Public Hearing to consider an Amendment to Section 11-97-7 and 11-97-13 of the Lakeville Zoning Ordinance concerning the P-OS, Public and Open Space District. BACKGROUND The City Council has been reviewing and making recommendations on plans for redevelopment of Antlers Park including a new plaza area, pavilion building and other amenities to update the park as one of several park improvements being completed because of the park referendum. In February, the council discussed concepts to add a restaurant facility within Antlers Park that would be located adjacent to the plaza and pavilion. A request for proposal was sent to over 60 various food service establishments in the Lakeville area and two proposals were submitted. Upon evaluation of responses the council has determined it will work with Lakeville Brewing Co. on a food and beverage sales concept. In July, three options were presented to the City Council on what type of structure could be placed in the park for this use including a fixed structure, two customized 40-foot shipping containers or three food trucks. Staff presented potential ordinance amendments that would be necessary for each option for the P-OS, Public and Open Space section of the Zoning Ordinance and also to Title 3 of the City Code. The City Council chose the shipping containers option for this use in Antlers Park and directed staff to proceed with necessary code amendments and preparation of a lease agreement. The following exhibits are attached for your information: • Draft Zoning Ordinance amendment • Proposed Pavilion Rendering • Antlers Park Site Plans (2) 2 ANALYSIS Title 11, Chapter 97, the PO-S, Public and Open Space District does not include a permitted or conditional use allowing retail sales of food or beverages. Staff is proposing this use be added as a conditional use to ensure that appropriate conditions for operation can be placed on this use. DRAFT ORDINANCE Staff drafted a proposed amendment to Section 11-97-7 (conditional uses) to add retail sale of food and beverages (including liquor) in Antlers Park as a conditional use with the following standards: • All food and beverages shall be sold from a permanent or semi-permanent structure which may include the customized metal shipping container option that was favored by the City Council. • All required food and beverage licenses shall be obtained by the operator. • Hours of sale of food and beverage is limited to 11:00 a.m. and 9:00 p.m. and the operational season is May 15th-October 15th. Proposed hours and season correspond with the Concession Agreement with Lakeville Brewing Co. • Signage on the container shall be limited to fifty (50) square feet. • Patio area will have to comply with City Code requirements. Staff is working through some minor amendments to Title 3 of the city code regarding serving alcoholic beverages on patios. • The design of the structure shall be complementary to park structures or historic theme of Antlers Park. The draft requires 65% of the exterior to use materials from Class A, B, or C such as: brick, natural/artificial stone, glass, precast panel, fiber cement siding (Hardi/LP), ornamental metal, etc. The pavilion building will utilize board and batten style siding (Hardi or LP) with a peaked roof to honor the historical park buildings. • The draft ordinance permits the remaining 35% of the elevation to include grade D, E or F materials. This would allow some of the metal container to be exposed and incorporated into the overall design. CONCLUSION AND RECOMMENDATION The proposed draft meets the intent of the City Council to allow the food and beverage sales within a structure with conditions that will allow the use to operate cohesively within the public park setting in a design that will be complimentary to the redevelopment of the park. Staff recommends approval of the proposed Zoning Ordinance amendment. 1 ORDINANCE NO.________ CITY OF LAKEVILLE DAKOTA COUNTY, MINNESOTA AN ORDINANCE AMENDING THE LAKEVILLE CITY CODE THE CITY COUNCIL OF THE CITY OF LAKEVILLE ORDAINS: Section 1. Section 11-97-7 (P-OS District Conditional Uses) of the Lakeville City Code is hereby amended to read as follows: H. Retail sale of food and beverages (including liquor) within Antlers Park, provided that: 1. Food and beverage operators shall obtain all required food and liquor licenses prior to any sale. 2. Operating season shall be limited to May 15th through September 15th unless an extended season is approved of the City Council. 3. All food and beverage sales (including liquor) shall be limited to the hours of operation of 11:00 a.m. and 9:00 p.m. unless extended hours are approved by the City Council. 4. All food and beverages (including liquor) shall be sold from a permanent or semi-permanent structure including, but not limited to, customized metal shipping containers, meeting the following design standards: a. The sides of the structure shall include exterior finish materials that are complementary to existing park structures and/or historic theme of Antlers Park. b. The exterior finish shall consist of at least sixty five percent (65%) grade A, B, or C materials and up to thirty five percent (35%) grade D, E or F materials as listed in section 11-17-9.B of this title. 5. Signage shall be limited to one wall sign per structure not to exceed fifty (50) square feet. Painted signage may be considered as complementary to the historic theme of Antlers Park. 2 6. Any installed patio shall be in compliance with section 3-1-8-14.C of this code. Section 2. Section 11-97-13 (P-OS District Design Standards) of the Lakeville City Code is hereby amended to add the following provision: The architectural appearance and functional design of the building and site shall maintain a high standard of architectural and aesthetic compatibility with surrounding uses so as to positively reflect the desired community character. All sides of the principle and accessory structures are to have essentially the same or coordinated, harmonious exterior finish materials and treatment and shall comply with section 11-17-9 of this title, except as allowed by section 11-97-7.H.6 of this title. Section 3. This Ordinance shall be effective immediately upon its passage and publication according to law. PASSED and ADOPTED by the Lakeville City Council this ______ day of ______________, 2022.
