The Preliminary and Final Plat of Lakeville Christian Church First Addition 2. A Conditional Use Permit to allow: A) a religious institution in the RM-1, Medium Density Residential District, B) an exception to the exterior building finish requirements for an institutional use and, C) a fence located within the front yard setback. Application Action Deadline: April 12, 2022 INTRODUCTION Applications for preliminary and final plat and conditional use permit have been submitted by representatives of Lakeville Christian Church for the development of a church (institutional use) in the RM-1, Medium Density Residential District. The public hearing scheduled for January 6, 2022 was removed from the agenda at the request of the applicant to allow for plan revisions based on Department of Natural Resources comments and internal church and school changes to the site layout. The subject property is located south of Hartford Way, west of Hamburg Avenue, and north of Lakeville Boulevard totaling 8.55 acres. The plans propose a 12,107 square foot, 750 seat sanctuary church. The applicants request an exception to the exterior building finish requirements for the church, an institutional use. A five-foot tall wrought iron style decorative fence is proposed to be located within the Hartford Way and Hamburg Avenue 30-foot front 2 yard setback, which requires approval of a conditional use permit. The previous plans would have required a variance from the Shoreland Overlay District maximum impervious surface area requirement of 25%. The revised plans have eliminated the need for the variance. A 2.0 acre outlot (Outlot B) is proposed at the west end of the property for construction of a future church affiliated private school with an anticipated maximum enrollment of 40 children between grades K-12. Lakeville Christian Church currently has assembly locations in Lakeville at 21151 Idaho Avenue, 9880 – 192nd Street, and 16701 Joplin Way. The Lakeville Christian Church First Addition plans have been distributed to the Engineering Division, the Parks and Recreation Department the Parks, Recreation and Natural Resources Committee, and the Department of Natural Resources. Building Elevation Plans and Perspectives (3 pages) J. Front Yard Decorative Fence PLANNING A NALYSIS PRELIMINARY AND FINAL PLAT Existing Conditions. The property is an 8.55 acre undeveloped metes and bounds described parcel. The site is flat and includes a portion of the South Creek tributary including floodway and flood fringe areas within the Vermillion River along the west and south boundary of the property. An Xcel Energy electric power substation is located at the corner of Hamburg Avenue and Lakeville Boulevard immediately south of the proposed Lakeville Christian Church First Addition site. A portion of the property is located within the 300-foot wide Shoreland Overlay District of the tributary stream, within Outlots A and B. 3 Adjacent Land Uses. North: Hartford Way, Village Creek Townhomes, and a single-family home (RM-2 and RS-3 Districts) South: Lakeville Boulevard and Xcel Energy Substation (C-1 District) East: Hamburg Avenue and single family homes in Cedar Landing (RST-2 District) West: City Owned Property Adjacent to South Creek and Single-Family Homes (P/OS and RS-3 Districts) Consistency with the Comprehensive Plan. The property is located in Planning District No. 4 of the 2040 Comprehensive Land Use Plan which guides the properties for medium density residential development. The church (assembly) use and public and private schools are allowed in the RM-1 District subject to approval of a conditional use permit. Zoning. The subject property is zoned RM-1, Medium Density Residential District which allows religious institution uses by conditional use permit. The west third of the property is located within the 300-foot Shoreland Overlay District boundary of the tributary stream to the Vermillion River. MUSA. The Lakeville Christian Church First Addition preliminary and final plat is located within the current Metropolitan Urban Service Area (MUSA). City sanitary sewer is available to serve the proposed development. Premature Subdivision Criteria. A preliminary and final plat may be deemed premature if any of the criteria listed in Chapter 10-2-4-1 of the Subdivision Ordinance exist. Eligible criteria pertain to a lack of adequate: drainage, water, streets, sanitary sewer, and public service capacity (police and fire protection). The other pertinent criteria pertain to inconsistencies with the City Comprehensive Land Use and Capital Improvement Plans. Staff’s review of the Lakeville Christian Church First Addition preliminary and final plat with these criteria finds that it is not a premature subdivision. Lots and Blocks. One 3.35 acre lot is proposed for the church. A minimum lot size for institutional uses is not required in the RM-1 District. Outlots. Two outlots are proposed with the preliminary and final plat. Outlot A is 2.69 acres and will include the tributary stream, wetland, floodway and flood fringe, and stormwater basins. Outlot A will be deeded to the City for wetland preservation and stormwater maintenance purposes. Outlot B is 2.0 acres and will be retained by the owner for a possible future private school site and associated parking lot and outdoor play area. 4 Setbacks. The Lakeville Christian Church preliminary and final plat and site plan meets the RM-1 District setback requirements, as follows: Abutting a Public Street – 30 feet Front Yard – 30 feet Rear Yard – 30 feet Side Yards – 14 feet interior/30 feet adjacent to Hartford Way Streets. The subject site abuts Hamburg Avenue to the east, Hartford Way to the north and Lakeville Boulevard to the south. Hamburg Avenue and Hartford Way are classified as minor collector streets. Lakeville Boulevard is classified a major collector street. Forty (40) feet of right-of-way will be dedicated for Hamburg Avenue and 26.86 feet of right-of-way for Lakeville Boulevard consistent with the Comprehensive Transportation Plan. No additional right-of-way is required for Hartford Way. Hartford Way will be designated for no parking adjacent to the subject property. Park and Open Space. Park land dedication is not identified in the Parks, Trails and Open Space Plan for this area and no park land dedication is proposed with the Lakeville Christian Church preliminary and final plat. The 8.55 acre property will be subject to a single family home equivalent cash fee park dedication rate in effect at the time of final plat approval. The 2022 park dedication fee for medium density residential is $3,382/lot. The Parks, Recreation and Natural Resources Committee will not review the Lakeville Christian Church First Addition preliminary and final plat since the plat consists of only one lot and no park land dedication. Trails and Sidewalks. A concrete sidewalk is located along the south side of Hartford Way. A five foot wide concrete sidewalk will be constructed by the applicant along the west side of Hamburg Avenue from Hartford Way to the proposed driveway access. Grading, Drainage and Utility Plans. The grading, drainage and utility plans were submitted to the Engineering Division for their review. The subject property has access to City sewer, water, and storm water utilities. Overhead utility lines are located on the west side of Hamburg Avenue and are required to be buried as a condition of approval of the preliminary and final plat. A cross access and shared maintenance agreement shall be established for the private utilities on Lot 1, Block 1, and Outlot B prior to recording the final plat. Please refer to the February 9, 2022 Engineering Division report prepared by Alex Jordan, Assistant City Engineer and Mac Cafferty, Environmental Resources Manager for more detailed review comments. 5 Tree Preservation. There are no significant trees within the Lakeville Christian Church First Addition preliminary and final plat. Wetlands. Wetlands will not be impacted as part of the Lakeville Christian Church First Addition development. The wetland has been delineated and incorporated into the preliminary and final plat plans. The 0.43 acre wetland and wetland buffer are located within Outlot A, which will be deeded to the City. Floodplain Boundaries. A portion of Lakeville Christian Church First Addition is located within areas shown on the Flood Insurance Rate Map (FIRM) as Zones AE and A, as identified on FIRM Map No. 27037C0213E, map data dated December 2, 2011. Based on this designation, there are areas within the plat that are located within a Special Flood Hazard Area (SFHA). All Special Flood Hazard Areas will be located within Outlot A, to be deeded to the City. Lot 1, Block 1 and Outlot B are located outside of known flood hazard areas. Department of Natural Resources. The property lies within the Shoreland Overlay District of the South Creek Vermillion River Tributary, a DNR designated stream corridor. Prior to the scheduled public hearing on January 6, 2022, the DNR responded with comments of concern regarding the proposed impervious surface area within the Shoreland Overlay District exceeding 25%. The developer has since relocated the church and school and placed the future school within Outlot B on the west side of the property. The greater amount of green space associated with the future school site on Outlot B, combined with the area of Outlot A, will reduce the proposed impervious surface area to 14.7%. CONDITIONAL USE PERMITS Lakeville Christian Church requests approval of a conditional use permit pertaining to three sections of the Zoning Ordinance. The first is for a church use in the RM-1 District (Section 11-58-9.D). The second is to allow an exception to the exterior building finish requirements for an institutional use (Section 11-17-9.D.2). The third is to allow a fence within the front yards abutting Hartford Way and Hamburg Avenue (Section 11-21-5.H.1.a). Religious institutions are allowed in the RM-1 District subject to a conditional use permit. The performance standard for said institutions requires the building(s) to be set back double the required side yard setbacks but not greater than 30 feet. The church building complies with those setback requirements. Religious institutions are commonly located within residential zoning districts subject to approval of a conditional use permit. Lakeville Christian Church is requesting to use building 6 materials other than those required for institutional uses. Section 11-17-9.D requires institutional buildings to provide exterior materials with a minimum of three Grade A materials, at least 65% Grade A materials; not more than 35% Grade B or Grade C materials and not more than 10% Grade D materials. Section 11-17-9.G outlines exceptions to the exterior building materials requirements that may be granted by conditional use permit subject to the following criteria: 1. The use is an essential service as defined by this title (buildings associated with communications buildings, utility substations, or public or private utility buildings); or The church use is not considered an essential service as defined by the Zoning Ordinance. 2. The applicant shall have the burden of demonstrating that: a. The proposed building maintains the quality in design and materials intended by this title. The primary exterior building material is proposed to be face brick and fiber cement siding. Lakeville Christian Church (formerly Minneapolis Meeting Rooms) proposed and received conditional use permit approval in 2011 for a religious institution building with similar exterior materials in the single family residential neighborhood at 21151 Idaho Avenue. The exterior materials for the 3,200 square foot building on Idaho Avenue were determined to be in keeping with residential character of the neighborhood. b. The proposed building design and materials are compatible and in harmony with other structures within the district. The proposed exterior building materials for the low profile 12,107 square foot church building provide the look and durability desired for a religious institution use in the RM-1 District and the adjacent single family and townhome uses to the north and east. To the south is the 3.33 acre Xcel Energy electric power substation property. c. The justification for deviation from the requirements of this section shall not be based on economic considerations. The exterior design of the building is intended to be consistent with the residential neighborhood character of the area utilizing the following materials: 7 Building Height. The church building will be 27 feet in height at the uppermost point of the curved roof, which is less than the maximum 35 feet height allowed in the RM-1 District. Fences. The church proposes to install a five foot tall decorative security fence along Hartford Way and Hamburg Avenue, within the front yard setback, 10 feet from the property lines. Section 11-21-5.H. allows fences within front yards abutting public right-of-way subject to approval of a conditional use permit. The five foot tall decorative open design metal fence will resemble a black wrought iron design. A five foot tall chain link fence will be installed around the south and west sides of the property. The proposed fences are open in design and do not create obstructions to views, intersection visibility, sunlight, or movement of air. Driveway Accesses. The site plan proposes two accesses for the church. One from Hartford Way and the other from Hamburg Avenue. The site plan proposes a separate access from Hartford Way for the future school. The Zoning Ordinance allows each lot to have at least one access to a public street. Parking. Parking for a church with a sanctuary with a seating capacity of less than 1,000 seats is one space for each three seats of building capacity. The church is proposed to include sanctuary seating for 750 seats. The proposed church requires a total of 250 parking spaces. The site plan proposes 280 parking spaces. All drive aisles, parking spaces and driveways meet Zoning Ordinance design requirements for dimensions and drive aisle widths. The future school will require parking spaces equal to one space for each seven students between elementary and middle school grades, based on building design capacity. High school students (classrooms) will require one parking space per each three students plus one space per high school age dedicated classrooms. The proposed sketch layout for Outlot B for the future school proposes 14 parking spaces. Parking calculations will be formally determined for the number of students and building occupancy design capacity at the time building plans are submitted for the school. A separate conditional use permit application is required for the proposed school. A preliminary and final plat for the development of Outlot B is also required. A conditional use permit stipulation for the church will require a cross access and parking agreement between Lot 1, Block 1 and Outlot B. Snow Storage. The Zoning Ordinance requires that snow storage not occur within required parking spaces. The parking lot for the church has 30 parking space more than the minimum required by the Zoning Ordinance. The proposed fence around the parking lot will restrict 8 the ability to store snow on-site. Snow storage exceeding the equivalent of 30 parking spaces must be hauled from the site. Landscaping/Screening. The landscape plan proposes planting 21 deciduous trees, 10 coniferous trees, and numerous shrubs throughout the site. A row of deciduous trees and shrubs will provide screening of the parking lot from Hartford Way as required by the Zoning Ordinance. The landscape plan shall be amended to include similar parking lot screening adjacent to Hamburg Avenue. The conifer trees will be planted primarily west of the church building and parking lot in compliance with the Shoreland Overlay District requirements. A $25,000 landscape security shall be submitted to guarantee installation of the landscaping. When the future school use on Outlot B is proposed for development, addition landscape screening will be required between the school and parking lot and the existing single family home to the north. Exterior Storage/Trash and Recycling Containers. A trash and recyclable materials enclosure is not identified on the plans. Any outside storage of trash/recycling containers will require a screening enclosure constructed of materials similar to the church building and in compliance with Zoning Ordinance requirements. Lighting. The church does propose parking lot light fixtures. Church representatives have stated a site lighting plan will be submitted. All site and exterior building lighting shall comply with Zoning Ordinance requirements. Signs. The plans do not propose any signs for the subject property. The other Lakeville Christian Church properties and buildings do not include signs. The Zoning Ordinance allows a single free-standing sign up to 32 square feet in area and eight feet in height in the RM-1 District subject to issuance of a sign permit. RECOMMENDATION Planning Department staff recommends approval of the request of Lakeville Christian Church for: 1) the Preliminary and Final Plat of Lakeville Christian Church First Addition. 2) a Conditional Use Permit to allow: a) a religious institution in the RM-1, Medium Density Residential District, b) an exception to the exterior building finish requirements for an institutional use and, c) a fence located within the front yard setbacks. 9 1. The recommendations listed in the Engineering Department memorandum dated February 9, 2022. 2. The building and site shall be developed consistent with the plans approved by the City Council. 3. The Grade A exterior building materials shall not be painted. 4. Outlot A shall be deeded to the City with the final plat. 5. A zoning permit shall be issued by the City prior to the installation of any fences. 6. The landscape plan shall be amended to include parking lot screening adjacent to Hamburg Avenue as required by the Zoning Ordinance. 7. A $30,000 landscaping security shall be submitted with the final plat. 8. Parking lot lighting shall be provided in the parking lot on Lot 1. A lighting plan shall be submitted for review prior to issuance of a building permit. 9. The future private school within Outlot B, Lakeville Christian Church First Addition shall require approval of a preliminary and final plat and conditional use permit. 10. A cross access and shared maintenance agreement shall be established for the private utilities on Lot 1, Block 1 and Outlot B prior to recording the final plat. 11. A cross access and parking agreement shall be established between Lot 1, Block 1 and Outlot B prior to recording the final plat. 12. A no parking resolution shall be considered by the City Council along Hartford Way adjacent to the plat. 13. Snow storage is permitted on site only within parking spaces not required to meet minimum parking requirements of the Zoning Ordinance. Additional snow shall be hauled from the site. 14. Any outside storage of trash/recycling containers shall require a screening enclosure constructed of materials similar to the church building and in compliance with Zoning Ordinance requirements. 10 15. The Planning Commission conducted a public hearing on the proposed conditional use permit preceded by published and mailed notice. The applicant was present and the Planning Commission heard testimony from all interested persons wishing to speak. FINDINGS OF FACT 1. The property is located in Comprehensive Planning District No. 4, Central Lakeville, which guides the property for medium density residential uses. 2. The property is zoned RM-1, Medium Density Residential District. 3. The legal description of the property is: Lot 1, Block 1 and Outlots A and B, Lakeville Christian Church First Addition 4. Section 11-4-3E of the City of Lakeville Zoning Ordinance provides that a conditional use permit may not be issued unless certain criteria are satisfied. The criteria and our findings regarding them are: a) The proposed action has been considered in relation to the specific policies and provisions of and has been found to be consistent with the official City Comprehensive Plan. Finding: The proposed religious institution is consistent with uses allowed in residential zoning district areas of the City. The church use, proposed exterior 2 building materials, and the proposed fence within the front yard setback for an institutional use is consistent with the policies and provisions of Planning District 4 of the Comprehensive Land Use Plan. b) The proposed use is or will be compatible with future land uses of the area. Finding: The proposed religious institution use, the proposed exterior building materials, and the proposed fence within the front yard setback for an institutional use is consistent in the RM-1 District and will be compatible with existing and future residential land uses in the area. c) The proposed use conforms with all performance standards contained in the Zoning Ordinance and the City Code. Finding: The proposed religious institution use in the RM-1 District, the proposed exterior building materials, and the proposed fence within the front yard setback for an institutional use will conform to the performance standards set forth in the Zoning Ordinance given approval of the conditional use permit. d) The proposed use can be accommodated with existing public services and will not overburden the City’s service capacity. Finding: The proposed religious institution use will be served with existing public services and will not overburden the City’s service capacity. e) Traffic generation by the proposed use is within capabilities of streets serving the property. Finding: Traffic generation from the religious institution use can be accommodated by minor collectors Hamburg Avenue and Hartford Way serving the property. 5. Prior to recording the final plat, a resolution restricting parking along Hartford Way adjacent to the site must be approved. Development of Lakeville Christian Church First Addition includes construction of one access along Hamburg Avenue and one along Hartford Way. The driveway entrances must be constructed per City standards. A $10,000 security will be required with the final plat for construction of the driveway entrances onto the public roadways. Eight-inch private sanitary sewer was extended with City Project 19-05 to provide utility service to the parent parcel. The sanitary sewer was tested and approved for connection. Consistent with the City’s Public Ways and Property Ordinance, the Developer shall place the overhead utilities underground adjacent to the plat with the development improvements. A $50,000 security will be required with the final plat for the removal of the overhead utilities. DDRRAAIINNAAGGEE AANNDD GGRR AADDIINN GG Lakeville Christian Church First Addition is located within subdistrict SC-188 of the South Creek stormwater district as identified in the City’s Water Resources Management Plan. In conjunction with City Project 19-05, the City constructed a series of public stormwater management basins on the parent parcel. In exchange for the land dedication for the basin area, the City oversized the stormwater management system to provide the necessary stormwater treatment and rate control for development of the parent parcel. No additional stormwater management improvements are necessary with the development, including future development of Outlot B. The final grading plan shall identify all fill lots in which the building footings will be placed on fill material. The grading specifications shall also indicate that all embankments meet FHA/HUD 79G specifications. The Developer shall certify to the City that all lots with footings placed on fill material are appropriately constructed. A copy of the Notice of Stormwater Permit Coverage must be submitted to the City upon receipt from the MPCA. Privately owned and maintained storm sewer constructed within the site will collect and convey runoff to the publicly owned and maintained stormwater basins on Outlot A.
