CITY OF LAKEVILLE
PLANNING COMMISSION MEETING MINUTES
June 16, 2022 Chair Witte called the meeting to order at 6:00 p.m. in the Council Chambers at City Hall. The Pledge of Allegiance to the flag was given.
Members Present: Chair Jeff Witte, Vice Chair Jenna Majorowicz, Karl Drotning, Brooks Lillehei, Patrick Kaluza, Patty Zuzek, Christine Zimmer, Ex-Officio Melissa Field
Members Absent: None
Staff Present: Tina Goodroad, Community Development Director; Kris Jenson, Associate Planner; Lucas Ritchie, Project Engineer; Tina Morrow, Recording Secretary
3. Approval of the Meeting Minutes
The May 19, 2022 Planning Commission meeting minutes and the May 19, 2022 Planning Commission work session minutes were approved as presented.
4. Announcements
Associate Planner Kris Jenson stated that the following was distributed to the Planning Commission at tonight’s meeting:
• June 15, 2022 Parks, Recreation and Natural Resources Committee meeting motion regarding the Ninth Elementary First Addition preliminary plat.
• Ms. Jenson introduced Tina Goodroad, the new Community Development Director.
5. Ninth Elementary First Addition Chair Witte opened the continued public hearing to consider the application of Wold Architects, on behalf of Independent School District #194 for the following, located west of Highview Avenue and south of the future extension of 185th Street (CSAH 60): 1. Preliminary plat of one lot to be known as Ninth Elementary First Addition; and 2. Conditional use permit to allow: A) a public educational institution (elementary school) in the RS-3, Single Family Residential District B) building height in excess of 35 feet. Beth Louden from Independent School District #194, along with Vaughn Dirks from Wold Architects were in attendance at tonight’s meeting. Ms. Louden and Mr. Dirks presented a brief overview of the request. Associate Planner Kris Jenson presented the planning report. Ms. Jenson stated that Wold Architects, on behalf of Independent School District 194, have submitted preliminary plat and conditional use permit applications for Ninth Elementary First Addition which

consist of one institutional lot totaling 33.45 acres within the RS-3, Single Family Residential District. Ms. Jenson stated the site will include a 100,00 square foot public elementary school. The proposed height of the school exceeds the 35 feet allowed in the RS-3 District unless a conditional use permit is approved to exceed that height. The property is currently located in Planning District No. 5 of the 2040 Comprehensive Land Use Plan and is in Metropolitan Urban Service Area (MUSA) Expansion Area A, which allows development prior to 2028 provided that the proposed development is consistent with the 2040 Land Use Plan. Ms. Jenson outlined a summary of streets that will provide access for the Ninth Elementary First Addition preliminary plat. A right in/right out access from Highview Avenue will be restricted to busses, delivery, and trash vehicles and aright out only access will be constructed to 185th Street. The primary access to the school will be from Huntley Trail, which will connect to the residential neighborhood to the south and will provide a full access to 185th Street. The site proposes 147 parking spaces, which meets both the proposed school and a potential addition. Ms. Jenson noted the tree preservation plan and the location of significant trees to be removed. Evergreens are proposed along the southeast side of the building to add screening to the mechanical equipment and loading dock area as well as within a gap of existing trees to buffer the view to existing single family homes to the south of the site. All landscaped areas surrounding the school, including landscaped islands within the parking lot, shall be irrigated in compliance with the Zoning Ordinance. The exterior materials on the school will consists of brick, architectural precast panels with a custom form-lined pattern, and glass. The proposed materials meet the requirements of the Zoning Ordinance. Planning Department staff recommends approval of the Ninth Elementary First Addition preliminary plat and conditional use permit subject to the 7 stipulations listed in the June 8, 2022 planning report, and adoption of the Findings of Fact dated June 16, 2022. Chair Witte opened the hearing to the public for comment.
There were no comments from the audience.
Motion was made by Lillehei, seconded by Majorowicz to close the public hearing at 6:14 p.m.
Voice vote was taken on the motion. Ayes – unanimous
Chair Witte asked for comments from the Planning Commission. Discussion points included:
• Plans regarding the parking lot and loading dock.

• Commissioner Majorowicz asked for clarification for the proposed underpass on 185th Street. Ms. Jenson explained there will be two underpasses in the area constructed to provide pedestrian access.
• Sidewalks and trails along the future 185th Street construction.
• The safeguards that will be implemented and the safety protocols/lockdown points for the site.
• Commissioner Kaluza appreciates the improvements to the site plan regarding the parent drop off and walking paths for the safety of the children.
Motion was made by Lillehei, seconded by Majorowicz to recommend to City Council approval of the Ninth Elementary First Addition preliminary plat and conditional use permit, subject to the following stipulations, and adoption of the Findings of Fact dated June 16, 2022: 1. Implementation of the recommendations listed in the May 11, 2022 engineering report. 2. The site and building for Lot 1, Block 1 shall be developed in compliance with the plans approved by the City Council and Zoning Ordinance requirements. 3. The landscape plan shall be amended to include additional plantings to the southeast of the loading zone to provide additional screening of the area and west of the general parking lot. All landscaped areas surrounding the school, including landscaped islands within the parking lot, shall be irrigated in compliance with the Zoning Ordinance. 4. A security to guarantee installation of the approved landscaping must be submitted at the time of final plat approval. The security amount will be determined prior to City Council consideration of the final plat. 5. All signs shall comply with Zoning Ordinance requirements and sign permits shall be issued by the Planning Department prior to the installation of any signs. 6. The maximum height above ground for the bases, poles, and light fixtures is 35 feet. 7. The site plan must be modified to show that the trash and recycling containers shall be stored inside the building or within a six-foot tall enclosure constructed of similar materials as the building, including a durable, maintenance free gate, located adjacent to the loading dock area.
