Public Hearing to consider an Amendment to Section 11-17-9 9 (Building Type and Construction) of the Lakeville Zoning Ordinance. BACKGROUND The O-P, Office Park District allows office buildings, wholesale showroom, research and development facilities and light manufacturing as permitted uses. Conditional uses include warehousing and light manufacturing when 50% or more of the principle building floor area or greater. The O-P District is distinct from I-1, Light Industrial District, through higher requirements in overall open space (requires 30% green space) and building design standards. Working with developers it is becoming apparent tenants are needing multi-use facilities that include a combination of office, manufacturing space with warehouse space versus one of these uses as a single occupancy. While the O-P district allows this combination of uses the design standards specific to the O-P district uses are driving up costs resulting in O-P zoned sites being more challenging to develop compared to I-1 zoned sites. ANALYSIS Section 11-17-9 of the zoning ordinance outlines building type and construction requirements for all uses including uses in the O-P district in 11-17-9. D. Staff is proposing some minor amendments that can provide for some increased flexibility in materials without compromising on high quality design. No changes to permitted or conditional uses are proposed, only changes to the design standards. DRAFT ORDINANCE Staff drafted a proposed amendment to Section 11-17-9.D with the following: 2 • Focus on front, sides and rear elevations visible from public street, parks, residential areas and require two or more materials that are 65% grade A materials on these elevations. The current ordinance does not specify more than one grade A material. • All side and rear elevations not visible may use a combination of A, B or C grade materials (with no specific percentage amount). This would allow non-visible elevations to follow standards more aligned with the I-1 district. • Allow smooth finish as one of the concrete panel options as a grade A material. The current ordinance allows concrete panels as a grade A material but does not include smooth. • Require buildings to have a two-story appearance with windows and design treatments to define the floors. This is a new requirement intended to ensure that buildings have a more office-building appearance to maintain some distinction from a true warehouse look while still being a multi-use building. • Reorganized a stipulation that applied to commercial uses and added it to the commercial section. CONCLUSION AND RECOMMENDATION The proposed draft meets the purpose and intent of the O-P, Office Park District with some increased flexibility that will continue to provide architectural controls. The proposed amendment was reviewed and supported by the EDC at their meeting on September 27th. Staff recommends approval of the proposed Zoning Ordinance amendment. 1 ORDINANCE NO.________ CITY OF LAKEVILLE DAKOTA COUNTY, MINNESOTA AN ORDINANCE AMENDING THE LAKEVILLE CITY CODE THE CITY COUNCIL OF THE CITY OF LAKEVILLE ORDAINS: Section 1. Section 11-17-9. D of the Lakeville City Code is hereby amended to read as follows: 1. Commercial Districts (except O-P District): a. The exterior building finish shall use at least three (3) grade A materials, except that buildings may be constructed primarily of one (1) specific grade A material provided the design is obviously superior to the general intent of this title, provides variation in detailing, footprint of the structure or deviations in long wall sections to provide visual interest. b. The exterior building finish shall be composed of at least sixty five percent (65%) grade A materials; not more than thirty five percent (35%) grade B or grade C material and not more than ten percent (10%) grade D materials. c. Masonry veneer may be used for principal buildings with a gross floor area of less than ten thousand (10,000) square feet to satisfy the grade A material requirements of this section. 2. O-P District uses and all institutional uses regardless of zoning district: a. The exterior building finish of the front and any side and rear elevations visible from public right(s)-of-way, parks, public view from adjacent properties, or residential uses or districts (as determined by the Zoning Administrator), shall be composed of at least two (2) or more materials that consist of at least sixty-five percent (65%) grade A materials, not more than thirty-five percent (35%) grade B and grade C materials, and not more than ten percent (10%) grade D materials. (1) Architecturally precast concrete panels with a form liner, tooled, brick and stone face, cast stone, and/or smooth type finish may be used to satisfy the grade A material requirements of this section. 2 (2) Masonry veneer may be used for principle buildings with a gross floor area of less than ten thousand (10,000) square feet to satisfy the grade A material requirements of this section. b. Architecturally precast concrete panels with a form liner, tooled, brick and stone face, and/or cast stone type finish may be used to satisfy the grade A material requirements of this section. Side or rear elevations not visible from public right(s)-of-way, parks, public view from adjacent properties or residential uses or districts shall use a combination of grade A, B, or C materials for the exterior building finish. c. Masonry veneer may be used for principal buildings with a gross floor area of less than ten thousand (10,000) square feet to satisfy the grade A material requirements of this section. Buildings shall have an office design, as opposed to a warehouse design, with a two-story appearance by the use of window bands and other design treatments that define “floors” on the front and any side or rear elevations visible from public right(s)-of-way, parks, public view from adjacent properties, or residential uses or districts. 3. Institutional uses regardless of zoning district: a. The exterior building finish shall be composed of at least sixty five percent (65%) grade A materials, not more than thirty five percent (35%) grade B and C materials, and not more than ten percent (10%) grade D materials. b. Architecturally precast concrete panels with a form liner, tooled, brick and stone face, and/or cast stone type finish may be used to satisfy the grade A material requirements of this section. c. Masonry veneer may be used for principal buildings with a gross floor area of less than ten thousand (10,000) square feet to satisfy the grade A material requirements of this section. 34. All elevations of the principle and accessory structures are to have essentially the same or coordinated harmonious exterior finish with the exception of material uses as defined in subsection 2.a, b, and c above. Section 2. Section 11-17-9. F.1 of the Lakeville City Code is hereby repealed and subsequent sections renumbered accordingly: 1. One Grade A Material: Buildings may be constructed primarily of one specific grade A material provided the design is obviously superior to the general intent of this title, provides variation in detailing, footprint of the structure or deviations in long wall sections to provide visual interest. 3 Section 3. This Ordinance shall be effective immediately upon its passage and publication according to law. PASSED and ADOPTED by the Lakeville City Council this ______ day of ______________, 2022.
