Citizen Comments: • Douglas Boedecker expressed concerns regarding storm drainage from the commercial area near 210th Street and Kensington Boulevard, which is creating erosion and has a negative impact on his property. Mayor Anderson referred the matter to city staff. 4. Additional Agenda Information: None 5. Presentations/Introductions: • Kati Bachmayer introduced Natalie Mouilso, Dakota County Business Advisor with the Metropolitan Consortium of Community Developers, who presented an update on the Open to Business Program. • Chief Long presented the Police Department quarterly report. 6. Liquor License at Ole Piper Restaurant and Sports Bar Mayor Anderson opened the public hearing on the application of Woodlane, Inc. for an on - sale and Sunday liquor license at Ole Piper Restaurant and Sports Bar. The applicant, Robert Lane, stated he plans to take over the business from the current owner. No changes are proposed at this time. There were no public comments. Motion was made Hellier, seconded by Volk, to close the public hearing. Voice vote was taken on the motion. Ayes - unanimous Motion was made by Bermel, seconded by Hellier, to grant an on -sale and Sunday liquor license to Woodlane, Inc., doing business as Ole Piper Restaurant and Sports Bar, 16604 Cedar Avenue, effective January 1, 2022. Roll call was taken on the motion. Ayes - Anderson, Bermel, Hellier, Lee, Volk 8. Caslano preliminary plat and rezoning Melissa Duce requested Council approval of the Caslano preliminary plat, consisting of 221 single family lots on approximately 21 acres located south of Dodd Boulevard and west of Highview Avenue. She provided an overview of the project. The western portion of the southerly part of the property, she stated, is proposed to be rezoned from RS -3 to RS -4. The proposed trails will provide additional connectivity to King Park and adjacent neighborhoods. Overall, the project will include over 5,000 feet of additional trails. Planning Director Daryl Morey presented the staff report for the Caslano preliminary plat, which will be developed in three phases. Right of way for the future extension of 185th Street is being dedicated with this plat. About 35 acres of land within the development will be dedicated as outlots for public purposes. The greenway corridor will provide a significant off- street trail connection from King Park to the existing trail system at Heritage Commons. CITY COUNCIL Minutes, December 20, 2021 Page 4 Mayor Anderson asked staff to consider a trail underpass at 185th Street and Highview Avenue for the safety of school children. The city attorney recommended a correction to Section 3 of the rezoning ordinance to read as follows, "This ordinance shall be effective upon its passage by the City Council and the recording with Dakota County of the final plat of Lots 155-205, Caslano. Motion was made by Hellier, seconded by Lee, to approve Resolution No. 21-186 approving the Caslano preliminary plat, findings of fact and Ordinance No. 1059 rezoning a portion of the property from RS -3 to RS -4, with the correction to Section 3 of the zoning ordinance as provided by the city attorney. Roll call was taken on the motion. Ayes - Anderson, Bermel, Hellier, Lee, Volk 9. Report on City Administrator's Performance Evaluation On behalf of Personnel Committee, Councilmember Bermel read the following statement: The City Council completed an annual performance review for City Administrator Justin Miller on Monday, December 20 at a special closed meeting. Mr. Miller's review focuses on his leadership, presence in the community, and communications with the Council, the public and employees. We find Mr. Miller's performance continues to beat an exceptional level. Asper Mr. Miller's employment agreement and based on the outcome of this evaluation, we recommend that his annual pay increase to $198,297 and earn an additional 10 hours of paid time off effective January 1, 2022. Motion was made by Bermel, seconded by Lee, to set the City Administrator's annual salary at $198,297 and grant 10 additional hours of paid time off effective January 1, 2022. Statute Section 13D.05, subd. 3(b). Roll call was taken on the motion. Ayes - Anderson, Bermel, Hellier, Lee, Volk The City Council convened the closed session at 7:45 p.m. All council members were present. Also present: Justin Miller, City Administrator; Allyn Kuennen, Assistant City Administrator; Daryl Morey, Planning Director; Andrea McDowell Poehler, City Attorney, John Baker and Aaron Knoll. Motion was made by Bermel, seconded by Lee, to adjourn the meeting. Voice vote was taken on the motion. Ayes - unanimous.
