BACKGROUND
Robert and Colleen Powell have applied for a Comprehensive Plan amendment and
Zoning Map amendment to change the land use designation and rezone property of three
parcels they own located west of I-35. Each of these parcels has a single-family home, one
of which is occupied by the Applicants and another is occupied by the Applicant’s son
and his family. The Comprehensive Plan amendment would change the land use
designation from High Density Residential and Medium/High Density Residential to
Low/Medium Density Residential and the Zoning Map amendment would rezone the
property from RH-2, High Density Residential District and RM-2, Medium Density
Residential District to RST-2, Single and Two Family Residential District. The subject
property is located south of 205th Street and west of Keokuk Avenue.

PLANNING A NALYSIS
COMPREHENSIVE PLAN AMENDMENT
As a part of the Metropolitan Council’s Comprehensive Plan amendment process,
notification of the proposed Comprehensive Plan amendment was sent on January 27,
2022 to adjacent and affected jurisdictions. At this time, seven of the ten adjacent/affected
jurisdictions have responded, all providing no comment about the Comprehensive Plan
amendment.
An amendment to the Comprehensive Plan for the above-referenced actions is required
and will be submitted to the Metropolitan Council for their approval following an action
by the City Council to approve the amendment. The Comprehensive Plan amendment
will not adversely impact the housing goals of the 2040 Comprehensive Plan.
REZONING
An application has been submitted to rezone the parcel from RH-2, High Density
Residential District and RM-2, Medium Density Residential District to RST-2, Single and
Two Family Residential District. After the 2040 Comprehensive Plan was approved by the
Met Council, the City updated the Zoning Ordinance and map to bring them into
compliance with the Comprehensive Plan. One change that was made to the Zoning
Ordinance was to remove single family homes as a permitted use from the RM-2 District,
in an effort to maintain a higher density within the RM-2 District. An unintended
outcome of that change is that the Applicant’s existing single family homes became
lawfully existing, non-conforming structures that could not be modified or expanded,
something that the Applicants would like the ability to do. The Applicants have stated
they are planning to construct additions to two of the three single family homes, which
would only be allowed with approval of the Comprehensive Plan and Zoning Map
amendments. The RST-2 District is consistent with the proposed Low/Medium Density
Residential land use designation.
Findings of Fact for the Comprehensive Plan and Zoning Map amendments are attached.
RECOMMENDATION
Planning Department staff recommends approval of the Powell Comprehensive Plan
amendment and Zoning Map amendment.

ZONING MAP AMENDMENTS
FINDINGS OF FACT AND RECOMMENDATION
On February 17, 2022, the Lakeville Planning Commission met at its regularly scheduled meeting
to consider the applications of Robert and Colleen Powell to amend the 2040 Land Use Plan Map
of the Comprehensive Plan to change the land use designation of three properties and to amend
the Zoning Map to change the zoning designation of the same three properties located west of
Keokuk Avenue and south of 205th Street. The Planning Commission conducted a public hearing
on the proposed amendments preceded by published and mailed notice. The applicant was present
and the Planning Commission heard testimony from all interested persons wishing to speak.
FINDINGS OF FACT
1. The properties are guided for HDR, High Density Residential and MDR, Medium Density
Residential and are located in Planning District 6 of the 2040 Comprehensive Plan.
2. The subject sites are zoned RH-2, Multiple Family Residential District and RM-2, Medium
Density Residential District.
3. Legal description of the property is attached as Exhibit A.
4. The applicant is requesting to amend the 2040 Land Use Plan to guide the property L/MDR,
Low/Medium Density Residential. The Zoning Map would be amended to zone the property
as RST-2, Single and Two Family Residential District.
5. The 2040 Lakeville Comprehensive Land Use Plan and Chapter 3 of the City of Lakeville
Zoning Ordinance establish criteria by which the Planning Commission is to consider the
applications. The criteria and our findings regarding them are:
a. The proposed action has been considered in relation to the specific policies and
provisions of and has been found to be consistent with the official City Comprehensive
Plan.
Finding: The site’s location, adjacent to parcels guided RDR, Rural Density Residential and
zoned Rural/Agriculture District supports the change to the 2040 Comprehensive Plan and
the Zoning Map.
b. The proposed use is or will be compatible with present and future land uses of the area.

Finding: The subject site is surrounded by the following existing and planned land uses
shown in the table below. The proposed land use will be compatible with existing and
planned land uses surrounding the subject site.

c. The proposed use conforms to all performance standards contained in the Zoning
Ordinance and the City Code.
Finding: The proposed amendments will allow the existing single family homes on these
parcels to expand in compliance with the applicable provisions of the Zoning Ordinance
and City Code.
d. The proposed use can be accommodated with existing public services and will not
overburden the City’s service capacity.
Finding: The parcels are not connected to public services and are currently served by
private wells and septic systems.
e. Traffic generated by the proposed use is within capabilities of streets serving the
property.
Finding: The parcels have access to 205th Street and no changes to the traffic generated or
the access to the parcels is proposed with these amendments.

herein.
RECOMMENDATION
The Planning Commission recommends that the City Council approve the Comprehensive Plan
and Zoning Map amendments conditioned upon compliance with the February 9, 2022 Planning
Report prepared by Associate Planner Kris Jenson.
