HomeMy WebLinkAbout1060ORDINANCE NO. 1060 CITY OF LAKEVILLE COUNTY OF DAKOTA, MINNESOTA AN ORDINANCE AMENDING TITLE 3, CHAPTER 1 OF THE LAKEVILLE CITY CODE CONCERNING CONSUMPTION AND DISPLAY PERMITS THE CITY COUNCIL OF THE CITY OF LAKEVILLE, MINNESOTA ORDAINS: SECTION 1. Section 3-1-3(A) of the Lakeville City Code is amended to read as follows: A. Except as provided in Minn. Stats. ch. 340A, no person may directly or indirectly, on any pretense or by any device, sell, barter, keep for sale, charge for possession, or otherwise dispose of alcoholic beverages as part of a commercial transaction without having obtained the required license or permit. SECTION 2. The Title of Section 3-1-4 of the Lakeville City Code is amended to read as follows: 3-1-4: TYPES OF LICENSES AND PERMITS: SECTION 3. Section 3-1-4(E) of the Lakeville City Code is amended to read as follows: E. "Consumption and Display Permit ": A consumption and display permit may be approved for an organization that complies with the requirements of Minnesota statutes section 340A.414. No business establishment or club that does not hold an on -sale intoxicating liquor license may directly or indirectly allow the consumption and display of alcoholic beverages or knowingly serve any liquid for the purpose of mixing with intoxicating liquor in the city without first obtaining a consumption and display permit. An applicant for a consumption and display permit shall submit an application for approval by the city to the city clerk. Holders of a consumption and display permit shall comply with the financial responsibility requirements of this chapter and shall pay the fee set by the city council. SECTION 4. Section 3-1-5-2 is amended to read as follows: 3-1-5-2: RENEWAL APPLICATIONS: A. License and Permit Period, Expiration: Each renewal license shall be issued for a maximum period of one year. All licenses expire on June 30 of each year. Each renewal consumption and display permit shall be issued for a maximum period of one year. All consumption and display permits and the accompanying city consent to the permits shall expire on March 31 of each year. 2195580 B. Time of Making Application: Applications for the renewal of an existing license or consumption and display permit shall be made at least sixty (60) days prior to the date of the expiration of the license or permit, and shall state that everything in the prior applications remains true and correct except as otherwise indicated. If, in the judgment of the council, good and sufficient cause is shown by any applicant for his failure to file for a renewal within the time period provided, the council may, if the other provisions of this chapter are complied with, grant the application. SECTION 5. Section 3-1-8-2 of the Lakeville City Code is hereby deleted in its entirety. SECTION 6. This Ordinance shall be effective immediately upon its passage and publication.
