PLANNING COMMISSION MEETING MINUTES
December 1, 2022 Chair Witte called the meeting to order at 6:00 p.m. in the Council Chambers at City Hall. The Pledge of Allegiance to the flag was given.
Members Present: Chair Jeff Witte, Karl Drotning, Pat Kaluza, Brooks Lillehei, Jason Swenson, Christine Zimmer
Members Absent: Vice Chair Jenna Majorowicz, Patty Zuzek, Ex-Officio Melissa Field
Staff Present: Daryl Morey, Planning Director; Kris Jenson, Associate Planner; Lucas Ritchie, City Engineer; Tina Morrow, Recording Secretary
3. Approval of the Meeting Minutes
The November 17, 2022 Planning Commission meeting minutes were approved as presented.
4. Announcements
Mr. Morey stated that if none of the items at tonight’s meeting are tabled, the December 15, 2022 Planning Commission meeting will be cancelled.
5. Affinity at Lakeville Chair Witte opened the public hearing to consider the application of Affinity at Lakeville, LLC. for a conditional use permit for a multiple family use in the M-2, Mixed Use Cedar Corridor District, located east of Cedar Avenue (CSAH 23), south of 179th Street (future CSAH 9), and west of Glacier Way. Andrew Bernard (via Teams), from Inland Group presented a brief overview of the project. Associate Planner Kris Jenson presented the planning report. Ms. Jenson stated that the applicant has submitted a conditional use permit application for a 174-unit age-restricted apartment building. Ms. Jenson reviewed the performance standards for a multiple family building in the M-2 District, which are outlined in the November 22, 2022 planning report. Planning Department staff recommends approval of the Affinity of Lakeville conditional use permit, subject to the eight stipulations listed in the November 22, 2022 planning report, and approval of the Findings of Fact dated December 1, 2022. Chair Witte opened the hearing to the public for comment.

Steve Devney - 5810 212 Street W, Farmington, MN, stated he is one of the owners of this
property and he thinks this project would be a good addition to the community.
Motion was made by Zimmer, seconded by Kaluza to close the public hearing at 6:14p.m.
Voice vote was taken on the motion. Ayes – unanimous.
Chair Witte asked for comments from the Planning Commission. Discussion points included:
• Commissioner Zimmer asked about the proposed main level garage design instead of an underground design. Mr. Bernard stated it was more cost effective to do the enclosed parking at-grade.
• Commission Swenson made a positive comment regarding the sidewalk connections on the site.
Motion was made by Lillehei, seconded by Drotning to recommend to City Council approval of the Affinity at Lakeville conditional use permit subject to the following stipulations, and approval of the Findings of Fact dated December 1, 2022: 1. The recommendations listed in the November 9, 2022 engineering report. 2. Snow is required to be removed from the site if it cannot be accommodated on the site outside of parking spaces. 3. A zoning permit must be issued for the proposed fence around the dog walk area. 4. A trail connection to the trail along the west side of Cedar Avenue (CSAH 23) must be constructed with the development of the site. 5. A zoning permit must be issued prior to the garden shed being placed on the site. The exterior materials of the shed must be compatible in design and color to the Affinity apartment building. 6. A sign permit will be required prior to the installation of any signs on the site. 7. A security for landscaping must be submitted at the time the property is final platted. 8. Prior to City Council consideration, buffer landscaping should be added to the north and east sides of the utility pad for additional screening.

6. City of Lakeville Chair Witte opened the public hearing to consider the Comprehensive Plan amendment to reguide approximately 116 acres (Adelmann property) and 91 acres (Ruddle property) of land from outside the MUSA to within the current 2030 MUSA boundary. Associate Planner Kris Jenson presented the planning report. Ms. Jenson stated the City of Lakeville annexed the Ruddle and Adelmann properties in 2021 and each was approved for a Comprehensive Plan amendment in August 2021 to establish the land use as Warehouse/Light Industrial. The City of Lakeville now wishes to establish both properties to be included in the 2030 MUSA boundary, and to update the City’s

employment forecasts for 2030 and 2040. At this time the City has not received an application for development of the parcels. Planning Department staff recommends approval of the Adelmann and Ruddle property Comprehensive Plan amendment and approval of the Findings of Fact dated December 1, 2022. Chair Witte opened the hearing to the public for comment.
There were no comments from the audience.
Motion was made by Kaluza, seconded by Swenson to close the public hearing at 6:20 p.m.
Voice vote was taken on the motion. Ayes – unanimous Chair Witte asked for comments from the Planning Commission. Discussion point included:
• Commission Drotning spoke positively regarding the updated employment projections
Motion was made by Lillehei, seconded Swenson to recommend to City Council approval of the Adelmann and Ruddle property Comprehensive Plan amendment and approval of the Findings of Fact dated December 1, 2022.
