING AND ABATING ASSESSMENTS FOR APPALOOSA FARMS SECOND ADDITION WHEREAS, the City levied special assessments for the construction of sanitary sewer, watermain and rural paved roadways in connection with City project No. 16-04 against the property located at 9880192nd Street — PID 22-01900-07-011 ("Property"), which assessments were deferred with interest until subdivision of the Property; WHEREAS, the assessments included two future parcel assessments for sanitary sewer (#1162) and watermain (#1163) and three future parcel assessments for roadway (#1161); WHEREAS, the Property is now being platted into 2 lots as Appaloosa Farms Second Addition; WHEREAS, the property owner has requested that roadway assessment be abated for the second future parcel assessments for sanitary sewer and watermain and two future parcel assessments for roadway since only one additional lot will be included in the plat for Appaloosa Farms Second Addition and has requested that the assessments for one future parcel be reapportioned to Lot 2, Block 1, Appaloosa Farms Second Addition; WHEREAS, the City Council agrees with the reapportionment of the special assessments pursuant to the authority granted the City by Minn. Stat. 429.071 and finds that such reassessment or reapportionment of assessment for the Property will not materially impair collection of the remaining balance of unpaid special assessments. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Lakeville, Minnesota, as follows: 1. That the special assessments for the Property for a one future parcel be reapportioned to Lot 2, Block 1, Appaloosa Farms Second Addition as follows: #1161 Deferred Rural Roadway $11,861.12 #1162 Deferred Sanitary Sewer $ 7,673.00 #1163 Deferred Watermain $ 8,250.92 2. The assessments numbered 1161, 1162, and 1163 for Lot 2, Block 1, Appaloosa Farms Second Addition shall be payable in equal semi-annual installments to be payable in 2022 and shall 218282v4 bear the interest rate of 4.5% per annum from the date of recording of the plat of Appaloosa Farms Second Addition. The owner of Lot 2, Block 1 may, at any time prior to certification of the reapportionment to the County Auditor, pay the whole of the assessments on such property, with interest accrued to the date of payment. 3. That the remaining assessments proposed for the Property for assessment numbers 1161,1162 and 1163 are hereby abated. 4. This Resolution will take effect upon recording of the final plat for Appaloosa Farms Second Addition. Upon recording of the Plat, the City Clerk shall transmit a certified duplicate of this assessment to the County Auditor to be extended on the property tax lists of the County. Such assessments shall be collected and paid over in the same manner as other municipal taxes.
