City of Lakeville Planning Department Memorandum To: Planning Commission From: Frank Dempsey, Associate Planner Date: November 9, 2022 Subject: Packet Material for the November 17, 2022 Planning Commission Meeting Agenda Item: Cedar Hills 4th Addition preliminary plat, final plat, and conditional use permit BACKGROUND Applications have been submitted by representatives of US Home Corporation for the preliminary plat and final plat of Cedar Hills 4th Addition (dba Lennar) to modify the 1.81 acre Outlot C of the preliminary plat of Cedar Hills, which is also Outlot C of Cedar Hills 3rd Addition, and a conditional use permit application and plans to allow the construction of a homeowner association (HOA) amenity (community) building and other recreational amenities on a lot within the neighborhood. The preliminary plat proposes to remove three detached townhome lots from undeveloped Outlot C previous preliminary plat and modify Outlot C as one lot for the amenity building and related site improvements. The Cedar Hills 4th Addition preliminary and final plat are located south of 200th Street (CR 64), east of Cedar Avenue (CSAH 23), and west of the city boundary with Farmington. The Cedar Hills preliminary plat was approved by the City Council on April 6, 2020. Because the change in the planned development of Outlot C proposes minimal impact on the grading and utility plans, an updated Engineering memo has not been prepared. Building Elevation and Floor Plans PLANNING A NALYSIS The Cedar Hills 4th Addition preliminary and final plat area is zoned RM-1, Medium Density Residential District. Zoning Ordinance Section 11-58-9.D allows private recreational buildings and neighborhood community centers subject to approval of a conditional use permit. The property will include an 1,187 square foot amenity building, pickleball courts, bocce ball courts, gazebo, pergola and fire pit with seating area as well as common open space. A 20 vehicle parking space will be constructed with driveway access from Gallifrey Avenue. PRELIMINARY AND FINAL PLAT Density/Average Lot Size. The proposed Cedar Hills 4th Addition preliminary plat will reduce the total number of detached townhome lots from 205 to 202 north of 202nd Street. The approved preliminary plat includes 205 detached townhome units. The overall development includes a gross density of 2.16 units per acre and a net density of 3.11 units per acre excluding arterial roadway Cedar Avenue (CSAH 23), wetlands, and stormwater management basins. The proposed amenity lot construction does not preclude the option for the developer to preliminary and final plat the additional three detached townhome lots within the Cedar Hills development in the future subject to Zoning Ordinance requirements. CONDITIONAL USE PERMIT AND SITE PLAN The plans submitted for the amenity building include an overall site plan, grading, drainage and utility plan, and landscaping plan. Given the limited scope of the proposed construction, the Engineering Division will review the grading, drainage, and utility plan at the time of building permit review. Setbacks. The Zoning Ordinance requires that all private recreation buildings be set back double that required by the zoning district but not more than 30 feet. The proposed building setbacks are 90 feet+ (east), 90+ feet (north) 100+ feet (south), and 175 + feet (west). Pedestrian Access. Private five foot wide concrete sidewalks will be constructed on the property that will connect the site and the private building to the public sidewalks on Gallifrey 3 Way, Gamma Lane, and Gambit Pass. The sidewalk within Gambit Pass right of way will require approval of a private maintenance agreement as a condition of preliminary and final plat approval. Building. The building will be 1,187 square feet in area and 15 feet tall and will be grey in shade/color. The building will constructed with a stone wainscot and columns and LP SmartSide lap and batten/boarding siding, glass windows, and asphalt shingle roof consistent with the residential buildings in the neighborhood. Landscaping. The proposed landscaping will provide screening of the property from nearby residential properties across Gallifrey Way, Gambit Pass, and Gamma Lane. No rear yards abut the proposed amenity lot. Landscaping for the property includes 82 trees which include mixes of various deciduous, evergreen, and ornamental trees. All proposed planting materials comply with Zoning Ordinance requirements for size and height. A two foot tall retaining wall is proposed on the north side of the private sidewalk abutting the bocce ball courts. Lighting. The site plan does not indicate pole lighting on the property. Building mounted security light is proposed on the north building wall. No other lighting is shown on the site or on the building. All lighting must be downcast and may not shine onto adjacent properties. Lennar has constructed similar private pools and buildings in the Summerlyn development north of 194th Street between Holyoke Avenue and Dodd Boulevard, the Prairie Lakes development north of 185th Street and west of Interstate 35 on Lake Forest Drive at Kingsway Path, and in The Greenway (Trevar) development west of Ipava Avenue on Ireton Way, north of Inndale Drive. RECOMMENDATION Planning Department staff recommends approval of the Cedar Hills 4th Addition preliminary plat and conditional use permit subject to the following stipulations: 1. An established homeowner’s association shall maintain ownership and maintenance of the Lot 1, Block 1, Cedar Hills 4th Addition including the amenities and improvements on the property. 2. A private sidewalk maintenance agreement shall be submitted to allow the private sidewalk within street right-of-way. 3. A landscape security shall be submitted in accordance with the materials and installation costs based on the approved landscape plan. The Planning Commission conducted a public hearing on the proposed conditional use permit preceded by published and mailed notice. The applicant was present and the Planning Commission heard testimony from all interested persons wishing to speak. FINDINGS OF FACT 1. The property is zoned RM-1, Medium Density Residential District. 2. The property is located in Planning District No. 5 and is guided as Low/Medium Density Residential in the Comprehensive Land Use Plan. 3. The legal description of the property is: Lot 1, Block 1, Cedar Hills 4th Addition 4. Section 11-4-3E of the City of Lakeville Zoning Ordinance provides that a conditional use permit may not be issued unless certain criteria are satisfied. The criteria and our findings regarding them are: a) The proposed action has been considered in relation to the specific policies and provisions of and has been found to be consistent with the Official City Comprehensive Plan. The proposed private recreation facility is consistent with the policies and provisions of Planning District 5 of the Comprehensive Land Use Plan. The proposed recreation facility will be complementary to the Cedar Hills development and will meet the recreational needs of its residents. 2 b) The proposed use is or will be compatible with future land uses of the area. The proposed private recreation facility is compatible with existing and proposed land uses in the Cedar Hills development given compliance with the approved plans and the stipulations of the conditional use permit. c) The proposed use conforms with all performance standards contained in the Zoning Ordinance and the City Code. The private recreation facility will conform to all performance standards set forth in the Zoning Ordinance given compliance with the approved conditional use permit. d) The proposed use can be accommodated with existing public services and will not overburden the City’s service capacity. The private recreation facility will be served with existing public services. e) Traffic generation by the proposed use is within capabilities of streets serving the property. Traffic generation will not significantly increase due to the private recreation facility. Traffic can be accommodated by the proposed parking lot and existing streets serving the subject property. Private and public sidewalk improvements will allow pedestrian access to the main entrance of the private recreation building. 5.
