PLANNING COMMISSION MEETING MINUTES
October 20, 2022 Chair Witte called the meeting to order at 6:00 p.m. in the Council Chambers at City Hall. The Pledge of Allegiance to the flag was given.

3. Approval of the Meeting Minutes
The October 6, 2022 Planning Commission meeting minutes were approved as presented.

5. Keswick Medical Addition Chair Witte opened the public hearing to consider the application of Ross Hedlund, representing Twin Cities Orthopedics for a preliminary plat of one commercial lot to be known as Keswick Medical Addition, located south of 210th Street (CSAH 70) and north of Keswick Loop. Ross Hedlund from Frauenshuh presented a brief overview of the project. Associate Planner Frank Dempsey presented the planning report. Mr. Dempsey stated that an application was submitted for a preliminary and final plat of 5.5 acres of property in conjunction with the proposed development of a 44,255 square foot, two story medical office building located at 21074 Keswick Loop. Mr. Dempsey outlined the lot requirements within the C-3 District. He indicated that the proposed building and parking lot comply with Zoning Ordinance setback requirements. The site access will be from two driveways at Keswick Loop. The west driveway access will be shared with the Candlewood Suites hotel. A total of 214 parking spaces are proposed on the site plan, however, staff recommends that the four parking spaces west of the west driveway entrance and the southerly three parking spaces on the east side of the east driveway entrance be removed to reduce potential traffic conflicts.

Mr. Dempsey stated the landscape plan must be amended to include parking lot screening adjacent to Keswick Loop as required by the Zoning Ordinance. Planning staff recommends that stipulation #3 from the October 12, 2022 planning report be amended to include this requirement. Planning Department staff recommends approval of the Keswick Medical Addition preliminary plat subject to the eight stipulations listed in the October 12, 2022 planning report as amended. Chair Witte opened the hearing to the public for comment.

Motion was made by Majorowicz, seconded by Zuluza to close the public hearing at 6:12 p.m.
Voice vote was taken on the motion. Ayes - unanimous
Chair Witte asked for comments from the Planning Commission. Discussion points included:
• Clarification was provided on the proposed driveways access points at Keswick Loop.
• Commissioner Drotning inquired about the parking lot and how this affects the parking relating to the proposed building. Mr. Dempsey outlined the requirements for the parking spaces.
Motion was made by Zimmer, seconded Drotning to recommend to City Council approval of the Keswick Medical Addition preliminary plat of one commercial lot, subject to the following stipulations, and approval of the Findings of Fact dated October 20, 2022: 1. The site shall be developed in accordance with the approved preliminary and final plat plans and in compliance with Zoning Ordinance requirements. 2. The site shall be developed in accordance with the recommendations listed in the October 12, 2022 engineering report. 3. The property owner shall be responsible for maintenance of all landscaping, including within the boulevard. A financial security of $30,000 shall be submitted to guarantee installation of the landscaping per the approved landscape plan. Prior to City Council consideration, the landscape plan shall be revised to include parking lot screening adjacent to Keswick Loop as required by the Zoning Ordinance. 4. Site lighting shall be installed in accordance with the approved lighting plan and shall meet the requirements of the Zoning Ordinance. 5. All signage on the property must meet the requirements of Section 11-23 of the Zoning Ordinance. A sign permit is required prior to the installation of any signs. 6. Snow storage shall not occur within required parking spaces and vehicle driving lanes.

7. Modify the site plan to remove the four parking spaces west of the west driveway entrance drive and three parking spaces at the east side of the east driveway entrance drive prior to City Council consideration of the preliminary and final plat. 8. Prior to City Council consideration, the final plat must be revised to include a permanent drainage and utility easement over the public utilities being extended through the site to serve the UCA Development.

6. Lakeville Christian Church Second Addition
Chair Witte opened the public hearing to consider the application of Westwind Education Inc, dba OneSchool Global Minneapolis for the following, located north of Lakeville Boulevard, west of Hamburg Avenue, and south of Hartford Way: 1. Preliminary plat of one lot to be known as Lakeville Christian Church Second Addition, and 2. Conditional use permit to allow a private educational institution (Grades 3-12) in the RM-1, Medium Density Residential District and an exception to the exterior building finish requirements for an institutional (school) use. Greg Cornell, from OneSchool Global Minneapolis, presented a brief overview of the request. Associate Planner Frank Dempsey presented the planning report. Mr. Dempsey stated the applicant has applied for a preliminary and final plat and conditional use permit for the development of a 12,021 square foot private school (institutional use) in the RM-1, Medium Density Residential District. The proposed building will include classrooms, a gymnasium, and other space related to school classrooms and administrative offices. The preliminary and final plat and conditional use permit are discussed in more detail in the October 12, 2022 planning report. Planning Department staff recommends approval of the Lakeville Christian Church Second Addition preliminary plat and conditional use permit subject to the nine stipulations listed in the October 12, 2022 planning report. Chair Witte opened the hearing to the public for comment.

Chair Witte asked for comments from the Planning Commission. Discussion points included:
• Commissioner Zimmer asked for clarification regarding the Police, Fire, and EMT access to the property in the event of an emergency if the security gate to the parking lot is closed. Mr. Dempsey clarified the staff recommendation regarding the school parking lot security gate as well as the pedestrian security gate connecting the school property to the church property.
Motion was made by Lillehei, seconded by Drotning to recommend to City Council approval of the Lakeville Christian Church Second Addition preliminary plat and conditional use permit, subject to the following stipulations, and approval of the Findings of Fact dated October 20, 2022: 1. The site development shall comply with the recommendations outlined in the October 12, 2022 engineering memorandum. 2. The building exterior shall match the design and building materials approved with the conditional use permit. 3. School enrollment and employees shall be limited to 50 persons based on the building design and Building Code requirements. 4. The five-foot-tall fence along the front (north) property line shall be at least 75% open. A fence permit is required prior to installation. 5. The security gate at the driveway entrance shall include a lock-box or an Opticom light sensor to allow police, fire, and EMT access to the property and building in the event of an emergency. 6. A shared parking agreement shall be submitted and recorded with the conditional use permit between the school and church properties prior to issuance of a building permit. 7. Landscaping shall be installed consistent with the landscape plan approved by the City Council. A $25,000 landscaping security shall be submitted with the final plat to guarantee installation of the approved landscaping. 8. Any outside storage of trash containers will require a screening enclosure constructed of materials similar to the school building and in compliance with Zoning Ordinance requirements. 9. Parking lot lighting pole height shall not exceed 15 feet in height, excluding the height of the light pole pedestal. Site lighting and building lighting shall be downcast and shielded to prevent glare onto adjacent properties.
