CITY OF LAKEVILLE
PLANNING COMMISSION MEETING MINUTES
January 6, 2022
Chair Witte called the meeting to order at 6:00 p.m. in the Council Chambers at City Hall. The
Pledge of Allegiance to the flag was given.
Members Present: Chair Jeff Witte, Karl Drotning, Brooks Lillehei, Scott Einck, Patty Zuzek
Members Absent: Vice Chair Jenna Majorowicz, Pat Kaluza, Christine Zimmer, Ex-Officio

3. Approval of the Meeting Minutes
The December 16, 2021 Planning Commission meeting minutes were approved as presented.
4. Announcements
Planning Director Daryl Morey stated that Lakeville Christian Church representatives have
requested that their applications be removed from the agenda (Agenda Item 5). There is no
need for a motion. This agenda item will be considered at an upcoming Planning Commission
meeting.
5. Lakeville Christian Church First Addition
Lakeville Christian Church representatives have requested that their applications for a
Preliminary Plat and Conditional Use Permit be removed from the agenda.
6. Dick’s Sanitation Service
Chair Witte opened the public hearing to consider the application of Dick’s Sanitation Service
for an interim use permit to allow open and outdoor storage as a secondary use related to a
non-airport operation in the I-3, Airport Industrial District.

Brett Anderson, Project Manager for Dick’s Sanitation Service, presented a brief overview of
their project. He indicated that this application would give them additional truck parking,
additional storage and additional fueling locations on the MAC property.
Associate Planner Frank Dempsey presented the planning report. Mr. Dempsey stated that
Dick’s Sanitation Service submitted an application for an interim use permit (IUP) for an
accessory outdoor storage yard, which would be located west of the private access road adjacent
to the Dick’s Sanitation Service property.
The Zoning Ordinance and Zoning Map were amended last year to allow outdoor storage as a
secondary use related to a non-airport operation in the I-3 District on an adjacent parcel as an
interim use. The I-3 District will allow Dick Sanitation’s proposed outdoor storage yard on
MAC property with the approval of an IUP and compliance with the nine stipulations listed in
the December 29, 2021 planning report.
The proposed outside storage area will be used for possible future garbage truck and recyclables
truck parking on the south half of the site or for possible outside storage of related storage
containers provided by Dick’s Sanitation Service.
A chain link fence is proposed around the perimeter of the property parallel to the private road
and will required a zoning permit prior to installation.
Planning Department staff recommends approval of the Dick’s Sanitation Service interim use
permit, subject to the eight stipulations listed in the December 29, 2021 planning report, and
approval of the Findings of Fact dated January 6, 2022.
Chair Witte opened the hearing to the public for comment.
There were no comments from the audience.
Motion was made by Lillehei, seconded by Einck to close the public hearing at 6:09 p.m.
Voice vote was taken on the motion. Ayes - unanimous

Motion was made by Lillehei seconded by Drotning to recommend to City Council approval
of the Dick’s Sanitation Service interim use permit to allow open and outdoor storage as a
secondary use related to a non-airport operation in the I-3, Airport Industrial District, located
at 8984 215th Street, subject to the following stipulations, and approval of the Findings of Fact
dated January 6, 2022:
1. Final revised stormwater design plans and information must be submitted and approved
by City staff prior to City Council consideration of the interim use permit.
2. Outdoor storage shall be a secondary use limited to operations accessory to Dick’s
Sanitation Service operations and any subsidiary use of the principal properties including
successors and assigns shall be consistent with the approved interim use permit.
3. All outdoor storage, parking, and drive areas shall be surfaced with asphalt, concrete, or
pavers with perimeter curb and gutter for stormwater management purposes, unless
exempted by the City Engineer as allowed by the Zoning Ordinance.
4. All exterior lighting shall be hooded and downcast in compliance with Section 11-16-17 of
the Zoning Ordinance.
5. A zoning permit shall be issued prior to the installation of any fence.
6. Accessory outdoor storage shall not include any waste material.
7. The interim use permit shall terminate upon the earlier of the following: i) termination of
the lease with MAC; ii) a change of building occupancy for Dick’s Sanitation Service or
Recycle Minnesota properties located at 8984 – 215th Street and 8812 – 215th Street as
determined by the City’s Building Code; or iii) the abandonment of the outdoor storage or
parking area for more than one year.
8. Construction shall comply with all Federal Aviation Administration and Metropolitan
Airports commission requirements.
