HomeMy WebLinkAbout05-19CITY OF LAKEVILLE PLANNING COMMISSION MEETING MINUTES May 19, 2022 Chair Witte called the meeting to order at 6:00 p.m. in the Council Chambers at City Hall. The Pledge of Allegiance to the flag was given. Members Present: Chair Jeff Witte, Vice Chair Jenna Majorowicz, Karl Drotning, Brooks Lillehei, Ex-Officio Melissa Field Members Absent: Patrick Kaluza, Christine Zimmer, Patty Zuzek Staff Present: Daryl Morey, Planning Director; Frank Dempsey, Associate Planner; Kris Jenson, Associate Planner; Tina Morrow, Recording Secretary 3. Approval of the Meeting Minutes The May 5, 2022 Planning Commission meeting minutes were approved. 4. Announcements Planning Director Daryl Morey stated that the following was distributed to the Planning Commission at tonight’s meeting: May 18, 2022 Parks, Recreation and Natural Resources Committee meeting minutes regarding Voyageur Farms preliminary plat. Mr. Morey stated that Agenda Item 5, Ninth Elementary First Addition preliminary plat and conditional use permit, will be tabled at tonight’s meeting at the applicant’s request The Planning Commission meetings in June will be determined after staff hears back from all Planning Commission members about their availability in June Mr. Morey reminded the Planning Commission about the work session in the Council Chambers immediately following tonight’s regular meeting. 5. Ninth Elementary First Addition Chair Witte asked for a motion to table. Motion was made by Drotning, seconded by Lillehei to table Ninth Elementary First Addition at the request of the applicant. Kenwood Trail Business Park 2nd Addition Chair Witte opened the public hearing to consider the application of the City of Lakeville preliminary plat) and 4 West Capital Development, LLC (conditional use permit) for the following, located north of Kenwood Trail (CSAH 50) and east of Ipava Avenue: A. Preliminary plat of two commercial lots to be known as Kenwood Trail Business Park 2nd Addition, and B. Conditional use permit for a child daycare facility in the O-R District. Eric Mikkonen, representing 4 West Capital Development, LLC presented a brief overview of the project. He stated the proposed development will be used for childcare and business office purposes and feels it will be a great addition to the area. Associate Planner Frank Dempsey presented the planning report. Mr. Dempsey stated the City of Lakeville has prepared a preliminary and final plat named Kenwood Trail Business Park 2nd Addition in preparation for the property to be sold to 4 West Capital Holdings, LLC. The preliminary and final plat includes property that was obtained by the City as part of the Kenwood Trail (CSAH 50) improvement project in 2017-18. The Kenwood Trail Business Park preliminary and final plat was approved by the City Council on February 21, 2017 and included one lot, seven outlots, and Icenic Way street right-of-way. The City has since entered into a purchase agreement with 4 West Capital Holdings, LLC to purchase Lots 1 and 2, Block 1, Kenwood Trail Business Park 2nd Addition. The preliminary and final plat includes two lots and one outlot. The lot size for the two lots in the preliminary and final plat exceed the 24,000 square foot minimum lot area and 120 foot minimum lot width requirements for the O-R District. Mr. Dempsey explained the site plan, indicating the two lots will share a driveway access at Icenic Way and will include internal shared driveways, shared parking, and a shared trash enclosure/storage by private agreement. The proposed childcare building on Lot 1 will be 13,877 square feet and will include an 11,087 square foot outdoor play area and a 38 space parking lot. The future office building on Lot 2 is proposed to be 6,000 square feet in area with a 30 space parking lot. Mr. Dempsey stated there will be a Site Improvement Performance Agreement required prior to the development of the properties. The criteria pertaining to the conditional use permit is outlined in the May 13, 2022 planning report. Planning Commission Meeting Minutes, May 19, 2022 Page3 Planning Department staff recommends approval of the preliminary plat and conditional use permit, subject to the seven stipulations listed in the May 13, 2022 planning report, and approval of the Findings of Fact dated May 19, 2022. Chair Witte opened the hearing to the public for comment. There were no comments from the audience. Motion was made by Drotning, seconded by Lillehei to close the public hearing at 6:13 p.m. Voice vote was taken on the motion. Ayes -unanimous Chair Witte asked for comments from the Planning Commission. Discussion points included: •Commissioner Drotning asked about the zoning of the triangular shaped portion of theAmes Arena parcel being split off and added to the Kenwood Trail Business Park 2ndAddition plat. Mr. Morey stated that Planning Department staff will review the zoningprior to consideration by the City Council.•Chair Witte commented on the parking plan for the site. He agrees that the planaccommodates safe drop off for the child care use and is in support of the project aspresented.Motion was made by Lillehei, seconded by Majorowicz to recommend to City Council approval of Kenwood Trail Business Park 2nd Addition preliminary plat and conditional use permit, subject to the following stipulations, and approval of the findings of fact dated May 19, 2022: 1.The developer and City Council shall enter into a Site Improvement Performance Agreement (SIPA) for site development prior issuance of a building permit.2.A signed copy of the private shared access, driveway, parking, and trash enclosure agreement will be required prior to issuance of a building permit.3.Sign permit applications must be submitted and approved by the City prior to sign installation.4.The State of Minnesota shall issue the childcare license for the facility prior to building occupancy.5.The site and building shall be developed in accordance with the plans approved by the City Council.6.Landscaping shall be installed consistent with the approved landscape plan. An escrow amount, based on the revised landscape plan, shall be submitted with the SIP A to guarantee installation of the approved landscaping.7.The barbed wire fence identified on the property survey shall be removed prior to issuance of a building permit. Voyageur Farms Chair Witte opened the public hearing to consider the application of U.S. Home, LLC d/b/a Lennar for the following, located east of Cedar Avenue (CSAH 23), south of 181st Street, and west of Glacier Way: 1. Preliminary plat of 154 detached townhomes lots to be known as Voyageur Farms, and 2. Zoning Map amendment to rezone a portion of the property from RM-2, Medium Density Residential District to RST-2, Single and Two Family Residential District. Josh Metzer from Lennar presented a brief overview of the project. Mr. Metzer described the proposed unit lots shown on the Voyageur Farms preliminary plat. He stated that a homeowner’s association will be required for ownership and maintenance of the common area lots. Associate Planner Kris Jenson presented the planning report. Ms. Jenson stated that U.S. Home, LLC d/b/a Lennar has applied for preliminary plat and rezoning to allow the development of 154 detached townhome lots on 62.32 acres to be known as Voyageur Farms. Ms. Jenson explained the rezoning from RM-2 to RST-2 is to have consistent development standards across the entire plat. An amendment to the Comprehensive Land Use Plan is not required because, while the west half of the parcel is guided MDR, Medium Density Residential and the east half of the parcel is guided L/MDR, Low/Medium Density Residential, both designations have a minimum density of 4.0 units per acre, which the site meets. Ms. Jenson described the proposed grading plan, outlots and trails. The requirements for exterior materials, townhome unit floor area, garage width and area, and the buffer yard landscape plan is outlined in the May 11, 2022 planning report. Ms. Jenson stated a variety of overstory trees are proposed in the front yard area of the units and the remainder of the common open space will be landscaped with a mix of overstory and evergreen trees. Planning Department staff recommends approval of the Voyageur Farms preliminary plat and Zoning Map amendment subject to the 11 stipulations listed in the May 11, 2022 planning report, and approval of the Findings of Fact dated May 19, 2022. Chair Witte opened the hearing to the public for comment. There were no comments from the audience. Ayes – unanimous Chair Witte asked for comments from the Planning Commission. Discussion point included: Commissioner Drotning asked for clarification on the phasing plan. Mr. Metzer explained the planned phasing for the project. Motion was made by Lillehei, seconded by Drotning to recommend to City Council approval of the Voyageur Farms preliminary plat and Zoning Map amendment, subject to the following stipulations, and approval of the Findings of Fact dated May 19, 2022: 1. Implementation of the recommendations listed in the May 11, 2022 engineering report. 2. Park dedication shall be satisfied with a combination of land dedication and cash contribution paid with the final plat for each development phase. 3. The developer shall construct five-foot-wide concrete sidewalks on one side of each street as shown on the preliminary plat plans. The developer shall construct a bituminous trail along the east side of Cedar Avenue, the north side of 185th Street, and through Outlot A as shown on the plans. 4. Outlots A, B, and D shall be deeded to the City with the final plat. 5. Buffer yard landscaping shall be installed according to the approved landscape plan. A security for the buffer yard landscaping shall be submitted with the final plat. 6. The existing house, accessory structures, fence, well, and septic system must be removed with the development of this property. 7. A homeowner’s association must be established for ownership and maintenance of the following lots: Lot 16, Block 1 Lot 24, Block 2 Lot 48, Block 3 Lot 22, Block 4 Lot 21, Block 5 Lot 17, Block 6 8. Detached townhomes must meet the exterior materials requirements of Section 11-57- 19.B.3 of the Zoning Ordinance. 9. The developer must submit dimensioned floor plans for the detached townhome units to verify compliance with the minimum requirements for above grade floor area established by Section 11-17-13D of the Zoning Ordinance. 10. Each detached townhome unit shall include an attached garage meeting the minimum width and area requirements of Section 11-57-19.C of the Zoning Ordinance.
