The Pheasant Run of Lakeville Eighth Addition preliminary plat is located east of Pilot Knob Road (CSAH 31) and north of 179th Street (future CSAH 9). The Pheasant Run of Lakeville Eighth Addition preliminary plat plans have been distributed to Engineering Division and Parks and Recreation Department staff, and the Parks, Recreation and Natural Resources Committee. The development site consists of one parcel, Outlot D, Pheasant Run of Lakeville Seventh Addition. Some preliminary grading has occurred on site (Exhibit A). Consistency with the Comprehensive Plan. The Pheasant Run of Lakeville Eighth Addition property is located in Planning District 3 of the 2040 Comprehensive Plan. Planning District 3 guides the subject property for low/medium density residential where city sewer is available. MUSA. The Pheasant Run of Lakeville Eighth Addition preliminary plat area is located within the current MUSA. Zoning. The parcel is currently zoned RST-2, Single and Two Family Residential District. Detached townhomes are a permitted use in the RST-2 District (Exhibit B). Adjacent Land Uses. Adjacent land uses and zoning are as follows: North – North Creek, future North Creek Greenway (RST-2 and P/OS) East – 179th Street (future CSAH 9), North Creek (RST-2) South – Future stormwater pond (RST-2), 179th Street (Future CSAH 9) West – Single family home lots (RST-2) Consistency with the Capital Improvement Plan (CIP). City streets, sanitary sewer and water improvements for the area of Pheasant Run of Lakeville Eighth Addition will be financed and constructed by the developer. The development costs associated with the Pheasant Run of Lakeville Eighth Addition development are not programmed in the 2022–2026 CIP. Premature Subdivision Criteria. A preliminary plat may be deemed premature if any of the criteria listed in Chapter 10-2-4-1 of the Subdivision Ordinance exist. Eligible criteria pertain to a lack of adequate: drainage, water, streets, sanitary sewer, and public service capacity (police and fire protection). The other pertinent criteria pertain to inconsistencies with the City Comprehensive Land Use and Capital Improvement Plans (discussed above). Staff review of the Pheasant Run of Lakeville Eighth Addition preliminary plat against these criteria finds that it is not a premature subdivision. Density/Average Lot Size. The Pheasant Run of Lakeville Eighth Addition preliminary plat consists of 33 detached townhome lots on 9.14 acres. This results in a gross overall density of 3.61 units per acre. Excluding the future stormwater ponding outlot, the net density is 3.91 units per acre. Lot Requirements. The proposed unit lots shown on the Pheasant Run of Lakeville Eighth Addition preliminary plat have sufficient area to accommodate detached units. A 3 | Page homeowner’s association will be required to be established for ownership and maintenance of Lot 16, Block 1, Lot 9, Block 2, and Lot 11, Block 3. The RST-2 District requires at least 5,000 square feet per unit. The Pheasant Run of Lakeville Eighth Addition preliminary plat has an average of just over 11,000 square feet per unit for the detached townhomes area, which exceeds the minimum lot area per unit requirements of the RST-2 District. Setbacks. The following minimum requirements for detached townhome building setbacks in the RST-2 District pertain to the Pheasant Run of Lakeville Eighth Addition preliminary plat: Base Lot Between Buildings (Detached Units) Front Yard (to ROW) RST-2 30 feet 14 feet 20 feet (front), 25 feet (garage) The proposed building pads shown on the Pheasant Run of Lakeville Eighth Addition grading, drainage and erosion control plan indicate that all 33 detached townhomes have adequate building pad areas that meet setback requirements. Exterior Materials. Each townhouse unit must meet the requirements of Section 11-57- 19.B.3, which requires that a minimum of 25% of the area of each elevation of the unit must have an exterior finish of brick, stucco, and/or natural or artificial stone. Except for brick, stucco, and/or natural or artificial stone, no single elevation may have more than 75% of one type of finish or have more than 60% of all elevations of one type of finish. The City has deemed the use of cement fiberboard material as satisfying the minimum masonry material requirement and is therefore also allowed to exceed the maximum area limit for non-masonry materials. Floor Area. The proposed detached townhome units must comply with the minimum requirements for above grade floor area established by Section 11-17-13.D of the Zoning Ordinance. Garage Area. The detached townhome units are all proposed to include a basement so the minimum area of each garage must be at least 440 square feet. Each garage must have a minimum interior width of 20 feet. Unit Landscaping. Landscaping plans for required foundation plantings around the detached townhome units will be required with the final plat. The Developer must also provide information to demonstrate conformance with the requirements of Section 11- 57-19.G. Outlots. There is one outlot totaling 0.70 acres in the Pheasant Run of Lakeville Eighth Addition preliminary plat. Outlot A will consist of a stormwater management basin that will be deeded to the City with the final plat. 4 | Page Phasing. Pheasant Run of Lakeville Eighth Addition is proposed to be developed in one phase. Streets. The following is a summary of streets proposed with the Pheasant Run of Lakeville Eighth Addition preliminary plat. Additional detailed information is outlined in the Engineering Division memorandum dated March 25, 2022. 179th Street (future CSAH 9) – 179th Street is a future minor arterial highway as identified in the City’s Transportation Plan. The 120 feet of required right of way was dedicated with previous Pheasant Run of Lakeville plats, so no additional right of way is required to be dedicated. Given the proximity of this plat to the crossing of North Creek, the construction of 179th Street adjacent to the Pheasant Run of Lakeville Eighth Addition plat will be completed with the future bridge construction over North Creek, in conjunction with the proposed Brookshire development. The Developer shall provide an escrow with the final plat for the portion of future 179th Street to be constructed adjacent to the plat. See the March 25, 2022 Engineering memo for more information. Ellsworth Drive – Ellsworth Drive will be a 32-foot-wide residential street constructed within a 60-foot right-of-way. The street will extend from its current terminus east of Embers Avenue and will connect to 179th Street, which will be a future right-in/right-out access to 179th Street based on Dakota County access spacing guidelines. A five-foot-wide concrete sidewalk will be constructed along the south side of the street. If Ellsworth Drive is constructed prior to 179th Street, the Developer will be required to construct a temporary cul-de-sac, provide a temporary easement over the temporary cul-de-sac, and place a “Future Street Extension” sign and barricades at the southeast terminus. Elkwood Court – Elkwood Court will be a 32-foot-wide residential street constructed within a 60-foot-wide right-of-way that ends in a permanent cul-de-sac. All streets meet the minimum width and design requirements of the Subdivision Ordinance. Sidewalks/Trails. The developer will construct a five-foot-wide concrete sidewalk along one side of Ellsworth Drive. The City is partnering with Dakota County to construct a greenway trail along North Creek later this year. That trail will provide a connection to the North Creek neighborhood park to the north, which will also be constructed later this year. Grading, Drainage, Erosion Control, and Utilities. Proposed grading, drainage, erosion control, and utilities for the Pheasant Run of Lakeville Eighth Addition preliminary plat is shown on the grading, drainage and erosion control and utility plans. All existing and new local utilities shall be placed underground. Grading, drainage, erosion control, and utilities details are outlined in the March 25, 2022 engineering report prepared by Alex Jordan, Assistant City Engineer and Mac Cafferty, 5 | Page Environmental Resources Manager. The Engineering Division recommends approval of the preliminary plat. Tree Preservation. The site was mass graded with a previous phase of development. No additional significant trees are proposed to be removed. Wetlands. There are no wetland impacts with this plat. Residential Buffer Yard Requirements. Lot 11, Block 3, adjacent to 179th Street, includes the planting of seven coniferous and overstory trees to provide a landscape buffer to the detached townhome units. The buffer yard screening must provide an effective minimal visual screen to a height of 10 feet. The landscape plan must be modified to shift the evergreen trees such that they are planted a minimum of 25 feet from property lines adjacent to public right-of-way, to ensure that the mature growth of the evergreen trees does not extend into the public right of way (Exhibit E). The common area lot must be sodded to the trail abutting 179th Street. Park Dedication. Park dedication will be satisfied through a cash contribution with the final plat. The Parks, Recreation and Natural Resources Committee will review the preliminary plat at their April 6, 2022 meeting. Signs. No subdivision identification monument signs are proposed with the Pheasant Run of Lakeville Eighth Addition preliminary plat. Plat Commission. The Dakota County Plat Commission reviewed and approved the preliminary plat at their March 2, 2022 meeting. The Plat Commission letter is included as Exhibit H. RECOMMENDATION Planning Department staff recommends approval of the Pheasant Run of Lakeville Eighth Addition preliminary plat, subject to the following stipulations: 1. Implementation of the recommendations listed in the March 25, 2022 engineering report. 2. Park dedication shall be satisfied with a cash contribution paid with the final plat. 3. The developer shall construct a five-foot-wide concrete sidewalk along the south side of Ellsworth Drive. 4. Outlot A shall be deeded to the City with the final plat. 5. If a subdivision monument sign is proposed for the development, it must be maintenance free and located on private property. A sign permit is required prior to installation of the sign. 6. With the final plat, the Developer shall provide an escrow for the portion of future 179th Street to be constructed adjacent to the plat. 6 | Page 7. Prior to City Council consideration, the landscape plan must be modified to address the City Forester’s comments. Buffer yard landscaping shall be installed according to the approved landscape plan and a security for the buffer yard landscaping shall be submitted with the final plat. The plat is adjacent to Future County Road 179th St. W. and is therefore subject to the Dakota County Contiguous Plat Ordinance. The proposed plat is a replat of Outlot D, PHEASANT RUN OF LAKEVILLE SEVENTH ADDITION. No additional right of way required along future CR (179th Street). Restricted access should be shown along all of 179th Street except for Ellsworth Drive. A quit claim deed to Dakota County for restricted access is required with the recording of the plat mylars. The Plat Commission has approved the preliminary and final plat, provided that the described conditions are met, and will recommend approval to the County Board of Commissioners on March 22, 2022. Traffic volumes on Future County Road 179th St. W. are yet to be determined. Traffic volumes may indicate that current Minnesota noise standards for residential units could be exceeded for the proposed plat. Residential developments along County highways commonly result in noise complaints. In order for noise levels from the highway to meet acceptable levels for adjacent residential units, substantial building setbacks, buffer areas, and other noise mitigation elements should be incorporated into this development. No work shall commence in the County right of way until a permit is obtained from the County Transportation Department and no permit will be issued until the plat has been filed with the County Recorder’s Office. The Plat Commission does not review or approve the actual engineering design of proposed accesses or other improvements to be made in the right of way. Nothing herein is intended to restrict or limit Dakota County’s rights with regards to Dakota County rights of way or property. The Developer previously stockpiled construction fill on the south side of the parent parcel per the stockpile permit approved May 2, 2019. A wastewater treatment plant was previously located on the parent parcel, which has been removed. The Developer has prepared a Phase 1 ESA, Phase 2 ESA and Response Action Plan for approval by the MPCA for remediation of the possible waste disposal or abandonment of structures, wastewater sludge and demotion debris. The RAP recommends: • Excavation and removal off site of soils and wastes in two locations • An environmental professional must be present to conduct vial inspections during excavation with periodic screening using PID to confirm absences of VOC or petroleum contaminates • Any excavated soils found to have organic vapors above screening criteria must be segregated and stockpiled for testing to determine any special disposal requirements. The RAP must be approved by the MPCA prior to site grading. SSTTRREEEETT AANNDD SSUUBBDDIIVVIISSIIOONN LLAAYYOOUUTT 179th Street (Future CSAH 9) Pheasant Run of Lakeville Eighth Addition is located northwest of and adjacent to 179th Street (Future CSAH 9), a future minor arterial highway, as identified in the City’s Transportation Plan. The right-of-way for 179th Street was dedicated with previous phases of Pheasant Run of Lakeville. 179th Street is designated as a future County Roadway, as identified in the Dakota County East-West Corridor Preservation Study completed in 2006. The current Dakota County Plat Review Needs Map indicates a 120-foot-wide right-of-way requirement and designates this roadway as a three-lane roadway over its entire length adjacent to the plat. Given its proximity to the North Creek crossing, construction of 179th Street adjacent to the plat will be completed with the future bridge construction over North Creek, in conjunction with the proposed Brookshire development. The Developer shall provide an escrow with the final plat for the portion of future 179th Street to be constructed within the plat. The Developer must grade the right-of-way area of future 179th Street to its ultimate profile to avoid future grading impacts on the adjacent lots. The Developer shall also design the plat’s storm sewer and stormwater management basins with sufficient capacity to convey and treat the runoff generated from future 179th Street adjacent to the plat. Ellsworth Drive Development of Pheasant Run of Lakeville Eighth Addition includes the construction and extension of Ellsworth Avenue, a local roadway. Ellsworth Avenue is designed as a 32-foot wide, two-lane urban roadway with a five-foot wide concrete sidewalk along one side of the street. The Developer is dedicating 60-feet of right-of-way for the local roadway. Ellsworth Drive will provide a future right-in/right-out access to 179th Street based on the County’s Access Spacing Guidelines. If Ellsworth Drive is constructed prior to the construction of 179th Street, the Developer shall construct a temporary cul-de-sac, grant an easement over the cul-de-sac, and install a “Future Street Extension” sign and barricades at the southeastern terminus of Ellsworth Drive until it is extended in the future. Elkwood Court Development of Pheasant Run of Lakeville Eighth Addition includes the construction of Elkwood Court, a local roadway terminating in a cul-de-sac. The local roadway is designed as 32-foot wide, two-lane urban roadway. The Developer is dedicating 60-feet of right-of-way for Elkwood Court. CCOONNSSTTRRUUCCTTIIOONN AACCCCEESSSS A single construction traffic access and egress for grading, utility and street construction shall be from 179th Street. No access to the adjacent local residential roadways will be permitted. PPAARRKKSS,, TTRRAAIILLSS AANNDD SSIIDD EEWWAALLKKSS Development of Pheasant Run of Lakeville Eighth Addition includes the construction of public sidewalks. A five-foot wide concrete sidewalk, with pedestrian curb ramps, will be installed along one side of the Ellsworth Drive. The North Creek Regional Greenway is located on the northeast side of the parent parcel. The City and County are partnering on the final engineering design for the greenway trail and construction is programmed for 2022. The necessary park area for the greenway trail was dedicated with the Pheasant Run of Lakeville Seventh Addition final plat. No additional park land is necessary from the parent parcel. The North Creek Regional Greenway will connect Pheasant Run of Lakeville Eighth Addition to the North Creek Neighborhood Park that will be constructed this year. The Park Dedication requirement has not been satisfied for the parent parcel and will be required to be satisfied through a cash dedication with the final plat. Public sanitary sewer will be extended within the subdivision to provide sewer service to the development. Wastewater will be conveyed to the MCES Farmington Interceptor and continue to the Empire Wastewater Treatment Facility. The Sanitary Sewer Availability Charge has not been collected on the parent parcel and shall be paid with the final plat. The fee will be based on the rate in effect at the time of final plat approval. WWAATTEERRMMAAIINN Development of Pheasant Run of Lakeville Eighth Addition includes the extension of public watermain. Watermain will be extended within the development from watermain constructed in Ellsworth Drive and the north side of Eclipse Avenue within Outlot C, Pheasant Run of Lakeville 6th Addition to provide water service to the subdivision. Final locations and sizes of all storm sewer facilities will be reviewed by City staff with the final construction plans. DDRRAAIINNAAGGEE AANNDD GGRR AADDIINNGG Pheasant Run of Lakeville Eighth Addition is located within subdistrict NCL-71 and NCL-72 of the North Creek stormwater district as identified in the City’s Water Resources Management Plan. Development of Pheasant Run of Lakeville Eighth Addition includes expansion of public stormwater management basin to collect and treat the stormwater runoff generated from the site. The basin will provide water quality treatment and rate control of the stormwater runoff generated from the subdivision and from future 179th Street adjacent to the plat. The stormwater management basin will be located within Outlot A which will be deeded to the City with the final plat. The final grading plan shall identify all fill lots in which the building footings will be placed on fill material. The grading specifications shall also indicate that all embankments meet FHA/HUD 79G specifications. The Developer shall certify to the City that all lots with footings placed on fill material are appropriately constructed. Building permits will not be issued until a soils report and an as-built certified grading plan have been submitted and approved by City staff. Pheasant Run of Lakeville Eighth Addition contains more than one acre of site disturbance. Storm sewer will be installed within the subdivision to collect and convey stormwater runoff generated from within the public right-of-way and lots to the public stormwater management basin located within Outlot A. The storm sewer design will be reviewed with the final construction plans to ensure it is in accordance with the future storm sewer design along 179th Street. Draintile construction is required in areas of non-granular soils within Pheasant Run of Lakeville Eighth Addition for the street sub-cuts and lots. Any draintile construction, including perimeter draintile required for building footings, which is deemed necessary during construction shall be the Developer’s responsibility to install and finance. The Trunk Storm Sewer Area Charge has not been collected on the parent parcel, and must be paid with the final plat. The fee will be based on the rate in effect at the time of final plat approval. Final locations and sizes of all storm sewer facilities will be reviewed by City staff with the final construction plans. FEMA FLOODPLAIN ANALYSIS Pheasant Run of Lakeville Eighth Addition is shown on the Flood Insurance Rate Map (FIRM) as Zone X with some northern portions as Zone AE by the Federal Emergency Management Agency (FEMA). Based on this designation, there are no areas in the plat located within a Special Flood Hazard Area (SFHA), as determined by FEMA. WWEETTLLAANNDDSS There are no wetland impacts associated with the plat. All wetland and creek buffers will be placed in outlots dedicated to the City with the final plat. Natural area signs are required to be installed along all wetland/creek buffer areas. Final sign locations will be identified in the field. The Developer shall provide a security to ensure proper seeding and maintenance. The Developer is responsible for meeting all the requirements of the MPCA Construction Permit. The permit requires that all erosion and sediment BMPS be clearly outlined in a site’s SWPPP. Changes made throughout construction must be documented in the SWPPP. Erosion control blanket and seeding is required in all rear yard lot swales and ditches that are within 200 feet of a storm sewer inlet. It is the developer’s responsibility to establish all stormwater basin and City owned Outlots with the appropriate native seed mix. The developer must install silt fence around the basins once the basins are graded. The silt fence north of block 1 must be move to the property line and outside the City outlot. Additional erosion control measures may be required during construction as deemed necessary by City staff. Any additional measures required shall be installed and maintained by the Developer. RREECCOOMMMMEENNDDAATTIIOONN Engineering recommends approval of the Pheasant Run of Lakeville Eighth Addition preliminary plat, grading and erosion control plan, and utility plan subject to the requirements and stipulations within this report.
