INTRODUCTION
The Goddard School representatives have submitted an application for a planned unit
development (PUD) amendment to allow the construction of a 3,500 square foot addition on
the north side of the existing daycare building located at 16189 Elmhurst Lane. The proposed
addition will include space for classrooms, a multipurpose room, and a staff room. The daycare
use was approved by a development stage PUD in 2015.
The subject property is zoned PUD, Planned Unit Development subject to the C-3, General
Commercial District uses and performance standards. Daycare centers are an allowed use
within the Spirit of Brandtjen Farm PUD subject to applicable requirements of the Zoning
Ordinance.

SITE ANALYSIS
The proposed building addition will be on the north side of the existing building. The
addition includes two classrooms, a staff room, a multi-purpose room, and four bathrooms. A
connection from the existing building will be provided via an indoor hallway.
The existing Goddard School is 9,212 square feet in area with outdoor fenced areas on the east
and west sides of the building. The development stage PUD approved in 2015 allowed daycare
for up to 144 children. The expansion is proposed to increase the license capacity to 199
children.

The proposed building addition was reviewed for conformance with Zoning Ordinance
performance standards as follows:

Building Elevations and Exterior Building Materials. The building addition will be
constructed of the same red brick as the existing structure. When the original structure was
approved in 2015, it was determined that although the building exterior was primarily one
Grade A material – red brick – it met the intent of Section 11-17-9.F.1, which states that a
building may be constructed primarily of one specific Grade A material provided the design is
obviously superior to the general intent of this title.

Building Height. The building addition will match the existing roof line, which has a
maximum height of 28 feet. The proposed building addition meets the height maximum
allowed in the C-3 District, which is three stories or 35 feet.
Floor Plan. The floor plan for the building addition includes daycare classrooms, a staff room,
multi-purpose room, and bathrooms.
Fencing. The daycare site has an existing white vinyl fence surrounding the exterior play areas
on site. The fence at the rear of the property will be removed to accommodate the building
addition and will be replaced with new six-foot-tall white vinyl fencing.
Access and Circulation. The property is accessed via one driveway to and from Elmhurst
Lane, which will remain unaffected by the proposed building addition and use.
Parking. The proposed building expansion will allow the daycare center to increase their
capacity from 144 children to 199 children, which then requires additional parking for the
site. The parking lot currently has 42 spaces which was in excess of the 36 spaces required at
the time of construction. With the increase in student capacity, the number of required spaces
has increased to 50 spaces. These additional eight spaces are shown on the south side of the
parking lot as proof of parking.
The applicant has requested a parking deferment for the eight additional spaces. A narrative
(Exhibit C) was submitted about the operation of the daycare, including parking counts from
the peak arrival and departure times over two days in August. The counts, taken every five
minutes between the hours of 7:15 am - 9:10 am and 4:00 pm - 5:25 pm, shows an average of
less than 20 cars in the parking lot at a time, well below the 42 parking spaces currently
available within the parking lot. Even if the 40% increase in student capacity translates to a
40% increase in parking counts observed by the applicant, it would increase the average
parking count to approximately 28 vehicles, less than the existing 42 parking spaces. Based on
this information, staff is willing to support the request for a parking deferment of the eight
additional required parking spaces. A parking deferment agreement will be drafted by the City
Attorney’s office and must be executed prior to the issuance of a building permit for the
addition.
Sidewalks. There is currently an eight-foot-wide concrete public sidewalk located along both
Elmhurst Lane to the east and 162nd Street to the south of the site. A private sidewalk extends
from the sidewalk along Elmhurst Lane to provide access to the front of the building as well as
along the sides of the building, within the fenced play areas. A sidewalk will be added from an
exit door at the rear of the building to connect with the existing sidewalk along the east side of
the building, all within a fenced and secured area.
Landscaping. Foundation plantings will be added along the building addition in those areas
outside of the screening fence and three Ivory Silk Japanese Tree Lilacs will be planted in the
northeast corner of the site. All materials meet the size and species requirements of the
Zoning Ordinance. A $5,000 escrow must be submitted with the building permit to guarantee
installation of the approved landscaping.

Signs. No changes to the building or freestanding signage are proposed with this PUD
Amendment. The daycare is subject to the C-3 District requirements of the Zoning
Ordinance. A sign permit is required prior to the installation of any signs.
Mechanical Equipment. The site does not include any exterior mechanical equipment, and
none is proposed to be added in conjunction with the building addition. Should the need
arise, the mechanical equipment must be screened from the public right of way with
landscaping and/or fencing.
Lighting. Any additional exterior lighting shall be downcast in design, shall not glare onto
adjoining properties or public streets, and shall meet Zoning Ordinance requirements. Plans
and an electrical permit shall be submitted prior to the installation of any exterior lighting.
RECOMMENDATION
Planning Department staff recommends approval of The Goddard School planned unit
development amendment subject to the following stipulations:
1. The site and building addition shall be developed in accordance with the plans
approved by the City Council.
2. Landscaping shall be installed consistent with the approved landscape plan. A $5,000
security shall be submitted with the building permit application to guarantee
installation of the approved landscaping.
3. A building permit is required prior to commencing construction of the addition and
accessory building. Construction of the addition and accessory building is subject to
the approval of the Building Official and Fire Marshal.
4. A parking deferment for the eight parking spaces must be executed prior to the
issuance of a building permit for the addition to the daycare.
5. The Minnesota Department of Health child care license shall be approved by the State
of Minnesota prior to occupancy of the daycare addition.

3. SCREWS - Screws meeting ASTM C1002 - shall be permitted to be substituted for the
prescribed nails, one for one, when the length and head diameter of the screws equal
or exceed those of the nails specifiec in the tested system, and the screw spacing does
not exceed the spacing specified for the nails in the tested system.
11. INSULATION IN WALLS - When not specified as a component of a fire tested wall or
partition system, either faced or unfaced mineral fiber, glass fiber or celulose fiber
insulation of a thickness not exceeding that of the cavity depth shall be permitted to be
added within the stud cavity.
18. STUD SIZES AND DEPTHS - Greater stud sizes (depths) shall be permitted to be
used in metal- or wood-stud systems.
24. ADDITIONAL GYPSUM PANEL LAYERS - Additional layers of any type of gypsum

3. SCREWS - Screws meeting ASTM C1002 - shall be permitted to be substituted for the
prescribed nails, one for one, when the length and head diameter of the screws equal
or exceed those of the nails specifiec in the tested system, and the screw spacing does
not exceed the spacing specified for the nails in the tested system.
11. INSULATION IN WALLS - When not specified as a component of a fire tested wall or

FINDINGS OF FACT AND RECOMMENDATION
On November 3, 2022, the Lakeville Planning Commission met at its regularly scheduled meeting to
consider the application of The Goddard School for a development stage PUD amendment to allow the
construction of an addition to a daycare as a principal use. The Planning Commission conducted a public
hearing on the development stage PUD amendment application preceded by published and mailed notice.
The applicant was present and the Planning Commission heard testimony from all interested persons
wishing to speak.
FINDINGS OF FACT
1. The subject property is located in Comprehensive Planning District 3, which guides the property for
Commercial.
2. The subject site is zoned PUD, Planned Unit Development.
3. Legal description of the property is:
Lot 1, Block 1, Minnesota Blue Skies Addition.
4. Chapter 96 of the City of Lakeville Zoning Ordinance provides that a development stage PUD
amendment may not be issued unless the criteria of Chapter 3 of the Zoning Ordinance are satisfied.
The criteria and our findings regarding them are:
a. The proposed action has been considered in relation to the specific policies and provisions of
and has been found to be consistent with the official City Comprehensive Plan.
Finding: The proposed daycare use is consistent with the guided commercial use of the property
and the Spirit of Brandtjen Farm PUD.
b. The proposed use is or will be compatible with present and future land uses of the area.
Finding: The proposed daycare use will be compatible with the existing and future land uses in
the area.
c. The proposed use conforms to all performance standards contained in the Zoning Ordinance
and the City Code.

Finding: Provided compliance with the stipulations of the conditional use permit, the proposed use
will conform to the performance standards contained in the Zoning Ordinance and the City Code.
d. The proposed use can be accommodated with existing public services and will not overburden
the City’s service capacity.
Finding: The proposed use can be accommodated with existing public services and will not over

e. Traffic generated by the proposed use is within capabilities of streets serving the property.
Finding: The streets serving this site are adequate to accommodate traffic from the proposed use.

RECOMMENDATION
The Planning Commission recommends that the City Council approve the development stage PUD
amendment conditioned upon compliance with the planning report prepared by Associate Planner
Kris Jenson dated October 26, 2022.
