JOINT DRIVEWAY AND UTILITY EASEMENT COVENANT
THIS JOINT DRIVEWAY AND UTILITY EASEMENT COVENANT (“Agreement”) covers
Lot 1 and Lot 2 Block 1, REPLAT OF ACORN HEIGHTS ADDITION, according to the recorded plat
thereof, Dakota County, Minnesota.
Merrill Enterprises, LLC, a Minnesota limited liability company, as Grantor, hereby impose upon
and subject said lots for the benefit of Susan Dailey, as Grantee, of said lots only and the present and future
owners thereof, the following conditions, restrictions, reservations, covenants and easements, which shall
operate as restrictions passing with the conveyance of each lot and shall apply to and bind every successor
in interest.
It is the intention of the Grantor to create a common driveway for Lots 1 and 2, Block 1, REPLAT
OF ACORN HEIGHTS ADDITION by establishing a driveway easement.
1. An easement is hereby created for utility and driveway purposes over, upon and across
that portion of Lot 1, Block 1, described as follows:
See Exhibit “A” attached hereto and incorporated herein (the “Easement Area”).
2. Said easement shall be appurtenant, non-exclusive, and perpetual for ingress and egress
and for the benefit of the owners of Lot 2, Block 1, REPLAT OF ACORN HEIGHTS ADDITION.
3. The owner of Lot 2, Block 1 shall have the right to improve the Easement Area provided
that the cost of any construction, reconstruction, maintenance, and repair of any improvement to the
driveway shall be at the cost and expense of the owner of Lot 2, Block 1, REPLAT OF ACORN
HEIGHTS ADDITION.
4. The grant of the foregoing permanent easement for utility purposes includes the
right of the Grantee, its contractors, agents and servants to enter upon the Easement Area at all
reasonable times to construct, reconstruct, inspect, repair and maintain utilities in the Easement
Area.
5. This agreement shall inure to the benefit of and be binding on the owners of Lot 1 and Lot
2, Block 1, REPLAT OF ACORN HEIGHTS ADDITION, according to the recorded plat thereof Dakota
County, Minnesota, and their heirs, successors, and assigns and the covenants herein contained shall run
with the land.
