INTRODUCTION
Applications for preliminary and final plat and conditional use permit have been submitted by
representatives of One School Global for the development of a 12,021 square foot private school
(institutional use) in the RM-1, Medium Density Residential District. The subject property is
located south of Hartford Way and west of Hamburg Avenue totaling 2.0 acres.
The Lakeville Christian Church Second Addition plans have been distributed to the
Engineering Division and the Parks and Recreation Department.

PLANNING A NALYSIS
PRELIMINARY AND FINAL PLAT
Existing Conditions. The property is a 2.0 acre undeveloped outlot created as part of the
Lakeville Christian Church First Addition final plat in 2022. The site is flat and includes a South
Creek tributary to the Vermillion River along the west and south boundary of the property. A
portion of the property is located within the 300-foot wide Shoreland Overlay District of the
tributary stream.
Adjacent Land Uses.
North: Hartford Way, Village Creek Townhomes, and a single-family home (RM-2 and
RS-3 Districts)
South: City owned stormwater outlot and Lakeville Boulevard (RM-1 District)
East: Future Lakeville Christian Church site (RM-1 District)
West: City Owned outlot and stream tributary and single-family homes (P/OS and RS-3
Districts)
Consistency with the Comprehensive Plan. The property is located in Planning District No. 4
of the 2040 Comprehensive Land Use Plan which guides the property for medium density
residential development. The private school use is allowed in the RM-1 District subject to
approval of a conditional use permit.
Zoning. The subject property is zoned RM-1, Medium Density Residential District which
allows accredited private elementary through high schools by conditional use permit. The west
third of the property is located within the 300-foot Shoreland Overlay District boundary of the
tributary stream to the Vermillion River. The stream is an environmentally protected water
course.

MUSA. The Lakeville Christian Church Second Addition preliminary and final plat is located
within the current Metropolitan Urban Service Area (MUSA) and will be served with city
sewer and water services.
Premature Subdivision Criteria. A preliminary plat may be deemed premature if any of the
criteria listed in Chapter 10-2-4-1 of the Subdivision Ordinance exist. Eligible criteria pertain
to a lack of adequate: drainage, water, streets, sanitary sewer, and public service capacity
(police and fire protection). The other pertinent criteria pertain to inconsistencies with the
City Comprehensive Land Use and Capital Improvement Plans. Staff’s review of the Lakeville
Christian Church Second Addition preliminary plat with these criteria finds that it is not a
premature subdivision.
Lots and Blocks. One, two-acre lot is proposed. There is no minimum lot size for
institutional uses in the RM-1 District.
Outlots. No outlot is proposed with the preliminary and final plat of Lakeville Christian
Church Second Addition.
Setbacks. The One School Global preliminary site plan meets the RM-1 District setback
requirements, as follows:
Abutting a Public Street – 30 feet
Front Yard – 30 feet
Rear Yard – 30 feet
Side Yards – 14 feet
Streets. The subject site abuts one street, Hartford Way to the north. Hartford Way is
classified as a minor collector street. No additional right-of-way dedication is required for
Hartford Way.
Park and Open Space. Park land dedication is not identified in the Parks, Trails and Open
Space Plan for this area and no park land dedication is required with the Lakeville Christian
Church Second Addition preliminary and final plat. The 2.0 acre property will be subject to a
single family home equivalent cash fee park dedication rate in effect at the time of final plat
approval. The 2022 park dedication fee is $3,382.
Trails and Sidewalks. An existing sidewalk is located along the south side of Hartford Way.
No sidewalk connections are proposed with the school use.

Grading, Drainage and Utility Plans. The grading, drainage and utility plans were submitted
to the Engineering Division for review. The subject property has access to City sewer, water,
and storm water utilities. Please refer to the October 12, 2022 Engineering Division report
prepared by Lucas Ritchie, Civil Engineer and Mac Cafferty, Environmental Resources
Coordinator for more detailed review comments.
Tree Preservation. There are no significant trees within the Lakeville Christian Church
Second Addition preliminary and final plat.
Wetlands. There are no wetlands within the Lakeville Christian Church Second Addition
preliminary and final plat.
Floodplain Boundaries. Proposed Lot 1, Block 1, Lakeville Christian Church Second
Addition is not located in a designated floodplain.
Department of Natural Resources. The property lies within the Shoreland Overlay District of
the South Creek Vermillion River Tributary, a DNR designated stream corridor. As part of
the Lakeville Christian Church Second Addition preliminary and final plat review, the DNR
staff agreed that the total impervious surface area of the school site within the Shoreland
Overlay District at 44% is off-set with the dedication to the City of the 2.69 acre Outlot A,
Lakeville Christian Church First Addition, of which approximately 90% of the portion located
within the Shoreland Overlay District is green space.
CONDITIONAL USE PERMIT
A conditional use permit is required for the private school use within the RM-1 District, to
allow an exception to the exterior building finish requirements for an institutional use, and to
allow a fence located in the front yard setback for an institutional use.
Building Design and Exterior. The proposed 12,021 square foot building will include
classrooms, a gymnasium, and other space related to school classrooms and administrative
offices. The floor plan proposes two large classrooms divided between younger and older age
groups and eight smaller educational rooms. A lunchroom, staff room, and a multi-purpose
room are also proposed. Approximately one-third of the floor plan is occupied by the
gymnasium.
Section 11-17-9.D requires institutional buildings to provide exterior materials with a
minimum of three Grade A materials, at least 65% Grade A materials, not more than 35%
Grade B or Grade C materials, and not more than 10% Grade D materials. Section 11-17-9
includes explanations of the various types of materials allowed and required and the criteria

by which any exceptions must be measured. A conditional use permit was approved to allow
the Lakeville Christian Church to be constructed to the east with a similar variation of
building materials. The school proposes to use a similar exterior design as the church.
Section 11-17-9.G outlines exceptions to the exterior building materials requirements that
may be granted by conditional use permit subject to the following criteria:
1. The use is an airport or essential service as defined by this title; or
The private school use is not considered an airport or essential service as defined by the
Zoning Ordinance.
2. The applicant shall have the burden of demonstrating that:
a. The proposed building maintains the quality in design and materials intended by this
title.
The primary exterior building material is proposed to be a mix of cultured stone
(Grade A) and LP Smartside engineered wood siding (Grade C). Lakeville Christian
Church received approval this year for the church’s exterior materials on the
adjacent lot. One School Global proposes to use similar building materials for
continuity.
b. The proposed building design and materials are compatible and in harmony with
other structures within the district.
The proposed exterior building materials for the low profile 12,107 square foot
building provide the look and durability desired for a religious institution use in the
RM-1 District and will be compatible with the adjacent single family and townhome
buildings in the neighborhood.
c. The justification for deviation from the requirements of this section shall not be
based on economic considerations.
The exterior design of the building is intended to be consistent with the residential
neighborhood character of the area utilizing the following materials:
North Façade
42% cultured stone (Grade A)
58% wood composite siding (Grade C)

South Façade
52% cultured stone (Grade A)
48% wood composite siding (Grade C)
East Façade
47% cultured stone (Grade A)
53% wood composite siding (Grade C)
West Façade
32% cultured stone (Grade A)
68% wood composite siding (Grade C)
Building Height. The school building will be 28 feet in height at the uppermost point of the
gymnasium roof, which is less than the maximum 35 foot height allowed.
Mechanical Unit Screening. Mechanical screening will be located on the lower roof below the
gymnasium wall. Screening will consist of the lighter colored horizontal LP Smartside panels
as noted on Exhibit I.
Parking. Parking for this school will be calculated separately for the elementary, middle
school, and high school grades. The planned enrollment for the school is proposed to be
approximately 32 students, with eight high school students and 24 elementary through middle
school students.
Elementary and middle schools - one space per seven students (four parking spaces)
High schools - one space per three students plus one space per classroom (three + one = four
parking spaces)
The site plan proposes 19 parking spaces, including two handicapped accessible spaces.
Eleven future parking spaces are identified north of the proposed parking lot in the event
additional parking spaces are necessary. The church has agreed to allow use of shared parking
in the event of higher demand such as family events within the school building that may
increase parking demand. A shared parking agreement shall be submitted and recorded with
the conditional use permit between the school and church properties. Parking is not allowed
on Hartford Way.
School enrollment and employees shall be limited to 50 persons based on the proposed
building design and Building Code requirements for maximum allowed capacity as a school.
Building Code allows an occupancy up to 281 persons for occurrences such as family
gatherings or sporting events and the like.

Vehicle access to the school site is from a single driveway off Hartford Way. There is no
driveway connection between the school and church sites.
Landscaping/Screening. The landscape plan proposes planting 21 evergreen trees and 21
deciduous trees as well as numerous shrubs throughout the site. The evergreen trees will be
planted as screening of the school and parking lot from the single family lot to the north, from
Hartford Way, and from the adjacent DNR protected stream. The proposed landscaping
meets Zoning Ordinance requirements.
Fence. One School Global proposes to install a five foot tall wrought iron style decorative
open design fence set back 15 feet from the north side of the lot within the front yard setback
consistent the church on the lot to the east. A conditional use permit is required to allow a
fence within the 30 foot front yard setback. The fence will be more than 75% open in design
consistent with the church fence to the east and will be compatible with the single family
homes in the vicinity.
A security gate will be located at the driveway entrance similar to the church property. A five
foot tall black coated vinyl chain link fence will be located around the south, west, and east
sides of the property consistent with the church site.
The security gate at the driveway entrance will be locked during building occupancy and
during non-occupancy hours. Parents and employees will have a means of access through the
gate. There will also be a gate control inside the building. The security gate shall require a
lock-box or an Opticom light sensor to allow police, fire, and EMT access to the property and
building in the event of an emergency. The Opticom light sensor is fitted to all safety response
vehicles and is the same system that allows emergency vehicles to control signalized road
intersections.
The site plan proposes a gate to be installed at the sidewalk connecting the school property to
the church parking lot.
Exterior Storage/Trash and Recycling Container Enclosure. A trash and recyclable
materials enclosure is not identified on the plans. Any outside storage of trash containers will
require a screening enclosure constructed of materials similar to the school building and in
compliance with Zoning Ordinance requirements.
Lighting. The church does not propose parking lot light fixtures. Planning Department staff
recommends a site lighting plan be submitted for site security prior to City Council
consideration of the conditional use permit. Staff recommends that parking lot lighting be
installed on poles not more than 15 feet in height and be down-cast and shielded to prevent

glare. Any security lighting proposed for the building must also be downcast and shielded to
prevent glare on to adjacent properties in compliance with Zoning Ordinance requirements.
Signs. One School Global has not proposed signs for the building or property. Any future
proposed signage will require approval of a sign permit prior to installation.
RECOMMENDATION
The Planning Department recommends approval of the Lakeville Christian Church Second
Addition preliminary and final plat and conditional use permits requested subject to the
following stipulations:
1. The site development shall comply with the recommendations outlined in the October
12, 2022 engineering memorandum.
2. The building exterior shall match the design and building materials approved with the
conditional use permit.
3. School enrollment and employees shall be limited to 50 persons based on the building
design and Building Code requirements.
4. The five foot tall fence along the front (north) property line shall be at least 75% open.
A fence permit is required prior to installation.
5. The security gate at the driveway entrance shall include a lock-box or an Opticom light
sensor to allow police, fire, and EMT access to the property and building in the event
of an emergency.
6. A shared parking agreement shall be submitted and recorded with the conditional use
permit between the school and church properties prior to issuance of a building
permit.
7. Landscaping shall be installed consistent with the landscape plan approved by the City
Council. A $25,000 landscaping security shall be submitted with the final plat to
guarantee installation of the approved landscaping.
8. Any outside storage of trash containers will require a screening enclosure constructed
of materials similar to the school building and in compliance with Zoning Ordinance
requirements.

9. Parking lot lighting pole height shall not exceed 15 feet in height, excluding the height
of the light pole pedestal. Site lighting and building lighting shall be down-cast and
shielded to prevent glare onto adjacent properties.

CONDITIONAL USE PERMIT
FINDINGS OF FACT AND RECOMMENDATION
On October 20, 2022, the Lakeville Planning Commission met at their regularly scheduled
meeting to consider the applications of Westwind Education Inc., dba One School Global
Minneapolis, for a conditional use permit to allow:
a) A private educational institution in the RM-1 District and an exception to the
exterior building finish requirements for an institutional use, and
b) An exception to the exterior building finish requirements for an institutional use in
the RM-1 District, and
c) A fence located within the front yard setback for an institutional use.
The Planning Commission conducted a public hearing on the proposed conditional use
permit preceded by published and mailed notice. The applicant was present and the
Planning Commission heard testimony from all interested persons wishing to speak.
FINDINGS OF FACT
1. The property is located in Comprehensive Planning District No. 4, Central
Lakeville, which guides the property for medium density residential uses.
2. The property is zoned RM-1, Medium Density Residential District.
3. The legal description of the property is:
Lot 1, Block 1, Lakeville Christian Church Second Addition
4. Section 11-4-3E of the City of Lakeville Zoning Ordinance provides that a
conditional use permit may not be issued unless certain criteria are satisfied. The
criteria and our findings regarding them are:

a) The proposed action has been considered in relation to the specific
policies and provisions of and has been found to be consistent with the
official City Comprehensive Plan.
Finding: The proposed private educational institution is consistent with uses
allowed in residential zoning district areas of the City. The school use, the
proposed exterior building finish materials, and fence located in the front yard
setback for an institutional use is consistent with the policies and provisions of
Planning District 4 of the Comprehensive Land Use Plan.
b) The proposed use is or will be compatible with future land uses of the area.
Finding: The proposed private educational institutional use, the proposed
exterior building finish materials for an institutional use, and the fence in
the front yard setback is consistent in the RM-1 District and will be
compatible with existing residential land uses in the area.
c) The proposed use conforms with all performance standards contained
in the Zoning Ordinance and the City Code.
Finding: The proposed private educational institution use, the proposed
exterior building finish materials for an institutional use, and the fence in the
front yard setback will conform to the performance standards set forth in the
Zoning Ordinance given compliance with the stipulations of the conditional
use permit.
d) The proposed use can be accommodated with existing public services
and will not overburden the City’s service capacity.
Finding: The proposed private educational institution use will be served with
existing public services and will not overburden the City’s service capacity.
e) Traffic generation by the proposed use is within capabilities of streets
serving the property.
Finding: Traffic generation from the proposed private educational institution use
can be accommodated by minor collectors Hamburg Avenue and Hartford Way
serving the property.

RECOMMENDATION
The Planning Commission recommends that the City Council approve the conditional
use permit conditioned upon compliance with the planning report prepared by Associate

plat named Lakeville Christian Church Second Addition, and a conditional use permit and site
plans to construct a 12,021 square-foot school on proposed Lot 1, Block 1, Lakeville Christian
Church Second Addition.
The proposed development is located west of Hamburg Avenue, north of Lakeville Boulevard
and south of and adjacent to Hartford Way. The parent parcel consists of Outlot B, Lakeville
Christian Church First Addition zoned RM-1, Medium Density Residential District. The
preliminary and final plats consist of one lot within one block on 2.00 acres. The Developer
dedicated the necessary right-of-way for Lakeville Boulevard with the recording of the final
plat of Lakeville Christian Church First Addition.

Hamburg Avenue and Hartford Way
Lakeville Christian Church Second Addition is located west of Hamburg Avenue and south of
and adjacent to Hartford Way, both minor collector roadways as identified by the City’s
Transportation Plan. Hamburg Avenue and Hartford Way are currently constructed as two-
lane undivided urban roadways adjacent to the plat. The Developer has dedicated the
necessary right-of-way with the Lakeville Christian Church First Addition plat.
Parking is not permitted along Hamburg Avenue or Hartford Way adjacent to the parent
parcel.
Development of Lakeville Christian Church Second Addition includes construction of one
entrance along Hartford Way. The driveway entrance must be constructed per City standards.
A $10,000 security will be required with the final plat for construction of the driveway
entrance onto the public roadway.
Lakeville Boulevard
Lakeville Christian Church Second Addition is located north of Lakeville Boulevard, a major
collector roadway as identified by the City’s Transportation Plan. The Developer has
dedicated the necessary right-of-way as shown on the final plat of Lakeville Christian Church
First Addition. No access or improvements are proposed along Lakeville Boulevard.

downstream facilities have sufficient capacity to serve the proposed commercial
development.
Eight-inch private sanitary sewer was extended with City Project 19-05 to provide utility
service to the parent parcel. The sanitary sewer was tested and approved for connection. The
development of Lakeville Christian Church First Addition includes the construction and
extension of the private sanitary sewer to the parent parcel to provide service to Lot 1, Block
1, Lakeville Christian Church Second Addition.

Lakeville Christian Church Second Addition is located within subdistrict SC-188 of the South
Creek stormwater district as identified in the City’s Water Resources Management Plan.
In conjunction with City Project 19-05, the City constructed a series of public stormwater
management basins south of the parent parcel on Outlot A, Lakeville Christian Church First
Addition. In exchange for the land dedication for the basin area, the City oversized the
stormwater management system to provide the necessary stormwater treatment and rate
control for development of the parent parcel. No additional stormwater management
improvements are necessary with the development.
The final grading plan shall identify all fill lots in which the building footings will be placed on
fill material. The grading specifications shall also indicate that all embankments meet
FHA/HUD 79G specifications. The Developer shall certify to the City that all lots with footings
placed on fill material are appropriately constructed. Building Certificate of Occupancies will
not be issued until a soils report and an as-built certified grading plan have been submitted
and approved by City staff.
Lakeville Christian Church Second Addition contains more than one acre of site disturbance. A
National Pollution Discharge Elimination System General Stormwater Permit for construction
activity is required from the Minnesota Pollution Control Agency for areas exceeding one acre
being disturbed by grading. A copy of the Notice of Stormwater Permit Coverage must be
submitted to the City upon receipt from the MPCA.

Development of Lakeville Christian Church Second Addition includes the construction of a
private storm sewer system. Privately owned and maintained storm sewer constructed within
the site will collect and convey runoff to the publicly owned and maintained stormwater
basins on Outlot A, Lakeville Christian Church First Addition.
The Trunk Storm Sewer Area Charge has not been collected and will be required to be paid
with the final plat, at the rate in effect at the time of final plat approval, calculated as follows:

there are no areas in the plat located within a Special Flood Hazard Area (SFHA), as
determined by FEMA.

There are no wetlands on the site. The wetland, creek and buffer was placed in a City owned
outlot with the first addition final plat.

The plans include a detailed erosion and sediment control plan. The Developer is responsible
for meeting all the requirements of the MPCA Construction Permit. Additional erosion control
measures may be required during construction as deemed necessary by City staff. Any
additional measures required shall be installed and maintained by the Developer. An on-site
preconstruction meeting shall be held with the City prior to the issuance of a building permit.
The MS4 Administration Fee has not been collected on the parent parcels and must be paid
