City of Lakeville Planning Department Memorandum To : Planning Commission From: Kris Jenson, Associate Planner Date: September 14, 2022, revised September 29, 2022 Subject: Packet Material for the October 6, 2022 Planning Commission Meeting Agenda Item: Panda Express Conditional Use Permit Action Deadline: November 5, 2022, extended from October 6, 2022 INTRODUCTION Panda Express, Inc., is requesting a conditional use permit to allow the construction of a convenience restaurant on Lot 2, Block 1, Timbercrest at Lakeville 8th Addition. The subject property is zoned PUD, Planned Unit Development subject to the C-3, General Commercial District uses and performance standards. Section 11-73-7.H of the Zoning Ordinance allows convenience restaurants by conditional use permit. The plans have been reviewed by Planning Department and Engineering Division staff. September 22 Planning Commission Public Hearing. The Planning Commission held the public hearing for the conditional use permit at the September 22 meeting. The item was tabled due to concerns about the potential traffic impact of adding an additional convenience restaurant with a drive-through on the vacant lot located south of Target and east of Raising Cane’s. A conditional use permit for a convenience restaurant for Raising Cane’s was approved by the City Council on June 21, 2021. A copy of the CUP form is included with this memo (Exhibit P). One of the stipulations is that Raising Cane’s is required to make use of both of their menu and pick-up drive through lanes anytime the drive through stacking lane reaches the private access road from Kenrick Avenue. Staff will be meeting with the management of Raising Cane’s on Monday afternoon to remind them of this CUP stipulation and to discuss addition 2 options for accommodating vehicle queuing for the drive-through on the site without extending into the private access drive. The Developer has submitted a written response to the drive-through stacking and fence issues raised during the Planning Commission meeting. A drive-through traffic management plan was also submitted, showing a potential revised drive-through route that could be used by Raising Cane’s and an alternate drive-through queue line that Panda Express could use in times of high demand. A stipulation has been added to this memo for Panda Express which is consistent with stipulation 3.c of Raising Cane’s CUP. This stipulation requires that Panda Express be required to use both menu drive-through lanes anytime the drive-through stacking lane reaches the private access road from Kenrick Avenue. Staff has also contacted the City Attorney to confirm that a CUP application for Panda Express cannot be denied because of concerns about traffic circulation on an adjacent parcel. Ms. Poehler’s opinion is included as Exhibit S. Finally, Staff discussed Panda Express’ concern about a fence along the west side of the drive- through and their suggestion to use bollards instead. Staff maintains the recommendation for a fence but suggests that the fence could include breaks in the fence line. City Attorney’s Opinion 3 The applicant proposes a 2,600 square foot convenience restaurant with a drive-through. The proposed restaurant will have seating for 48 and a dual lane drive through that accommodates at least 18 vehicles. Surrounding Land Uses and Zoning North – Target store and parking lot (PUD) South – 185th Street/CSAH 60 (ROW) East – Kenrick Ave (ROW), Citizens Bank (PUD) West – Raising Cane’s (PUD) SITE ANALYSIS Building Setbacks. Panda Express is proposing a 2,600 square foot restaurant with a drive through. The setback requirements of the C-3 District are: Yard Front (North) Side (interior) Side (Corner) Rear (South) Required: 30 feet 10 feet 30 feet 30 feet Proposed Building: 161 feet 22 feet 80 feet 87 feet Building Height. The proposed restaurant is a single-story structure, the height of which is shown to be 23 feet (Exhibit M). The building will not exceed the maximum building height of 35 feet allowed in the C-3 District. The proposed canopy over the menu board area will have an overall height of 11 feet, with a clearance of 10 feet, 6 inches (Exhibit O) Parking. Convenience food uses have a parking requirement of one stall per 70 square feet of floor area. Based on the building size of 2,600 square feet (minus 10% floor area as allowed by the Zoning Ordinance), 33 parking spaces are required. The site plan provides 43 parking spaces. The off-street parking stalls meet Zoning Ordinance requirements for size. Mechanical Equipment. All ground-level equipment will have landscape screening around the equipment, with the exception of the one side of the electrical transformer that must be kept clear for access. The plans do not indicate any rooftop mechanicals at this time, but should anything be added it will be required to be screened. CONDITIONAL USE P ERMIT Use. Development of a convenience food use is subject to the requirements within the C-3, General Commercial District. Section 11-73-7.H of the Zoning Ordinance establishes performance standards for convenience food uses as follows: 4 Hours. Section 11-73-7.H.1 of the Zoning Ordinance limits hours of operation from 5:00 am to 11:00 pm unless extended by the City Council as a part of the CUP. Panda Express has stated that the planned hours of operation for this restaurant are 10:00 am to 10:00 pm, Sunday through Friday and 10:00 am to 11:00 pm on Saturday. Exterior Building Materials. The primary exterior materials are modular brick, stone, and glass, with accents of metal and composite decking. Section 11-17-9.D of the Zoning Ordinance requires that the exterior building finish be of earth tone colors, use at least three grade A materials and that those grade A materials make up at least 65% of the exterior building finish. Not more than 35% of the exterior building finish may be grade B or grade C materials and not more than 10% of the exterior building materials may be grade D materials. Exhibit M illustrates the exterior building materials. Three distinct earth tone colors of brick and stone along with glass, all of which are grade A materials, make up at least 67% of each building façade. Three colors of brick are proposed for each side of the building, one of which is a red brick. Those areas where red brick is used have a vertical black metal trellis placed in front of the red brick, so as to only allow portions of the red brick to be seen. The remainder of the materials – wood-look composite panels and metal – are classified as grade C materials and do not exceed 33% of the exterior on any side of the building. The proposed materials meet the requirements of the Zoning Ordinance. Landscaping. Per Section 11-73-7.H.3 of the Zoning Ordinance, at least 25% of the lot shall remain as green space or landscaped area. The proposed Panda Express site exceeds 25% green space (Exhibit L). The right-of-way along 185th Street and Kenrick Avenue includes street trees that were planted with the Timbercrest at Lakeville development. The proposed landscaping includes plantings around the parking area in the northeast portion of the site as well as along the north side of the drive-through lanes. The south and southeast side of the site includes a large retaining wall, starting at about nine feet in height along the south and wrapping around the east side of the site. The City Forester recommended that shrubs be added between the parking lot and the top of the retaining wall. He also recommended that the three Prairie Rose Crabapples proposed for the entrance from Kenrick Avenue be shifted back from the curb to minimize site line issues and future obstructions from the canopy of these trees. Given that this area is an entrance point of the development, additional plantings to complement the crabapples should be added to the area. Landscape screening is also proposed around the trash enclosure. The City Forester’s comments must be addressed prior to consideration of the CUP by the City Council. Lighting. Downcast lighting is proposed along the interior of the drive-through lanes as well as well as along the perimeter of the parking lot area. The proposed lighting plan (Exhibit K) complies with the Zoning Ordinance. 5 Access. The site has access via a private access drive that serves the Target store and this site. Vehicles entering the site can either enter the drive-through lane or drive straight ahead and park near the building to enter the restaurant. Drive-Through Window. The drive-through window lane includes the minimum 180 feet of segregated vehicle stacking lane from the service window. A raised curb on both sides of the stacking lane beginning at the menu board protects the building and green area on site. The drive-through area splits to provide two lanes for ordering. In the area of the menu boards, the lanes are divided by a concrete curb and raised median, while further back they are separated with pavement striping. Planning staff inquired about extending the raised median, but Panda Express representatives stated that in their experience, having the striped area allowed vehicles to move to the other lane if necessary and that they preferred not to extend the raised median. After the menu boards, the two lanes merge back into one lane for pick up at the window. Even if only one drive-through lane is used, the stacking lane has enough space for at least 12 vehicles, including the one at the drive-through window. Exhibit H shows the stacking plan of the drive through. In order to better delineate the Panda Express drive-through lane from the primary Raising Cane’s site access, Planning staff requested either a wider median to the west of the drive through lane, a decorative black metal fence on said median, or both. Due to site constrictions, Panda Express representatives chose a two-foot wide median with a decorative fence. Prior to City Council approval of the CUP, fence details must be submitted for review. Circulation and Loading. Pedestrian vehicles can access the Panda Express site via the private access drive along the north property line or via a parking lot connection to the Raising Cane’s site south of the Panda Express building. The applicant has submitted a plan (Exhibit I) of the site showing that a semitrailer truck can access and navigate the site. A truck is able to park alongside the building for deliveries and then navigate out of the site. Deliveries will need to take place prior to the store’s operating hours to ensure there are no conflicts between the truck maneuvering and passenger vehicles at the site. Exhibit J demonstrates that a trash hauler can access the trash enclosure and navigate the site. Pedestrian Traffic. A sidewalk is proposed along the full length of the parking stalls adjacent to the east side of the building, as well as along the south side of the building. An eight-foot- wide concrete sidewalk is located on the west side of Kenrick Avenue and a 10-foot-wide bituminous trail is located on the north side of 185th Street (CSAH 60). No additional trails or sidewalks are proposed with this development. Noise. The stacking lane, order board intercom, and service window are all located so as to have minimal disruption to adjacent properties. Signs. Building elevation plans (Exhibit N) shows two primary wall signs on the east and south sides of the building. The west elevation of the building includes a panel of Chinese characters and their meaning. The proposed character panel is two feet in height by 40 feet in 6 length, is five feet above grade, and includes red Chinese characters on a black background. Planning staff has determined this to meet the definition of a sign. The lot has frontage on two public streets, thus allowing two wall signs. Panda Express representatives will need to determine on which two elevations they would like to include signs at the time sign permit applications are submitted to the Planning Department for review. The site is located within the Freeway Corridor District, which permits a sign area of up to 150 square feet. A free- standing sign is not shown at this time but would be subject to the Timbercrest at Lakeville Architectural Standards that were approved with the original plat. Sign permits are required to be issued prior to the installation of any signs on the site. Signs shown on the plans are illustrative only and no approvals are granted as a part of the CUP request. Menu boards (Exhibit O) are proposed for both drive-through lanes. The proposed menu boards are about five and one-half feet in height with 29 square feet of menu area per sign. The signs meet Zoning Ordinance requirements. Trash Enclosure. The trash enclosure is proposed to be located north of the building, near the entrance to the drive-through. Exhibit M illustrates that the trash enclosure walls use the same brick as the restaurant building. The gates will be a light tan metal panel to match the pale brick exterior of the trash enclosure and made of maintenance free materials. The side walls will be eight feet, four inches in height. RECOMMENDATION Planning Department staff recommends approval of the Panda Express conditional use permit, subject to the following stipulations: 1. The hours of operation shall not exceed 5:00 am to 11:00 pm, seven days a week. 2. Landscaping shall be installed consistent with the approved landscape plan. An escrow shall be submitted with the building permit application to guarantee installation of the approved landscaping. 3. Snow storage may not be located within required parking spaces. 4. Prior to City Council consideration of the CUP, the landscape plan must be modified to add plantings between the parking lot and the retaining wall as well as shifting the plantings at the northeast corner to be centered between the parking lot and the street. Additional plantings should also be added in this area to enhance the entrance to the site. 5. Prior to City Council consideration of the CUP, details of the decorative fence along the west side of the drive-through must be submitted for review. 7 6. Signs must be in compliance with the Timbercrest at Lakeville Architectural Standards and a sign permit must be issued prior to installation. Wall signs are limited to two exterior elevations. 7. Prior to release of a building permit, a security for erosion control and landscaping must be submitted. 8. In order to minimize the potential for vehicle stacking for the drive-through extending onto the private access road from Kenrick Avenue, Panda Express is required to make us of both menu drive-through lanes anytime the drive-through stacking lane reaches the private access road from Kenrick Avenue. Updated Findings of Fact for approval of the conditional use permit request are attached. The conditions would need to focus on any conditions on the Panda Express operation or site design that would reduce any issues related to zoning ordinance performance standards, such as: 11‐4‐7: GENERAL PERFORMANCE STANDARDS: In reviewing applications for conditional use permits, the planning commission and the city council may attach whatever reasonable conditions they deem necessary to mitigate anticipated adverse impacts associated with these uses, to protect the value of other property within the district, and to achieve the goals and objectives of the comprehensive plan. Such conditions may include, but are not limited to, the following: A.The use and the site in question shall be served by a street of sufficient capacity to accommodate the type and volume of traffic which would be generated and adequate right of way shall be provided. B. The site design for access and parking shall minimize internal as well as external traffic conflicts and shall be in compliance with chapter 19 of this title. The Planning Commission expressed concern about the application because it involves a convenience drive-through. Several of the Planning Commissioners have encountered backed- up traffic when trying to visit Target and/or Raising Cane’s, particularly around the dinner hour, of cars trying to use the Raising Cane’s drive through. One of the conditions of their CUP is that “Raising Cane’s is required to make use of both menu and pick-up drive-through lanes anytime the drive-through stacking lane reaches the private access road from Kenrick Avenue.” Tina and I plan to meet with the store manager later this week to discuss concerns about the drive-through stacking and discuss options for compliance with this condition. The Planning Commission tabled action on the Panda Express CUP and will revisit the item at the next meeting. I believe that the City doesn’t have the legal authority to deny the CUP application for Panda Express for a convenience restaurant simply because an adjoining use (Raising Cane’s) has a drive-through that is causing traffic concerns, and I would like written confirmation of that information from you that can be included in the Planning Commission packet for the October 6 meeting. Staff did recommend approval of the Panda Express application as it has met the CUP requirements of the Zoning Ordinance. This email has been scanned for viruses and malware. 1 CITY OF LAKEVILLE DAKOTA COUNTY, MINNESOTA PANDA EXPRESS CONDITIONAL USE PERMIT FINDINGS OF FACT AND RECOMMENDATION On September 22 and October 6, 2022, the Lakeville Planning Commission met at its regularly scheduled meetings to consider the application of Panda Express, Inc. for a conditional use permit to allow the construction of Panda Express, a convenience restaurant on property currently zoned Planned Unit Development. The Planning Commission conducted a public hearing on the conditional use permit application preceded by published and mailed notice. The applicant was present and the Planning Commission heard testimony from all interested persons wishing to speak. FINDINGS OF FACT 1. The subject property is located in Comprehensive Planning District 1, which guides the property for Commercial. 2. The subject site is zoned PUD, Planned Unit Development. 3. Legal description of the property is: Lot 2, Block 1, Timbercrest at Lakeville 8th Addition, Dakota County, MN 4. Chapter 4 of the City of Lakeville Zoning Ordinance provides that a conditional use permit may not be issued unless certain criteria are satisfied. The criteria and our findings regarding them are: a. The proposed action has been considered in relation to the specific policies and provisions of and has been found to be consistent with the official City Comprehensive Plan. Finding: The proposed convenience restaurant use is consistent with the guided commercial use of the property and District 1 recommendations. b. The proposed use is or will be compatible with present and future land uses of the area. Finding: The proposed convenience restaurant use will be compatible with the existing and future land uses in the Timbercrest at Lakeville PUD. c. The proposed use conforms to all performance standards contained in the Zoning Ordinance and the City Code. 2 Provided compliance with the stipulations of the conditional use permit, the proposed use will conform to all other performance standards contained in the Zoning Ordinance and the City Code. d. The proposed use can be accommodated with existing public services and will not overburden the City’s service capacity.
