Item: Comprehensive Plan amendment to reguide industrial land from outside the MUSA to within the current 2030 MUSA boundary
BACKGROUND The City of Lakeville annexed the Ruddle and Adelmann properties in 2021 and each was approved for a comprehensive land use amendment in August 2021 to establish the land use as Warehouse/Light Industrial. The City of Lakeville now wishes to establish both properties to be included in the MUSA boundary. The proposed amendment is to re-guide approximately 207 acres (Ruddle and Adelmann properties) of land from outside the MUSA to within the current 2030 MUSA boundary. The parcels are shown on the attached exhibits. At this time the City has not received an application for development of the parcels.

PLANNING ANALYSIS
COMPREHENSIVE PLAN AMENDMENT During the Metropolitan Council’s review of the Alternative Urban Areawide Review (AUAR) for the Ruddle property it was brought to staff’s attention that when the land use amendment was submitted in 2021, the request did not include an expansion of the MUSA. An AUAR is also underway for the Adelmann property. Therefore, this request is to re-guide the Adelmann property (approximately 116 acres) and Ruddle property (approximately 91 acres) from outside the MUSA to within the current 2030 MUSA boundary. The Adelmann property is located east of Cedar Avenue

(CSAH 23) and north of 225th Street. The Ruddle property is located west of Dodd Boulevard (CSAH 9) and north of 225th Street. As a part of the Metropolitan Council’s Comprehensive Plan Amendment process, notification of the proposed comprehensive plan amendment was sent on November 3, 2022 to adjacent and affected jurisdictions. At this time, six of the 10 adjacent/affected jurisdictions have responded, and all indicated that they have no comment about the Comprehensive Plan amendment. An amendment to the Comprehensive Plan for the above-referenced action is required and will be submitted to the Metropolitan Council for their approval following an action by the City Council to approve the amendment. Findings of Fact for the Comprehensive Plan amendments are attached.
RECOMMENDATION Planning Department staff recommends approval of the Adelmann and Ruddle property Comprehensive Plan amendment.

ADELMANN AND RUDDLE PROPERTY COMPREHENSIVE PLAN
AMENDMENT
FINDINGS OF FACT AND RECOMMENDATION On December 1, 2022, the Lakeville Planning Commission met at its regularly scheduled meeting to consider an application to amend the 2040 Comprehensive Plan to re-guide the Adelmann and Ruddle properties from outside the MUSA to within the current 2030 MUSA boundary. The Planning Commission conducted a public hearing on the proposed amendments preceded by published and mailed notice. The Planning Commission heard testimony from all interested persons wishing to speak. FINDINGS OF FACT 1. The Adelmann and Ruddle properties were annexed in 2021. The properties were re-guided to Warehouse/Light Industrial on August 16, 2021. 2. The properties were not included in the 2030 MUSA boundary when the land use designation was approved in 2021. 3. Legal description of the properties is attached in Exhibit A. 4. The City is requesting to amend the 2040 Comprehensive Plan to re-guide the Adelmann and Ruddle properties from outside the MUSA to within the current 2030 MUSA boundary. 5. The 2040 Lakeville Comprehensive Land Use Plan and Chapter 3 of the City of Lakeville Zoning Ordinance establish criteria by which the Planning Commission is to consider the applications. The criteria and our findings regarding them are:
a. The proposed action has been considered in relation to the specific policies and
provisions of and has been found to be consistent with the official City
Comprehensive Plan.
Finding: Each site’s location, adjacent to existing industrial development, supports the
change to the 2040 Comprehensive Plan MUSA boundary.
b. The proposed use is or will be compatible with present and future land uses of
the area.
Finding: The subject sites are compatible with existing or proposed industrial land uses.
The properties were re-guided to Warehouse/Light Industrial in 2021.
c. The proposed use conforms to all performance standards contained in the
Zoning Ordinance and the City Code.
Finding: Any proposed development for the sites will need to comply with applicable
provisions of the Zoning Ordinance, Subdivision Ordinance and City Code.

d. The proposed use can be accommodated with existing public services and will
not overburden the City’s service capacity.
Finding: The subject sites are able to be served by nearby utilities located within
adjacent parcels.
e. Traffic generated by the proposed use is within capabilities of streets serving
the property.
Finding: The subject sites have access to public streets as evaluated when the land use
re-guiding was approved in 2021. Access to each site will be reviewed in conjunction
with development plans for each individual site and may require additional upgrades. 6. The report dated November 22, 2022 prepared by Tina Goodroad, Community Development Director is incorporated herein.
RECOMMENDATION The Planning Commission recommends that the City Council approve the Comprehensive Plan Amendment conditioned upon compliance with the November 22, 2022 Planning Report prepared by Tina Goodroad, Community Development Director.
