INTRODUCTION
Representatives of Hampton Companies have submitted an application for a conditional use
permit to allow the construction and operation of a 32-unit senior housing establishment with
services in the C-3, General Commercial District. The memory care facility is proposed to be
located at the northwest corner of 210th Street (CSAH 70) and Keokuk Avenue within the
Lakeville Commerce Center plat immediately south of the Hampton Inn by Hilton hotel located
at 20851 Keokuk Avenue.
The site development plans have been reviewed by Planning Department and Engineering
Division staff.

PLANNING A NALYSIS
CONDITIONAL USE PERMIT
Section 11-73-7.N of the Zoning Ordinance allows senior housing with services (memory care) in
the C-3, General Commercial District subject to meeting the following five criteria:
1. Side and rear yards shall be screened in compliance with section 11-21-9 of this title.
Landscape screening is proposed around the sides and south (rear) of the property
abutting 210th Street (CSAH 70). The landscape plan proposes extensive perimeter
landscaping throughout the site. Plans propose 18 overstory shade trees, six Black Hills
Spruce trees, eight ornamental trees and various shrubs, grasses, and other perennials.
Landscaping is proposed around the building foundation and around the proposed
outdoor courtyard area on the south side of the building. All plant materials meet Zoning
Ordinance requirements. A $20,000 landscaping security shall be submitted prior to
issuance of a building permit.
2. Only the rear yard shall be used for recreational areas. Said area shall be fenced and
controlled and screened in compliance with section 11-21-9 of this title.
A six-foot tall ornamental security fence will also be included around a proposed outdoor
courtyard area on the south side of the building. Landscape screening is proposed around
the perimeter of the fence.
3. The site shall be served by an arterial or collector street of sufficient capacity to
accommodate traffic which will be generated by the use.
The property abuts 210th Street (CSAH 70) which is classified as an arteria street. Keokuk
Avenue is classified as a major collector street. All streets adjacent to the subject property

have dedicated the necessary right-of-way and are of a design to accommodate the
proposed land use. No additional right-of-way dedication or street construction is
required.
4. The use of exterior building materials shall be as required for buildings in the RH-1
district.
The Hampton Companies building will be 24,940 square feet in area and just over 20 feet
in height to the mid-point of the tallest gable roof, within the allowable maximum height
of 35 feet. The building will be constructed of Grade A materials including stone and
glass and Grade B materials including engineered wood (LP Smartside) horizontal siding,
and roofing of asphalt shingles in compliance with the requirements of Section 11-61-9
for this type of use in the C-3 District.
5. All state statutes and rules governing such uses are strictly adhered to and all required
operating permits are secured.
This performance standard is a recommended stipulation of the conditional use permit.
Lot Area. The area of Lot 1, Block 2, Lakeville Commerce Center consists of 3.06 acres which
meets the minimum 20,000 square foot lot size requirement in the C-3 District.
Lot Width. Lot 1, Block 2, Lakeville Commerce Center is 301 feet in width which complies with
the minimum 100 foot lot width requirement in the C-3 District.
Access. A single driveway access to Keokuk Avenue is proposed on the north side of the site.
The developer will be required to construct a median in Keokuk Avenue to restrict turning
movements to right-in right-out due to the proximity of the driveway access to the CSAH 70
intersection. The driveway access is designed to be extended to the property to the west to
provide a shared access to Keokuk Avenue with the future development of that site.
Grading, Drainage and Erosion Control. The conditional use permit plans include grading,
drainage and erosion control, and utilities construction associated with the proposed site plan.
Stormwater ponding is proposed on the west side of the site. Grading, drainage and erosion
control, and utilities are discussed in more detail in the November 10, 2021 engineering memo.
Setbacks. Setback requirements in the C-3 District are noted below:

The proposed memory care facility meets the C-3 District setback requirements.
Parking. Parking requirements for the 32-room memory care use are four spaces plus one space
for each three beds (11 spaces) for a total of 15 parking spaces. The site plan proposes 24 parking
spaces in compliance with Zoning Ordinance requirements. A drop-off lane is proposed at the
front entrance to the building. All drive aisle and parking space dimensions and setback
requirements comply with Zoning Ordinance requirements.
Trash/Recycling Storage. A trash/recyclables enclosure is proposed to be located near the
northeast corner of the building adjacent to the parking lot. The enclosure will be six feet in
height, gated with maintenance free materials that match the exterior materials of the principal
building.
Mechanical Unit Screening. No roof-top mechanical equipment is proposed. Any ground
mounted mechanical equipment must be screened with landscaping or a combination of
landscaping and privacy fencing as required by the Zoning Ordinance.
Site Lighting. A site lighting plan with three proposed individual light poles are proposed
between the parking lot and the building. Wall pack fixtures are proposed at various locations on
the building. All lighting is proposed to be shielded, downcast type fixtures to prevent glare onto
adjacent streets and properties. Photometric figures indicate that all site lighting meets the
maximum allowed threshold of one-foot candle at the property line.
Signs. A monument style freestanding sign is proposed in the southeast corner of the site. No
wall signs are shown on the building elevation plans. All signs must meet Zoning Ordinance
requirements and a sign permit must be submitted to, and approved by, the City prior to the
installation of any signs.
RECOMMENDATION
The Hampton Companies senior housing (memory care) establishment with services conditional
use permit is consistent with the requirements of the Zoning Ordinance. Planning Department
staff recommends approval subject to the following conditions:
1. The site shall be developed in accordance with the plans approved by the City Council.

2. The site shall be developed in accordance with the recommendations listed in the November
10, 2021 engineering report.
3. The exterior building materials shall comply with the requirements of Section 11-61-9 of the
Zoning Ordinance.
4. Trash and recyclable bins shall be stored inside the trash enclosure constructed in accordance
with the plans submitted with the conditional use permit application and approved by the
City Council.
5. A $20,000 landscaping security shall be submitted prior to issuance of a building permit.
6. All signs shall meet Zoning Ordinance requirements and a sign permit shall be submitted to,
and approved by, the City prior to the installation of any signs.
7. All state statutes and rules governing the memory care shall be strictly adhered to and all
required operating permits shall be secured.

FINDINGS OF FACT AND RECOMMENDATION
On November 18, 2021, the Lakeville Planning Commission met at its regularly scheduled
meeting to consider the application of Hampton Companies for a conditional use permit to allow a
senior housing establishment with services in the C-3, General Commercial District. The Planning
Commission held a public hearing on the proposed conditional use permit preceded by published
and mailed notice. The applicant was present and the Planning Commission heard testimony from
all interested persons wishing to speak.
FINDINGS OF FACT
1. The property is located in Comprehensive Planning District No. 6, I-35/CSAH 70
Economic Development Corridor, which guides the property for commercial use.
2. The property is zoned C-3, General Commercial District.
3. The legal description of the property is:
Lot 1, Block 2, LAKEVILLE COMMERCE CENTER
4. Section 11-4-3E of the City of Lakeville Zoning Ordinance provides that a conditional use
permit may not be issued unless certain criteria are satisfied. The criteria and our
findings regarding them are:
a) The proposed action has been considered in relation to the specific policies
and provisions of and has been found to be consistent with the official City
Comprehensive Plan.
Finding: The senior housing establishment with services facility is consistent with
uses allowed on the subject property in the C-3 District. The senior living use of
the property is consistent with the policies and provisions of Planning District 5 of
the Comprehensive Land Use Plan.
b) The proposed use is or will be compatible with future land uses of the area.

Finding: The senior housing establishment with services facility use in the C-3
District will be compatible with existing land uses in the area.
c) The proposed use conforms with all performance standards contained in the
Zoning Ordinance and the City Code.
Finding: The senior housing establishment with services facility use in the C-3
District conforms to the performance standards set forth in the Zoning Ordinance
required for a conditional use permit for the proposed land use.
d) The proposed use can be accommodated with existing public services and will
not overburden the City’s service capacity.
Finding: The senior housing establishment with services facility use is served with
existing public services and will not overburden the City’s service capacity.
e) Traffic generation by the proposed use is within capabilities of streets serving
the property.
Finding: Traffic generation from the senior housing establishment with services
facility use can be accommodated by streets (Major Collector Keokuk Avenue and
A Minor Arterial 210th Street) serving the property.

RECOMMENDATION
The Planning Commission recommends that the City Council approve the conditional use
permit conditioned upon compliance with the planning report dated November 12, 2021

Representatives of Hampton Companies have submitted a site plan and conditional use
permit application to allow a senior housing establishment with service in the C-3 General
Commercial District on Lot 1, Block 2, Lakeville Commerce Center. The property is located
west of and adjacent to Keokuk Avenue and north of and adjacent to 210th Street (CSAH 70).
The parent parcel is zoned C-3, General Commercial District.

The parent parcel is a vacant lot that was mass graded with the Lakeville Commerce Center
development in the 1980’s. Drainage and utility easements are located at the perimeter of the
parcel. Private utilities are located on the property within the existing drainage and utility

the site. A public sidewalk is located along the east side of the parcel within a sidewalk
easement.

The parent parcel contains several existing easements and rights-of-way. The following
easements/right-of-way will remain with development of the property:
• Public drainage and utility easements, per the Lakeville Commerce Center final plat
• Permanent Sidewalk Easement per Doc. No. 3379280

Hampton Companies proposes to construct a single story senior housing building on the
parent parcel. A driveway is proposed to be constructed to provide access to the site from
Keokuk Avenue. The access driveway must include a stop sign, stop bar, crosswalk striping
and pedestrian curb ramps for the public sidewalk. A $2,000 security will be required with the
building permit for the public pedestrian curb ramps located in the public right-of-way. The
construction of this driveway will include the removal of existing curb and gutter and
pavement along Keokuk Avenue. Additionally, the applicant shall construct a center median
within Keokuk Avenue to restrict the driveway access to right-in right-out. The center median
must be constructed in compliance with City Construction Specifications. A $15,000 security
will be required with the building permit for the removal, construction and restoration of the
public roadway infrastructure. The applicant shall construct a mast arm street light in the
public right-of-way at the proposed driveway.
The site plan includes the construction of a private parking lot, designed to provide a capacity
of 24 stalls, including one handicapped accessible stall. A two-way circulation drive will be
constructed to provide a guest drop off at the building entrance. Turning movement
templates were provided to demonstrate that proper circulation can be attained throughout
the parking lot.
The applicant and current property owner plan to construct a secondary access for the site,
which would include construction of a private access road along the north side of the parcel,
extending west onto the adjacent property. This access road would provide a right-in right-
out connection and access to CSAH 70.

Construction traffic access and egress for site grading, utility and building construction shall
be restricted to one entrance off of Keokuk Avenue. Construction access and egress must be

The parent parcel is located within SC-13400 of the South Creek sanitary sewer district as
identified in the City’s Comprehensive Sanitary Sewer Plan. Wastewater will be conveyed via
existing trunk sanitary sewer to the MCES Farmington Interceptor and continue to the Empire
Wastewater Treatment Facility. The downstream facilities have sufficient capacity to serve the
proposed development.
An existing private sanitary sewer service stub, extended from sanitary sewer within Keokuk
Avenue, provides service to the parent parcel.
The Sanitary Sewer Area Charge was collected with the Lakeville Commerce Center final plat;
therefore, the Sanitary Sewer Availability Charge will not be required. The Sanitary Sewer
Connection Charge will be collected for the proposed building prior to the issuance of a
building permit.
WWAATTEERRMMAAIINN
Existing 12-inch public watermain extends adjacent to the parent parcel along Keokuk
Avenue. A 6-inch private watermain stub was constructed to the property with the Lakeville
Commerce Center improvements. The private water service will be extended within the site
to provide water and fire suppression service to the proposed building.
DDRRAAIINNAAGGEE AANNDD GG RR AADDIINN GG
The parent parcel is located within subdistrict ML-8 of the Marion Lake Stormwater District, as
identified in the City’s Water Resources Management Plan.
The parent parcel was previously graded with the Lakeville Commerce Center improvements.
The site drains northwest to the adjacent wetland and drainage way north of the parent
parcel through an existing culvert under Keokuk Avenue. The runoff is conveyed to an
existing wetland complex adjacent to Regional Stormwater Basin ML-7-1, located southwest
of and adjacent to Interstate-35 and 205th Street. Regional Stormwater Basin ML-7-1 and the
existing wetland complex drain to the east via a 72-inch culvert and eventually is conveyed by
way of open-channel flow directly into Lake Marion.
The proposed site adds over an acre of impervious surface which is over the threshold of the
permitting requirements of the MPCA Construction General Permit with respect to the water
quality volume. Therefore, the Applicant must retain on site 1-inch over the area of the
impervious surface of the stormwater runoff generated from the project. The proposed
stormwater management plan consists of a privately owned and maintained filtration basin
and is consistent with the City’s requirements. Prior to the issuance of a building permit, the
Applicant must enter into a private maintenance agreement for the private stormwater
management facilities to be constructed with the project.

The final grading plan must indicate any proposed borrow areas in which the building
footings will be placed on fill material. The grading specifications must indicate that all
embankments meet FHA/HUD 79G specifications. A final certificate of occupancy shall not be
issued until an as-built certified grading plan has been submitted and approved by the City
Engineer.
The proposed site plan and improvements contain more than one acre of site disturbance. A
National Pollution Discharge Elimination System General Stormwater Permit for construction
activity is required from the Minnesota Pollution Control Agency for areas exceeding one acre
being disturbed by grading. A copy of the Notice of Stormwater Permit Coverage must be
submitted to the City upon receipt from the MPCA.

No public storm sewer is proposed to be constructed in conjunction with the site plan
improvements. A private storm sewer system will be installed to convey the discharge from
the stormwater management system to the adjacent wetland.
The Trunk Storm Sewer Area Charge has been collected on the parent parcel and will not be
required with the site plan improvements.

The erosion control plans include a detailed SWPPP for the site. The Applicant is responsible
for obtaining a MPCA Construction Permit for the site prior to issuance of a building permit.
Changes made throughout construction must be documented in the SWPPP.
Additional erosion control measures may be required during construction as deemed
necessary by City staff. Any additional measures required shall be installed and maintained
by the Applicant.
