PLANNING COMMISSION MEETING MINUTES
October 6, 2022 Chair Witte called the meeting to order at 6:00 p.m. in the Council Chambers at City Hall. The Pledge of Allegiance to the flag was given.

3. Approval of the Meeting Minutes
The September 22, 2022 Planning Commission meeting minutes were approved as presented.

5. Dennis Prawdzik Chair Witte introduced the request of Dennis Prawdzik for an extension to Conditional Use Permit No. 20-11 to allow the construction of a detached accessory building exceeding the maximum combined allowable floor area in the RS-CBD, Single Family Residential-Central Business District, located at 8540 208th Street. Dennis Prawdzik indicated that this is an extension from the previous application two years ago and explained the reason for his request. Community Development Director Goodroad stated that this extension request requires a recommendation from the Planning Commission and approval by the City Council. Staff recommends approval of the extension request. Chair Witte asked for comments from the Planning Commission. Commissioner Lillehei outlined the process for CUP extension requests.
Motion was made by Drotning, seconded by Swenson to recommend to the City Council approval of a one-year extension to CUP No. 20-11.

6. Panda Express Inc. Chair Witte introduced the continued application of Panda Express Inc. for a conditional use permit to allow the construction of a convenience restaurant with a drive-through service window in the Timbercrest at Lakeville PUD. Associate Planner Kris Jenson stated that City staff met with Raising Cane’s management to discuss occasions when drive-through traffic backed up into the shared private access drive from Kenrick Avenue. Raising Cane’s management staff stated that they currently don’t have the staff to support the stipulation from CUP No. 21-10 that requires Raising Cane’s to use both of the drive-through lanes for the menu boards and the payment/pick-up windows when vehicle traffic within the drive-through backs up into the shared access drive, but they will explore routing vehicle traffic through the Raising Cane’s parking lot before entering the drive-through to provide additional stacking space on-site during peak hours. Planning Department staff recommends approval of the Panda Express, Inc. conditional use permit, subject to the eight stipulations listed in the revised September 29, 2022 planning report, and approval of the Findings of Fact dated October 6, 2022. Chair Witte asked for comments from the Planning Commission. Discussion points included:
• Commissioner Zimmer asked for clarification regarding the proposed Panda Express CUP stipulation to require both drive-through lanes to remain fully open. Ms. Jenson outlined the interim options presented.
• Chair Witte thanked staff for following up with Raising Cane’s management to discuss options to address peak traffic demand.
• Discussed bollards versus a fence as a physical barrier to delineate the drive-through from the adjacent drive aisle.
Motion was made by Lillehei, seconded by Drotning to recommend to City Council approval of the application of Panda Express Inc. for a conditional use permit to allow the construction of a convenience restaurant with a drive-through service window in the Timbercrest at Lakeville PUD, subject to the following stipulations and approval of the Findings of Fact dated October 6, 2022: 1. The hours of operation shall not exceed 5:00 am to 11:00 pm, seven days a week. 2. Landscaping shall be installed consistent with the approved landscape plan. An escrow shall be submitted with the building permit application to guarantee installation of the approved landscaping. 3. Snow storage may not be located within required parking spaces. 4. Prior to City Council consideration of the CUP, the landscape plan must be modified to add plantings between the parking lot and the retaining wall as well as shifting the plantings at the northeast corner to be centered between the parking lot and the street. Additional plantings should also be added in this area to enhance the entrance to the site.

5. Prior to City Council consideration of the CUP, details for the physical barrier along the west side of the drive-through must be submitted for review. 6. Signs must be in compliance with the Timbercrest at Lakeville Architectural Standards and a sign permit must be issued prior to installation. Wall signs are limited to two exterior elevations. 7. Prior to release of a building permit, a security for erosion control and landscaping must be submitted. 8. In order to minimize the potential for vehicle stacking for the drive-through extending onto the private access road from Kenrick Avenue, Panda Express is required to make use of both menu drive-through lanes any time the drive-through stacking lane reaches the private access road from Kenrick Avenue.

7. City of Lakeville Chair Witte opened the public hearing to consider an amendment to Title 11, Chapter 17-9 of the Lakeville City Code concerning OP District exterior building finish requirements. Community Development Director Tina Goodroad presented the planning report. Ms. Goodroad stated staff has reviewed plans for development within the OP District. She indicted developers are looking to construct buildings that can be used for a multiple purpose versus a standalone building, and she highlighted example building exterior elevations. Chair Witte opened the hearing to the public for comment.
There were no comments from the audience.
Motion was made by Lillehei, seconded by Zimmer to close the public hearing at 6:39 p.m.
Voice vote was taken on the motion. Ayes – unanimous Chair Witte asked for comments from the Planning Commission. Discussion points included:
• The Planning Commission discussed the different building window types and appearances and how they will function in traditional industrial buildings within the OP District.
Motion was made by Swenson, seconded Zuzek to recommend to City Council approval of the proposed amendment to Title 11, Chapter 17-9 of the Lakeville City Code concerning OP District exterior building finish requirements, as presented.
