HomeMy WebLinkAbout02-17CITY OF LAKEVILLE PLANNING COMMISSION MEETING MINUTES February 17, 2022 Chair Witte called the meeting to order at 6:00 p.m. in the Council Chambers at City Hall. The Pledge of Allegiance to the flag was given. Members Present: Chair Jeff Witte, Vice Chair Jenna Majorowicz, Karl Drotning, Scott Einck, Brooks Lillehei, Pat Kaluza, Christine Zimmer Members Absent: Jason Swenson, Ex-Officio Melissa Field Staff Present: Daryl Morey, Planning Director; Frank Dempsey, Associate Planner; Alex Jordan, Assistant City Engineer; Tina Morrow, Recording Secretary 3. Approval of the Meeting Minutes The January 20, 2022 Planning Commission meeting minutes were approved as presented. 4. Announcements Planning Director Daryl Morey stated that the following was distributed to the Planning Commission at tonight’s meeting: • February 16, 2022 Parks, Recreation and Natural Resources Committee meeting motion regarding the Enclave of Lakeville preliminary plat. Mr. Morey reminded the Planning Commission about the work session in the Council Chambers immediately following tonight’s regular meeting. 5. Lakeville Christian Church Addition Chair Witte opened the public hearing to consider the application of Lakeville Christian Church for the following, located north of Lakeville Boulevard, west of Hamburg Avenue, and south of Hartford Way: A. Preliminary plat of one lot and two outlots to be known as Lakeville Christian Church First Addition; B. Conditional use permit to allow: 1. A religious institution (church) in the RM-1, Medium Density Residential District, 2. An exception to the exterior building finish requirements for an institutional (church) use, and 3. A fence located within the required front yard setback. Steve Griffith from Lakeville Christian Church presented a brief overview of the request. Planning Commission Meeting Minutes, February 17, 2022 Page 2 Associate Planner Frank Dempsey presented the planning report stating the previous public hearing scheduled for January 6, 2022 was removed from the agenda at the request of the applicant to allow for plan revisions based on Department of Natural Resources comments and to allow the church and school to make amendments to the site layout. The plans propose a 12,107 square foot, 750 seat sanctuary church and a future school and parking lot on proposed Outlot B. The applicants requested an exception to the exterior building finish requirements for the church, an institutional use. The project requires a preliminary and final plat for one lot and two outlots. Mr. Dempsey outlined the two outlots proposed with the preliminary and final plat. Outlot A is 2.69 acres and will include the tributary stream, wetland, floodway and flood fringe, and stormwater basins. Outlot A will be deeded to the City for wetland preservation and stormwater management purposes. Outlot B is 2.0 acres and will be retained by the owner for a possible future private school site and associated parking lot and outdoor play area. The development of Outlot B will require a separate conditional use permit and a preliminary and final plat. Mr. Dempsey explained each proposed Conditional Use Permit request and concluded by summarizing the planning reports recommended 15 stipulations outlined in the planning report and supported by the draft findings of fact noted in the February 11, 2022 planning report. Chair Witte opened the hearing to the public for comment. There were no comments from the audience. Motion was made by Lillehei seconded by Zimmer to close the public hearing at 6:19 p.m. Voice vote was taken on the motion. Ayes - unanimous Chair Witte asked for comments from the Planning Commission. Discussion points included: • Commissioner Zimmer asked about the zoning requirements and plans for the proposed private school. • Several Commissioners questioned the applicant on the need for the fence and security gates on the subject property. • Commissioners asked the applicant about the proposed exterior building materials. • Commissioner Drotning pointed out the lack of windows and unique architectural elements on the north elevation facing the existing Village Creek neighborhood. • Commissioners discussed installing additional landscaping within Outlot B adjacent to the existing single family home in Village Creek at the time the church is developed so the trees have time to grow, instead of waiting until the school site develops. Planning Commission Meeting Minutes, February 17, 2022 Page 3 • Based upon the Planning Commission’s discussion, Mr. Morey recommended the following additional stipulations: 1. Lakeville Christian Church must provide City public safety access to the site when the parking lot gates are closed. 2. Prior to City Council consideration, the building plans must be revised to add windows to the north side of the building. 3. Prior to City Council consideration, the landscape plan must be revised to add landscape screening along the north line of Outlot B adjacent to the existing single family home in Village Creek. Motion was made Majorowicz seconded by Zimmer to recommend to the City Council approval of the Preliminary Plat and Conditional Use Permit for Lakeville Christian Church subject to the following stipulations listed in the February 11, 2022 planning report, as amended, and approval of the Findings of Fact dated February 17, 2022. 1. The recommendations listed in the Engineering memorandum dated February 9, 2022. 2. The building and site shall be developed consistent with the plans approved by the City Council. 3. The Grade A exterior building materials shall not be painted. 4. Outlot A shall be deeded to the City with the final plat. 5. A zoning permit shall be issued by the City prior to the installation of any fences. 6. The landscape plan shall be amended to include parking lot screening adjacent to Hamburg Avenue as required by the Zoning Ordinance. 7. A $30,000 landscaping security shall be submitted with the final plat. 8. Parking lot lighting shall be provided in the parking lot on Lot 1. A lighting plan shall be submitted for review prior to issuance of a building permit. 9. The future private school within Outlot B, Lakeville Christian Church First Addition shall require approval of a preliminary and final plat and conditional use permit. 10. A cross access and shared maintenance agreement shall be established for the private utilities on Lot 1, Block 1 and Outlot B prior to recording the final plat. 11. A cross access and parking agreement shall be established between Lot 1, Block 1 and Outlot B prior to recording the final plat. 12. A no parking resolution shall be considered by the City Council along Hartford Way adjacent to the plat. 13. Snow storage is permitted on site only within parking spaces not required to meet minimum parking requirements of the Zoning Ordinance. Additional snow shall be hauled from the site. 14. Any outside storage of trash/recycling containers shall require a screening enclosure constructed of materials similar to the church building and in compliance with Zoning Ordinance requirements. 15. A five foot wide concrete sidewalk shall be constructed by the applicant along the west side of Hamburg Avenue from Hartford Way to the proposed driveway access. Prior to City Council consideration, the building plans must be revised to add windows to the north side of the building. 18. Prior to City Council consideration, the landscape plan must be revised to add evergreen landscape screening along the north line of Outlot B adjacent to the existing single family home in Village Creek. Enclave of Lakeville Chair Witte opened the public hearing to consider the application of Enclave of Lakeville for the following, located east of Kenwood Trail (CSAH 50) and north of 188th Street: A. Preliminary plat of nine single family residential lots to be known as Enclave of Lakeville; and B. Zoning Map amendment to rezone property from RS-2, Single Family Residential District to RS-3, Single Family Residential District. Chris Ahlbrect, owner of Superior Contracting, Inc. presented a brief overview of his project. Associate Planner Frank Dempsey presented the planning report. Mr. Dempsey stated that Mr. Ahlbrect applied for a preliminary plat, final plat and rezoning to allow the development of nine single family residential lots and two outlots on 6.41 acres of property to be known as Enclave of Lakeville. The developer requests approval of a rezoning of the properties within the proposed Enclave of Lakeville plat from RS-2, Single Family Residential District to RS-3, Single Family Residential District consistent with the zoning of the single-family neighborhoods to the east and south. Single family homes are allowed on the property subject to the RS-3 District requirements if the rezoning is approved. The proposed Enclave of Lakeville rezoning and preliminary plat are consistent with the goals and policies of the 2040 Comprehensive Plan. Mr. Dempsey indicated that the preliminary plat identifies two outlots, A and B. Outlot A is 0.47 acres and will be deeded to the City for stormwater management purposes. Outlot B is 0.60 acres and includes wetland and wetland buffer area that will be deeded to the City for stormwater management and wetland preservation purposes. The Parks, Recreation and Natural Resources Committee recommended approval of the Enclave of Lakeville preliminary plat at their February 16, 2022 meeting. Planning Commission Meeting Minutes, February 17, 2022 Page 5 Planning Department staff recommends approval of the Enclave of Lakeville preliminary plat and RS-2 to RS-3 rezoning subject to the five stipulations listed in the February 11, 2022 planning report. and approval of the Findings of Fact dated February 17, 2022. Chair Witte opened the hearing to the public for comment. There were no comments from the audience. Motion was made by Lillehei seconded by Zimmer to close the public hearing at 7:09 p.m. Voice vote was taken on the motion. Ayes – unanimous Chair Witte asked for comments from the Planning Commission. Discussion points included: • Commissioner Zimmer asked for clarification on the layout of Lot 5 in relation to Outlot B. • Commissioner Drotning commented on the unique layout Lot 5. Commissioner Einck agreed. Motion was made by Kaluza, seconded by Zimmer to recommend to City Council approval of the Preliminary Plat and Zoning Map amendment for Enclave of Lakeville subject to the following stipulations listed in the February 11, 2022 planning report, and approval of the Findings of Fact dated February 17, 2022. 1. Implementation of the recommendations listed in the February 11, 2022 engineering report. 2. Written documentation shall be submitted confirming that the water well and septic system have been sealed and removed in accordance with State of Minnesota and Dakota County requirements. 3. A minimum of six, six foot tall conifer trees shall be planted as buffer yard trees on Lot 1 as shown on the grading plan. A landscaping security of $1,500 shall be submitted with the final plat. 4. Park dedication shall be paid in cash in lieu of land at the rate in effect at the time of final plat approval. 5. Outlots A and B shall be deeded to the City with the final plat. Robert and Colleen Powell Chair Witte opened the public hearing to consider the application of Robert and Colleen Powell for the following, located at 11770, 11772 and 11774 – 205th Street: A. Comprehensive Plan amendment to re-guide property from High Density Residential and Medium/High Density Residential to Low/Medium Density Residential; and B. Zoning Map amendment to rezone property from RH-2, Multiple Family Residential District and RM-2, Medium Density Residential District to RST-2, Single and Two Family Residential District. Robert Powell presented a brief overview of their request. Planning Director Daryl Morey presented the planning report. Mr. Morey stated that the Powells are requesting amendments to the Comprehensive Plan and Zoning Map to allow additions to the existing single family homes on the three properties they own south of 205th Street. After the 2040 Comprehensive Plan was approved by the Met Council, the City updated the Zoning Ordinance and Zoning Map to bring them into compliance with the Comprehensive Plan. Because single family homes are not a permitted use in the RM-2 District, the Zoning Map Update had the inadvertent consequence of making the Powell’s existing single family homes non-conforming, which means additions would not be allowed by ordinance. The Comprehensive Plan and Zoning Map amendments proposed by the Powells will correct the non-conformity. Planning Department staff recommends approval of the Comprehensive Plan and Zoning Map amendments. Chair Witte opened the hearing to the public for comment. There were no comments from the audience. Motion was made by Kaluza, seconded by Einck to close the public hearing at 7:16 p.m. Voice vote was taken on the motion. Ayes – unanimous Chair Witte asked for comments from the Planning Commission. Discussion points included: • Commissioner Drotning supports the Powell’s requests so the inadvertent consequence from the 2040 Comprehensive Plan and Zoning Ordinance Update can be corrected. • Commissioner Lillehei thanked the Powell’s for their dedication to our community.
