HomeMy WebLinkAboutItem 06 Taco BellCity of Lakeville Planning Department Memorandum To : Planning Commission From: Frank Dempsey, AICP, Associate Planner Date: September 2, 2022 Subject: Packet Material for the September 8, 2022 Planning Commission Meeting Agenda Item: Taco Bell Conditional Use Permit Action Deadline: October 1, 2022 INTRODUCTION Westwood Professional Services, on behalf of Border Foods Real Estate Holdings has submitted a conditional use permit application for the development of a 2,867 square foot Taco Bell convenience food restaurant with a drive through to be located on a 1.75 acre parcel at the northwest corner of Keokuk Avenue and 207th Street. The subject property was administratively subdivided from the Emagine Theater property in 2016. The subject property is zoned C-3, General Commercial District which requires the site develop to specific performance standards for convenience food restaurants. Section 11-73-7.H of the Zoning Ordinance allows convenience restaurants by conditional use permit. The plans have been reviewed by Planning Department and Engineering Division staff. EXHIBITS A. Section 11-73-7.H allows convenience food uses subject to approval of a conditional use permit and in accordance with specific performance standards applicant to the subject property. Hours. Section 11-73-7.H.1 of the Zoning Ordinance limits hours of operation 5:00 A.M. to 11:00 P.M. unless extended by the City Council as part of the conditional use permit request. The applicant requests an extension to the allowed hours as has been granted to the two other Taco Bell restaurants in Lakeville. The requested hours are 6:00 AM to Midnight (12:00 AM) daily. Two other Taco Bell restaurants in Lakeville were permitted hours between 5:00 AM and 2:00 AM (Argonne Village) to 24 hours (Spirit of Brandtjen Farm). The hours proposed by the applicant are considered acceptable at this location as part of the larger commercial, entertainment, and hospitality character of the commercial area and the separation from nearby residential zoning. Building Design and Height. The applicant has provided colored, scaled plans of each building elevation illustrating a variety of materials and color pallet as required by Section 11-73-7.H.2 of the Zoning Ordinance. The proposed building has a coordinated finish treatment for each elevation emphasizing the north, east and south elevations of the building. The exterior finishes are principally masonry veneer brick (Grade A – 72%) and cement composite siding (Grade B – 28%) as required to comply with Section 11-17-9.D.1 of the Zoning Ordinance. The building elevation plans specify the grade of each material as defined by the Zoning Ordinance and percentage of these materials as used on each elevation. The contrasting colors do not exceed 10%. The exterior finish for the proposed building complies with the requirements of the Zoning Ordinance. The proposed restaurant is a single-story structure, with the tallest point being 23 feet. The maximum allowed building height is 35 feet in the C-3 District. The proposed canopy over the menu board area will have a clearance height of eight feet, nine inches at the curb to nine feet, eight inches at the tallest point. Landscaping. Section 11-73-7.H.3 of the Zoning Ordinance requires that 25 percent of the lot remain as greenspace. The landscape plan provides 12 new deciduous and ornamental trees on the property including the area adjacent to 207th Street and Keokuk Avenue as well as evergreen and deciduous shrubs for parking lot and drive-through lane screening. Sizes of proposed 3 plantings comply with Section 11-21-9.C of the Zoning Ordinance. The first phase development landscape plan indicates a 29.8% landscape area for the Taco Bell property. The sketch plan for future development of the north portion of the Taco Bell parcel indicates a proposed property line. At the time of future subdivision and development of the north portion of the 1.75 acre property, the Taco Bell site must maintain a minimum of 25% landscaped area in compliance with 11-73-7.H.3.a of the Zoning Ordinance. Exterior Lighting. The plans include a photometric lighting plan for proposed exterior lighting. The Zoning Ordinance limits exterior lighting to not more than 15 foot-candles at any location within the site and not more than one foot-candle at property lines using fixtures with horizontal shielding. The proposed lighting plan complies with Sections 11-16-17.B and 11-73-7.H.5. of the Zoning Ordinance. Access. Additional driveway accesses will not be installed onto Keokuk Avenue (major collector) or 207th Street (minor collector). In cooperation with the owner of the Emagine Theatre property, the developer of the Taco Bell site will modify the theater parking lot west of the Taco Bell site to allow an unrestricted two-way driveway for access to the Taco Bell site. A new driveway will also extend north to connect to the main theater driveway entrance/exit at Keokuk Avenue. The shared driveway arrangements will require that the parties prepare and record a shared access easement. Pedestrian Access. A sidewalk is located along both sides of Keokuk Avenue and the south side of 207th Street. There is no sidewalk on the north side of 207th Street abutting the proposed Taco Bell parcel. A sidewalk connection is proposed between the Taco Bell building and the Keokuk Avenue sidewalk. Drive-Through. There is a drive through window on the south elevation of the building with a drive lane approaching from the west. The access lane is separated from off-street parking areas and sidewalks and provides 180 feet of stacking space from the service window. The site plan for the drive through window complies with the requirements of Section 11-73-7.H.7 of the Zoning Ordinance. Parking. Convenience food uses have a parking requirement of one stall per 70 square feet of floor area. Based on the building size of 2,867 square feet (minus 10% floor area as allowed by the Zoning Ordinance), 37 parking spaces are required. The site plan provides 47 parking spaces in an arrangement to allow shared parking with the future site development on the north side of the property, which includes a concept for 1,400 square feet of restaurant space and 1,500 square feet of retail space (Exhibit C). Estimated parking for the future site development would require approximately 23 parking spaces. Thirty-four (34) parking spaces are shown conceptually on the north potion of the site. The off-street parking spaces and drive aisles meet Zoning Ordinance requirements for size and dimensions. 4 The proposed site design will result in a modification and reduction in the number of theater parking spaces, which was anticipated at the time the theater parcel was subdivided. A parking analysis indicates 1,149 existing parking spaces on the theater parcel and the two undeveloped properties (including the Taco Bell property) within the former theater parent parcel. The Taco Bell development will result in the removal of 273 parking spaces, of which 63 spaces are on the Taco Bell site. The resulting theater parking, post development of the Taco Bell site, is 876 spaces. Theater parking requires 294 parking spaces at the Zoning Ordinance ratio of 1 parking spaces for each 3.4 seats in the 1000 seat theater. Signs. All proposed signs are subject to the allowances established for the C-3 District by Section 11-23-19.D of the Zoning Ordinance. The site plan proposes a 100 square foot freestanding monument sign with a 41 square foot brick base at the southeast corner of the property. The overall height of the proposed sign is 15 feet and the brick base is 41 percent of the area of the sign. The proposed freestanding sign complies with the additional sign specifications for convenience food uses outlined in Section 11-73-7.H.11.b of the Zoning Ordinance. Wall signs are shown on the east and north elevations. The Zoning Ordinance allows a corner lot to have wall signs not to exceed 100 square feet on two wall elevations facing public streets or private through drives. The wall signs on the north and east elevations are approximately 24 square feet in area, which complies with Section 11-23-19.E.1.b of the Zoning Ordinance. The drive through lane includes two menu signs per queuing lane. The Zoning Ordinance allowance menu signs with a maximum area of 50 square feet and a maximum height of eight feet. The proposed menu sign shall receive sign permit approval prior to installation and shall comply with the requirements outlined in Section 11-73-7.H.11.c of the Zoning Ordinance. Setbacks. The C-3 District requires a 30 foot setback for buildings and 15 foot setback for parking from public rights-of-way and a 10 foot building setback and a 5 foot parking setback from interior lot lines. The location of the proposed building and parking area complies with the required setbacks from Keokuk Avenue and 207th Street. The building is setback 30 feet from the south property line (207th Street), 80 feet from the east property line (Keokuk Avenue), and 66 feet from the west interior property line. The north interior property line is located more than 200 feet to the north. The drive aisle for the drive through lane is setback 18 feet from the south (207th Street) property line. The setback of the drive through allows for installation of a landscape hedge to screen the vehicles stacked in the drive aisle as shown on the landscape plan. Mechanical Equipment. All rooftop mechanical equipment will be screened from view by screening walls that match the parapet height of the building. There is one ground level transformer, on the north side of the building. Dakota Electric has stated that the transformer will be over five feet in height and that nothing can be planted or located within three feet of each 5 side of the transformer or 10 feet at the front of the transformer. The landscape plan should be modified to add taller shrubs on three sides of the transformer to buffer the view while still meeting Dakota Electric’s requirements. Concept Plan. There is currently no development plan for the north portion of the 1.75 acre Taco Bell property. A concept plan for the area (Exhibit C) has been submitted with the site plan, showing a building location and parking layout. An administrative subdivision will be required to create an additional parcel. Shared driveway access easements shall be recorded to allow cross access to all affected properties. Noise. The stacking lane, order board intercom, and service window are all located so as to have minimal disruption to adjacent properties. Trash Storage. Trash storage will be internal and located at the northwest corner of the building. RECOMMENDATION Planning Department staff recommends approval of the Taco Bell conditional use permit, subject to the following stipulations: 1. The hours of operation shall not exceed 6:00 AM to 12:00 AM, seven days a week, unless extended hours are approved by the City Council. 2. A shared access easement shall be drafted and recorded with Dakota County allowing the Taco Bell property access consistent with the site plan approved with the conditional use permit. 3. Landscaping shall be installed consistent with the approved landscape plan. An escrow shall be submitted with the building permit application to guarantee installation of the approved landscaping. 4. Signs shall comply with Zoning Ordinance requirements and receive sign permit approval prior to installation. 5. Future subdivision and development of the north portion of the 1.75 acre property shall require that the Taco Bell parcel retain a minimum of 25% landscaped area in compliance with 11-73-7.H.3.a. of the Zoning Ordinance. The Planning Commission conducted a public hearing on the conditional use permit application preceded by published and mailed notice. The applicant was present and the Planning Commission heard testimony from all interested persons wishing to speak. FINDINGS OF FACT 1. The subject property is located in Comprehensive Planning District 6, which guides the property for Commercial uses. 2. The subject site is zoned C-3, General Commercial District. 3. Legal description of the property is: The South 305.57 feet of the East 248.78 feet of Lot 1, Block 1, Muller Family Theatre Addition 4. Chapter 4 of the City of Lakeville Zoning Ordinance provides that a conditional use permit may not be issued unless certain criteria are satisfied. The criteria and our findings regarding them are: a. The proposed action has been considered in relation to the specific policies and provisions of and has been found to be consistent with the official City Comprehensive Plan. Finding: The proposed convenience restaurant use is consistent with the guided commercial use of the property. 2 b. The proposed use is or will be compatible with present and future land uses of the area. Finding: The proposed convenience restaurant use will be compatible with the existing and future land uses in the area. c. The proposed use conforms to all performance standards contained in the Zoning Ordinance and the City Code. Finding: Provided compliance with the stipulations of the conditional use permit, the proposed convenience restaurant use will conform to all performance standards contained in the Zoning Ordinance and the City Code. d. The proposed use can be accommodated with existing public services and will not overburden the City’s service capacity. Finding: The proposed convenience restaurant use can be accommodated with existing public services and will not over burden the City’s service capacity. e. Traffic generated by the proposed use is within capabilities of streets serving the property. Finding: The streets serving the subject property are adequate to accommodate traffic from the proposed convenience restaurant use. 5.
