Davis Medical Building Height Conditional Use Permit Application Action Deadline: May 16, 2022 INTRODUCTION Mark A. Davis has submitted an application for a conditional use permit to allow the construction of a 59-foot, eight inch tall 100,000 square foot medical office building to be located on property at 18465 Orchard Trail. The property is zoned PUD, Planned Unit Development District which allows a maximum building height of three stories or 35 feet subject to increased setback requirements and approval of a conditional use permit. The properties included in the proposed development are two platted parcels requiring site plan approval. EXHIBITS A. Location and Zoning Map B. Aerial Photo C. SRF Consulting Traffic Study Executive Summary Findings, Conclusions, and Recommendations (4 Pages) 2 PLAN A NALYSIS Surrounding Land Uses and Zoning North – Wetlands, Orchard Trail, former Best Buy building (PUD District) South – 185th Street (CSAH 60) and Family of Christ Lutheran Church (RS-3 District) East – Commercial Retail/Restaurants, Northlake Lots Apartments, Orchard Trail, (PUD District) West – Wetland, Commercial Retail/Restaurants/Service Businesses (PUD District) Property. The subject property includes two platted lots described as Lots 3 and 4, Block 1, Timbercrest at Lakeville 3rd Addition totaling 4.23 acres in area. The Timbercrest at Lakeville preliminary plat was approved in 2001. The site was preliminary graded in 2005. The development of the first phase commercial retail/restaurant and parking lot was completed in 2008. The subject property is served with City sewer and water services. Lots 3 and 4, Block 1 associated with this development shall be combined by administrative approval of a zoning lot letter and the combination of the properties into a single tax parcel subject to approval of the Dakota County Assessor. Zoning. PUD District with underlying zoning controls that apply to the C-3, General Commercial District. Timbercrest at Lakeville Master Site Plan and Timbercrest at Lakeville 3rd Addition Site Plan. The existing commercial multi-tenant building on Lot 2 was constructed in 2008 and totals 15,500 square feet. A 5,100 square foot dental office received administrative site plan approval in 2021 for construction on Lot 1 and is pending building permit issuance. The site proposed for the new 100,000 square foot medical office building would replace two planned 15,000 square foot and 20,000 square foot retail buildings for Lots 3 and 4 envisioned on the original master site plan. Vehicle Circulation. Vehicles will enter the property from one of two driveway accesses onto Orchard Trail. There is an existing shared access to the Timbercrest at Lakeville 3rd Addition onto Orchard Trail. This access will remain and is located directly across from the Speedway motor fuel and convenience store located approximately 350 feet north of the 185th Street (CSHA 60) intersection. A new driveway access will be located approximately 255 to the north of the existing access directly across the new Northlake Lofts apartment building site. Parking. The 100,000 square foot medical office building requires a minimum of 450 vehicle parking spaces. The site proposes two levels of parking both surface and below ground totaling 460 spaces. Surface parking will be available as shared parking as envisioned with the Timbercrest at Lakeville 3rd Addition master site plan. The ordinance requires 87 parking spaces for the existing multi-tenant building of which 76 spaces are constructed on the commercial 3 building that includes Buffalo Wild Wings. The retail building has been utilizing 32 existing spaces on the owner of the proposed medical office building lot and approximately 65 existing spaces on the property owned by the proposed Moldrem Dentistry lot. The developer of the medical office building will be adding 102 additional surface spaces in front of the existing multi- tenant retail building in addition to 146 new surface spaces on Lots 3 and 4 for a total of 248 new surface parking spaces. An additional 212 parking spaces are in the below grade ramp for a total of 460 parking spaces, or 10 spaces more than the minimum number required. No existing parking spaces will be removed or otherwise impacted by the construction of the medical office building. Parking will be shared in accordance with a recorded shared access and parking easement between all properties within the development after completion of construction. Peak occupancy of the existing and proposed buildings are expected to complement each other in terms of daytime and evening prime occupancies. Dakota County Highway Department Review and Access Conditions at 185th Street (CSAH 60). Timbercrest at Lakeville has two accesses to 185th Street. The principal signalized access is located at Kenrick Avenue to the west of the proposed medical building site. The second access is at Orchard Trail which allows unrestricted turning movements without traffic signals. Dakota County provided review and input into the site plan proposal in addition to the findings outlined in the SRF Consulting traffic study. Dakota County has indicated that traffic projections and existing traffic patterns can be accommodated with existing road infrastructure. Dakota County does not anticipate that anticipated traffic volumes will warrant a traffic signal or construction of other intersection improvements and 185th Street (CSAH 60) and Orchard Trail at the time the medical building is occupied. Dakota County does monitor intersections along County Roads for possible future improvements. The summary findings of the SRF Consulting traffic study are attached as Exhibit I. Landscaping. Landscape plantings will be distributed throughout the site and will include various shade and evergreen trees and shrubs to complement existing landscape on Lot 2 and the future dental building property on Lot 1. Existing trees surround the north and west sides of Lots 3 and 4 with the protected wetland areas. The proposed evergreen trees and ornamental trees are less than the minimum size required. Evergreen trees require a minimum height of 8 feet. Ornamental trees require a minimum caliper of 2 inches. The landscape plan shall be amended prior to City Council consideration of the conditional use permit. Proposed Landscape Materials 25 Overstory trees (2.5 inch min. diameter) 5 Conifer trees (8 foot minimum height) 5 Ornamental trees (2 inch min. diameter) 153 Various Shrubs and perennials 4 Building Archit ecture/Exterior Materials. The building exterior is proposed to be primarily of Grade A materials including brick, stone, and glass on all four walls. The exterior materials comply with the requirements outlined in Zoning Ordinance 11-17 for commercial buildings and is consistent with the exterior materials of buildings within Timbercrest at Lakeville. Site and Building Lighting. A detailed site and building lighting plan have not yet been submitted and will be required prior to issuance of a building permit. All lighting on site and on the building shall be downcast only and consistent with the lighting within the Timbercrest PUD. Site and building lighting shall be reviewed by staff prior to issuance of a building permit to determine compliance with Zoning Ordinance requirements. Building Height Criteria. Section 11-73-15 of the Zoning Ordinance sets a maximum building height of 35 feet unless approved by conditional use permit. The proposed 100,000 square foot building would be 59 feet, eight inches tall. Section 11-17-7 of the Zoning Ordinance allows buildings to exceed the height limitations established within the individual zoning districts through a conditional use permit provided that: 1. The site is capable of accommodating the increased intensity of use (building height). The proposed building complies with the minimum setback requirements for a 60-foot tall building in the Timbercrest at Lakeville PUD. The proposed development meets the minimum parking requirements and street abutting the site can accommodate the proposed traffic caused by the additional 25-foot building height. 2. The increased intensity of use does not cause an increase in traffic volumes beyond the capacity of the surrounding streets. The proposed 59 foot, eight inch tall building will not increase traffic volumes beyond what can be accommodated by the surrounding streets in accordance with the findings established in the traffic study completed by SRF Consulting Engineers and reviewed by city staff and Dakota County. (See Exhibit I). 3. Public utilities and services are adequate. Sanitary sewer, city water, storm sewer utilities, and streets are in place to accommodate the proposed 100,000 square foot medical office building. 4. For each additional story over three (3) stories or for each additional ten feet (10') above thirty-five feet (35'), front and side yard setback requirements shall be increased by five feet (5'). The proposed building will include four levels with a proposed height of 59, eight inches. The Zoning Ordinance requires additional building setbacks of five feet for each 10 feet of additional building height. Minimum setbacks for a 35-foot tall or shorter building is: Front Yard – 30 feet 5 Side Yards – 10 feet Rear Yard (abutting street) – 30 feet Proposed building setbacks: Front Yard – 400+ feet Side Yards – 26 feet (east) 28 feet (west) Rear Yard – 40 feet (abutting 185th Street) The proposed building will comply with minimum setback requirements for a 59 foot, eight inch tall building. 5. The increased height is not in conflict with airport zoning regulations as provided in chapter 36 of this title. The proposed 59-foot tall building is not located within the Airlake Airport or other airport runway safety zone. 6. The performance standards and criteria of chapter 4 of this title are considered and satisfied. Chapter 4 of the Zoning Ordinance sets forth the criteria required for consideration of a conditional use permit. Findings of fact are drafted for the proposed conditional use permit. Findings of Fact for the proposed building height conditional use permit are attached RECOMMENDATION Planning Department staff recommends approval of a conditional use permit to allow a 59 foot, 8-inch tall commercial office building at Timbercrest at Lakeville 3rd Addition subject to the following stipulations: 1. The site and building improvements shall be developed according to the plans approved by the City Council. 2. The building roof height shall not exceed 59.8 feet as defined by the Zoning Ordinance and identified on the architectural plans attached to the planning report. 3. All building and freestanding signage shall comply with the Zoning Ordinance requirements. Signage shall require approval of a sign permit prior to installation. 4. The landscape plan shall be revised prior to City Council consideration of the conditional use permit to reflect minimum tree size requirements. 6 5. Site and building lighting shall be reviewed by staff prior to issuance of a building permit to determine compliance with Zoning Ordinance requirements. 6. Lots 3 and 4, Block 1 associated with this development shall be combined by administrative approval of a zoning lot letter and the combination of the properties into a single tax parcel subject to approval of the Dakota County Assessor. 7. The developer shall dedicate to the City a drainage and utility easement over the proposed storm sewer under the proposed driveway access and a stormwater ponding easement over expanded basin on Lot 4, Block 1. ! The proposed development consists of 101,500 square feet of medical-dental office building and 457 surface and structured parking spaces. Vehicular access to/from the proposed site is planned at one location on Orchard Trail, opposite the Timbercrest 9th Apartments/former Best Buy secondary site access. Based on field observations, engineering judgement and applicable standards, there is adequate sight distance at the proposed site access location to clearly identify approaching vehicles. Consideration should be made to limit any sight distance impacts from future onsite structures, landscaping and signing. The proposed site plan is generally well configured and the proposed site access on Orchard Trail does not appear to represent a significant traffic safety or operations concern. Summary of Findings, Conclusions and Recommendations Based on this proposed Lakeville Medical Center Development traffic impact study and analysis, the following summary of findings, conclusions and recommendations is offered for your consideration: 1. Results of the existing traffic operations analysis indicate that all study intersections currently operate at an acceptable overall LOS C or better during the a.m. and p.m. peak hours under existing traffic control and intersection geometrics. However, the southbound approach at the 185th Street (CSAH 60)/Orchard Trail intersection operates at LOS F, during the p.m. peak hour. 2. Results of a traffic signal warrant analysis following Dakota County staff guidance, indicate that traffic signal warrants are not currently met under existing conditions. 3. The year 2025 Background Traffic/No-Build Conditions assumed future adjacent/near-by developments are expected to generate significant levels of traffic with a total of 676 a.m. peak hour trips, 1,053 p.m. peak hour trips, and 10,706 daily trip ends (50 percent in/50 percent out). 4. The year 2025 Background Traffic/No-Build Conditions traffic operations analyses indicate that the 185th Street (CSAH 60)/Orchard Trail intersection would operate overall at an unacceptable LOS F (over capacity) with over five-minute average delays per vehicle, while the remaining study intersections are expected to continue to operate at an acceptable overall LOS C or better during a.m. and p.m. peak hours under existing traffic control and intersection geometrics. 5. The year 2025 Background Traffic/No-Build Conditions expected 95th percentile queue (44 vehicles) on the southbound approach at the 185th Street (CSAH 60)/Orchard Trail intersection, would spill back over 1,000 feet and beyond the proposed Lakeville Medical Center site access, during the p.m. peak hour. 6. The site of the proposed Lakeville Medical Center (LMC) development is generally located northwest of the 185th Street (CSAH 60)/Orchard Trail intersection with construction assumed to be completed and fully occupied by year 2025. The proposed development consists of 101,500 square feet of medical-dental office building and 457 surface and structured parking spaces. Mark A. The proposed Lakeville Medical Center development is expected to generate a total of 315 a.m. peak hour trips, 399 p.m. peak hour trips, and 3,654 daily trip ends (50 percent in/50 percent out). 8. Based on a comparative land use analysis, the proposed Lakeville Medical Center development would generate very similar total daily trips as the approved 2005 master site plan land use for the subject site (35,000 square feet of retail on the subject site). Additionally, the proposed Lakeville Medical Center development would generate significantly fewer total daily trips than a scenario assuming two 5,000 square foot fast-food restaurants with drive-through on the subject site. 9. Only limited LMC development-generated traffic was assigned to the Buffalo Wild Wings site route since most LMC drivers visit the site infrequently and are not familiar with the site, LMC gateway signing would also guide drivers to the LMC main access and the configuration of the site parking promotes loading on the north portion of the site and use of the LMC main access. 10. The year 2025 Development Build Conditions traffic operations analyses indicate that the 185th Street (CSAH 60)/Orchard Trail intersection would continue to operate at an unacceptable overall LOS F (over capacity) during the peak hours, under the existing side-street stop control and intersection geometrics. The remaining study intersections are expected to continue to operate at an acceptable overall LOS C or better during the peak hours. 11. The 2025 Development Build Conditions expected 95th percentile queue (60 vehicles) on the southbound approach at the 185th Street (CSAH 60)/Orchard Trail intersection, would spill back 1,000 feet, beyond the Lakeville Medical Center site access, during the p.m. peak hour. 12. The future installation of traffic signal control (traffic signal warrants are projected to be met for the year 2025 No-Build and Build conditions) or other intersection improvements such as restricted access (3/4 access) at the 185th Street (CSAH 60)/Orchard Trail intersection would significantly improve traffic operations under both the No-Build and Build scenarios. However, further review of the installation of a traffic signal or other intersection improvements at the 185th Street (CSAH 60)/Orchard Trail intersection is recommended since these improvements have corridor wide implications that are beyond the scope of this site specific traffic impact study. 13. A review of the proposed Lakeville Medical Center development site plan was completed to identify issues specific to the proposed site configuration and circulation. Based on this review the proposed site plan is generally well configured and the proposed site access on Orchard Trail does not appear to represent a significant traffic safety or operations concern. 14. It is recommended that consideration should be given to limit any sight distance impacts from future onsite structures, landscaping and signing at the proposed site access on Orchard Trail. 15. Based on this proposed Lakeville Medical Center Development traffic impact study and analysis, and assuming a future intersection improvement at the 185th Street (CSAH 60)/Orchard Trail intersection, it is concluded that the City of Lakeville may consider the proposed Lakeville Medical Center Development, without concern that it would represent a negative traffic impact to the supporting area roadway system or existing site circulation and traffic operations. The Planning Commission conducted a public hearing on the proposed conditional use permit preceded by published and mailed notice. The applicant was present and the Planning Commission heard testimony from all interested persons wishing to speak. FINDINGS OF FACT 1. The property is located in Planning District No. 1 of the 2040 Comprehensive Land Use Plan, which guides the property for commercial land uses. 2. The property is currently zoned PUD, Planned Unit Development District. 3. The legal description of the property is: Lots 3 and 4, Block 1, Timbercrest at Lakeville 3rd Addition 4. Section 11-4-3E of the City of Lakeville Zoning Ordinance provides that a conditional use permit may not be issued unless certain criteria are satisfied. The criteria and our findings regarding them are: a. The proposed action has been considered in relation to the specific policies and provisions of and has been found to be consistent with the official City Comprehensive Plan. Finding: The proposed medical office building is consistent with the recommendations of the 2040 Comprehensive Land Use Plan. The property abuts 185th Street (CSAH 60). The proposed additional building height above 35 feet is compatible to other land uses in the in area. 2 b. The proposed use is or will be compatible with present and future land uses of the area. Finding: Provided compliance with the conditional use permit, the 4 story commercial building will be compatible with existing and future land uses in the area. c. The proposed use conforms with all performance standards contained in the Zoning Ordinance. Finding: The proposed medical office building complies with the requirements of the Zoning Ordinance including performance standards for increased building property line setbacks. d. The proposed use can be accommodated with existing public services and will not overburden the City’s service capacity. Finding: The subject property lies within the current MUSA. Dakota County controls the right-of-way requirements and access locations along 185th Street. 185th Street is currently constructed as a four-lane divided urban roadway adjacent to the plat. A ten-foot-wide bituminous trail is located along both sides of 185th Street. No access is proposed from the site directly onto 185th Street. Orchard Trail The proposed development is located west of and adjacent to Orchard Trail, a minor collector roadway as identified in the City’s Comprehensive Transportation Plan. A traffic study was conducted on the 185th Street and Orchard Trail intersection and surrounding Timbercrest development area. Dakota County Transportation and Lakeville engineering staff reviewed that traffic study and determined that the intersection of Orchard Trail and 185th Street does not currently meet traffic signal warrants. Additionally, the intersection does not meet the County’s minimum spacing requirements for signalized intersections. Although the intersection does not meet warrants, queuing is expected along Orchard Trail in the side street stop condition. The City and County will continue to monitor the intersection of 185th Street and Orchard Trail for future traffic operation issues. Access to the site will be from one proposed driveway entrance connecting to Orchard Trail. The driveway design must include stop signs and stop bars. In addition, the concept plan proposes to connect the medical office building parking lot and access to the adjacent commercial development parking lot to the east, which has an existing access to Orchard Trail from which the site could also be accessed. The proposed development requires expansion of an existing stormwater basin on Outlot C, Timbercrest at Lakeville. The basin expansion is consistent with City standards and provides adequate rate control and water quality volume for the proposed improvements. The Applicant shall grant an easement over the expanded stormwater basin area. The proposed development contains more than one acre of site disturbance. A National Pollution Discharge Elimination System General Stormwater Permit for construction activity is required from the Minnesota Pollution Control Agency for areas exceeding one acre being disturbed by grading. A copy of the Notice of Stormwater Permit Coverage must be submitted to the City upon receipt from the MPCA. SSTTOORRMM SSEEWWEERR The proposed development includes the construction of a private storm sewer system within the site to collect and convey the runoff generated from the proposed improvements to the adjacent public stormwater management systems. In order to meet the City’s stormwater management requirements, the Applicant shall replace the public storm sewer outlet from the basin that will be expanded and under the proposed private driveway. The Trunk Storm Sewer Area Charge has been satisfied and will not be required with the final plat.
