Preliminary Plat Action Deadline: April 13, 2022 BACKGROUND Scannell Properties #455, LLC is proposing the development of a 46.8 acre parcel located south of 215th Street (CSAH 70) and west of Jacquard Avenue for light industrial (warehouse) uses on two lots. The proposed Comprehensive Plan and Zoning Map amendments proposes the westerly extension of the light industrial land use, zoning and development that has occurred east of the site and south of the westerly extension of 217th Street. The portion of the subject property (outlots) located north of 217th Street and south of 215th Street would remain guided and zoned for Office Park District uses. The preliminary plat includes two lots and two outlots, including the construction of a 168,000 square foot warehouse/office building on Lot 1, which would be owned by Magnum Trucking, the owner and developer of the property to the south located at 21895 Jacquard Avenue and approved with South Ryan Addition in 2021. Dakota County Plat Commission Letter PLANNING ANALYSIS COMPREHENSIVE PLAN AMENDMENT/REZONING Scannell Properties #455, LLC has submitted applications to amend the 2040 Comprehensive Land Use Plan to re-guide proposed Lots 1 and 2, Block 1, North Ryan Addition from Office Park to Warehouse/Light Industrial and also to rezone Lots 1 and 2 from OP, Office Park District to I-1, Light Industrial District. The proposed Comprehensive Plan amendment and rezoning will match the developed properties to the east, and south of 217th Street. The OP, Office Park District and the I-1, Light Industrial District have different performance standards. While warehouse uses are allowed by conditional use permit in the O-P District, the O-P District includes higher architectural and open space/landscaping standards than the I-1 District. Warehouse and cross dock distribution uses are permitted uses in the I-1 District and have reduced exterior building material and landscaping requirements. Findings of fact for the Comprehensive Plan and Zoning Map (rezoning) amendments are attached. PRELIMINARY PLAT Existing Conditions. The property consists of 46.8 acres and is roughly the north half of a 75- acre homestead parent parcel recently subdivided as part of the preliminary and final plat of South Ryan Addition approved last year. The property within the preliminary plat includes the Ryan house built in 1885 and several agricultural buildings. The property is moderately sloped from south to north and includes stands of significant trees in the northwest and southeast quadrants of the property. Surrounding Land Uses. North Ryan Addition is surrounded by the following existing or planned land uses: 3 Direction Existing Use Land Use Plan Zoning North 215th Street (CSAH 70) and Lakeville South High School Restricted Development and Public/Quasi-Public P/OS District South South Ryan Addition (under construction) Warehouse/Light Industrial I-1, Light Industrial District East Jacquard Avenue and Amazon Fulfillment Center Warehouse/Light Industrial I-1, Light Industrial District West Undeveloped Agricultural Property Office Park and Warehouse/Light Industrial OP, Office Park and I-1 Districts Lots/Block/Outlots. Two lots on one block and two outlots are proposed on the North Ryan Addition preliminary plat. The two proposed lots exceed the minimum lot area and lot width requirements of the I-1 District. Outlot A will be deeded to the City with the final plat for stormwater management purposes. Outlot B will be retained by the Ryan family for future Office Park development. The North Ryan Addition preliminary plat is adjacent to 215th Street (CSAH 70), which is designated as a principal arterial in the City’s Comprehensive Transportation Plan. The required 85 feet of south half right-of-way is shown on the preliminary plat. 215th Street was reconstructed as a four-lane divided roadway adjacent to the plat in 2021. The Dakota County Plat Commission recommended approval of the preliminary plat at its March 2, 2022 meeting. North Ryan Addition is also located adjacent to Jacquard Avenue, which is designated as a major collector in the City’s Comprehensive Transportation Plan. Jacquard Avenue is constructed as a two-lane rural roadway adjacent to the preliminary plat. No additional right-of-way needs to be dedicated. Development of North Ryan Addition includes the extension of 217th Street west of Jacquard Avenue to the west plat boundary. 217th Street is designated as a minor collector in the City’s 4 Transportation Plan and will be constructed as a 40-foot wide rural section roadway within an 80-foot right-of-way. The developer must construct a temporary turnaround at the west end of 217th Street until it is extended in the future with development of the adjacent property to the west. Development of North Ryan Addition includes the half right-of-way dedication for Ryan Avenue, which is located along the west plat boundary. Ryan Avenue will be constructed in the future to provide access to 215th Street when the adjacent property to the west develops and the west half right-of-way is dedicated. Ryan Avenue will be restricted to right-in/right-out access at 215th Street when it is constructed. Prior to City Council consideration of the final plat, Ryan Avenue will have to be changed to comply with the City’s street naming requirements. Grading, Drainage, Erosion Control, Utilities. Grading, drainage, erosion control, and utility plans have been submitted with the North Ryan Addition preliminary plat and are discussed in more detail in the March 9, 2022 engineering report. Tree Preservation. Most of the trees will be removed from the site due to proposed grading, except for trees located along the west property line and north of the gas line easement. The developer is responsible for installing tree protection fencing and any save trees that are damaged or removed will require replacement at 2:1. Wetlands. A wetland delineation was completed for the subject property in 2020. No wetlands were identified on the subject property. Park Dedication, Trails and Sidewalks. The City’s Comprehensive Parks, Trails, and Open Space Plan does not identify any future park land needs in the area of the plat. No public trails or sidewalks are being constructed with the North Ryan Addition plat. Park dedication will be satisfied with a cash fee in effect at the time of final plat approval. Park dedication for industrial zoned property is calculated a rate of $4,786 per acre (2022 rate) for the net area being final platted. SITE PLAN ANALYSIS The site development and construction plans propose a 168,000 square foot warehouse/office building on Lot 1, which is the only proposed lot being considered for formal site plan review at this time. The warehouse building will be owned by Magnum Trucking and will function together with the Magnum Trucking warehouse/cross-dock/office/maintenance building located on Lot 1, Block 1, South Ryan Addition to the south. An interconnecting driveway along the west boundary of Lot 1 will provide a cross access driveway between the two lots without vehicles 5 having to access Jacquard Avenue to move between the two sites. A signed private cross access easement in recordable form shall be submitted to the City prior recording the final plat. Setbacks. The building setback requirements of the I-1 District are being met with the proposed site plans for Lot 1, Block 1 as follows: Required Setbacks Lot 1 Front Yard (north)-- 40 feet Front (217th St.) – 165 feet Side Yard (east) - 10 feet Side Yard (west) - 10 feet Side (East) – 62.5 feet Side (West) – 113 feet Rear Yard (south)--30 feet Rear (South) – 281 feet Parking. The proposed 168,000 warehouse/office building will require a minimum of 188 parking spaces based on the estimated warehouse and office use square footage. The site plan proposes the initial construction of 101 vehicle parking spaces, including six ADA accessible parking spaces, and the deferment of 96 spaces for a total of 197 parking spaces, which exceeds Zoning Ordinance requirements by 9 spaces. The Zoning Ordinance allows for up to 50% of the required parking spaces to be deferred. All drive aisles and parking stalls comply with the required aisle width of 24 feet and parking stall dimensions of 9 feet in width and 18 or 20 feet in length depending if they are tandem spaces or overhang a curb. All driveways, loading dock areas and trailer parking spaces are of adequate size to accommodate two-way traffic and backing and turning movements. The driveways provide adequate width and turning radii to accommodate truck turning movements and emergency vehicle access. Access. Lot 1, Block 1, North Ryan Addition proposes two driveway accesses to 217th Street. Driveway access design to 217th Street meets Zoning Ordinance requirements for location, setback and width. 6 Outdoor Storage. Outdoor storage of equipment is not proposed other than semi-trailers to be located on the south side of the warehouse building, which are permitted as an accessory use in the I-1 District. Landscaping/Screening. The landscape plan proposes 164 overstory, evergreen, and ornamental trees and a variety of shrubs as noted in the table below: Landscape Materials 76 Overstory trees (2.5 inch min. diameter) 62 Conifer trees (8 foot minimum height) 26 Ornamental trees (2 inch min. diameter) 323 Variety of shrubs and perennial plantings All landscaped areas within and adjacent to the parking lot, including landscaped islands, shall be irrigated in compliance with Zoning Ordinance requirements. All areas not planted with trees, shrubs or perennials will be seeded with a natural grass mixture as shown on the landscape plan. A landscape security shall be submitted with the final plat to guarantee installation of the approved landscaping. The security amount will be determined by the developer’s landscaping contractor prior to City Council consideration of the final plat. Building Height/Exterior Materials. The warehouse building on Lot 1 will be one-story and 38 feet in height in compliance with I-1 District requirements. It will be constructed of pre-cast concrete panels accented with narrow pre-finished metal decorative panels. The north and south walls will include dock doors along the entire length of each wall. The building will be painted gray with blue accents. The exterior building materials comply with Zoning Ordinance requirements for the I-1 District. Signage. The I-1 District allows one wall sign not to exceed 200 square feet for individual tenant buildings with a gross floor area of 45,000 square feet or more and a freestanding sign not to exceed 100 square feet with a maximum height of 10 feet. A sign permit must be issued by the Planning Department prior to the installation of any signs. Site Lighting. Exterior lighting fixtures and specifications have been submitted indicating the parking lot and site lighting will be LED downcast fixtures on 30 foot tall poles with a three foot base. Wall mounted lights are proposed to be downcast fixtures. The light fixtures meet Zoning Ordinance requirements. A photometric plan has not been submitted. The Zoning Ordinance requires not more than one foot-candle of light measurement at any property line. The photometric plan must be submitted prior to City Council consideration of the preliminary plat. 7 Trash and Recycling Enclosure. A trash enclosure is not identified on the plans. A trash compactor is noted on the Key Notes but does not appear on the plan sheet. Any outside trash containers must be stored within a six-foot tall enclosure constructed of similar materials as the building, including a durable, maintenance free gate. Snow Storage. Snow storage may not take place in required parking spaces. RECOMMENDATION Planning Department staff recommends approval of the North Ryan Addition Comprehensive Plan and Zoning Map amendments and preliminary plat subject to the following stipulations: 1. The recommendations listed in the Engineering Division memorandum dated March 9, 2022. 2. Outlot A shall be deeded to the City with the final plat. 3. The developer shall construct a temporary turnaround at the west end of 217th Street until it is extended in the future with the development of the adjacent property to the west. 4. Prior to City Council consideration of the final plat, the name for proposed Ryan Avenue must be changed to comply with the City’s street naming requirements. 5. The Lot 1 site and building shall be developed and constructed consistent with the preliminary plat plans approved by the City Council. 6. A private cross access easement agreement between Lot 1, Block 1, North Ryan Addition and Lot 1, Block 1, South Ryan Addition shall be required with the final plat. 7. A parking deferment agreement shall be applied for and approved prior to issuance of a building permit for Lot 1 as noted on the preliminary plat plans. 8. A landscaping security shall be submitted for Lot 1 with the final plat. 9. All signs shall comply with Zoning Ordinance requirements for the I-1 District. A sign permit shall be issued by the Planning Department prior to the installation of any signs. 8 10. Site lighting shall not glare onto public streets and shall not exceed one-foot candle at the property line. A photometric lighting plan shall be submitted for Lot 1 prior to City Council consideration of the preliminary plat. 11. Snow storage shall not take place in required parking spaces. The plat is adjacent to CSAH 70 (215th St. W.) and is therefore subject to the Dakota County Contiguous Plat Ordinance. The revised plat includes an access location on western portion of the plat (Ryan Avenue), which will be a restricted access location to CSAH 70. The right-of-way needs for a 4-lane divided roadway are 75 feet of half right of way, which has been met on the proposed plat. Restricted access should be shown along all of CSAH 70 except for Ryan Avenue. A quit claim deed to Dakota County for restricted access is required with the recording of the plat mylars. The Plat Commission has approved the preliminary and final plat, provided that the described conditions are met, and will recommend approval to the County Board of Commissioners on March 22, 2022. Traffic volumes on CSAH 70 are 13,300 ADT and are anticipated to be 16,800 ADT by the year 2040. The Planning Commission conducted a public hearing on the applications preceded by published and mailed notice. The applicant was present and the Planning Commission heard testimony from all interested persons wishing to speak. FINDINGS OF FACT 1. North Ryan Addition is located in Comprehensive Planning District 6, which guides the property for Office Park and Warehouse/Light Industrial development. Scannell Properties #455, LLC has applied to re-guide a portion of the subject property from Office Park to Warehouse/Light Industrial. 2. North Ryan Addition is zoned OP, Office Park District and I-1, Light Industrial District. Scannell Properties #455, LLC has applied to rezone a portion of the subject property from OP District to I-1 District. 3. The legal description of the property for which the Comprehensive Plan and Zoning Map amendments is requested is identified as Lots 1 and 2, Block 1 on the North Ryan Addition preliminary plat. 4. Chapter 11-3-3.E of the Zoning Ordinance provides that the Planning Commission consider possible effects of the proposed amendments based upon, but not limited to, the following factors: a. The proposed action has been considered in relation to the specific policies and provisions of and has been found to be consistent with the official City Comprehensive Plan. Finding: The property is located in Planning District No. 6 of the 2040 Comprehensive Land Use Plan. The proposed Comprehensive Plan and Zoning Map amendments will 2 meet policies outlined in Planning District No. 6 and will be consistent with the 2040 Comprehensive Land Use Plan. Existing sanitary sewer and water utilities are available to serve the property with capacity to serve the planned warehouse/office development proposed with the preliminary plat. The proposed uses will not overburden the City’s service capacity. e. Traffic generated by the proposed use is within capabilities of streets serving the property. Development of North Ryan Addition includes the construction of multiple privately owned and maintained stormwater management basins along with one publicly owned and maintained stormwater management basin. The public stormwater management basin will be located on Outlot A. The Developer shall enter into a private stormwater maintenance agreement with the final plat for the private basins. The stormwater management design is consistent with City Ordinance requirements. Following completion of the site improvements and restoration, the Developer shall conduct two double ring infiltrometer tests in the location of the infiltration basin to demonstrate that the design infiltration rates have been achieved. The Developer shall provide a security with the final plat to ensure that this testing is completed. The final grading plan shall identify all fill lots in which the building footings will be placed on fill material. The grading specifications shall also indicate that all embankments meet FHA/HUD 79G specifications. The Developer shall certify to the City that all lots with footings placed on fill material are appropriately constructed. Building Certificates of Occupancy will not be issued until a soils report and an as-built certified grading plan have been submitted and approved by City staff. North Ryan Addition contains more than one acre of site disturbance. The Trunk Storm Sewer Area Charge has not been collected on the parent parcel and must be paid with the final plat. Final locations and sizes of all storm sewer facilities will be reviewed by City staff with the building permit application and final construction plans. FEMA FLOODPLAIN ANALYSIS North Ryan Addition is shown on the Flood Insurance Rate Map (FIRM) as Zone X by the Federal Emergency Management Agency (FEMA). Based on this designation, the plat is not located within a Special Flood Hazard Area (SFHA), as determined by FEMA. WWEETTLLAANNDDSS A wetland delineation report was completed and approved in 2020. No wetlands were identified within the project area. TTRREEEE PPRREESSEERRVVAATTIIOONN Due to site grading most of the significate trees on the site will be removed except for trees located along the west property line and north of the gas line easement. The developer is responsible for installing tree protection fencing. Any save trees that are damaged or removed will require replacement at 2:1. EERROOSSIIOONN CCOONNTTRROOLL The Developer is responsible for obtaining a MPCA Construction Permit for the site as well as maintaining the SWPPP for the site during construction. The permit requires that any changes made throughout construction must be documented in the SWPPP. A maintenance schedule for the establishment of vegetation in the basins must be submitted to the City for review prior to the start of grading. Additional erosion control measures may be required during construction as deemed necessary by City staff. Any additional measures required shall be installed and maintained by the developer.
