Action Deadline: January 24, 2023 INTRODUCTION Christian Heritage Academy is requesting an interim use permit to allow the placement of a temporary classroom building adjacent to the existing school at 7320 175th Street. The temporary building will be just over 5,800 square feet and located southwest of the existing school building. The subject property is zoned PUD, Planned Unit Development with RM-1, Medium Density Residential District as the underlying zoning. Section 11-58-11.C of the Zoning Ordinance allows temporary classroom type structures for use by public or private institutions by interim use permit. EXHIBITS A. Aerial Photo Map B. Zoning Map C. Floor Plan 2 SITE ANALYSIS The applicant proposes a 5,804 square foot temporary classroom at the southwest wall of the existing gymnasium of the Christian Heritage Academy school. A CUP for the construction of Crossroads Church was approved by the City Council in 2003, a CUP for Christian Heritage Academy was approved in 2018, and a PUD amendment for The Pillars of Lakeville senior housing and a CUP for Four Square Preschool and Daycare was approved in 2020. Surrounding Land Uses and Zoning North – 175th Street, Crossroads East commercial development (PUD) South – Glasgow Avenue, Crossroads Senior Housing (PUD) East – Crossroads Church, parking lot (PUD) West – Crossroads Commercial development (PUD) Building Setbacks. The temporary classroom building meets all setback requirements of the RM-1 District. The temporary classroom structure is a single story and measures just under 14 feet in height. The building will not exceed the maximum building height of 35 feet allowed in the RM-1 District. Floor Plan. The floor plan for the temporary classroom building includes six (6) classrooms with a central corridor and an entrance/exit at either end of the corridor. Parking. Per the CUP approved in 2016, the school has a capacity of 105 students in Pre-K to 8th Grade, which required 15 parking spaces. The Zoning Ordinance requires one parking space per seven students, which equals 15 required parking spaces. Based on the approved uses on site and the required parking spaces for each of those uses, the site has an excess of 73 surface parking spaces, which is more than adequate to accommodate any additional parking demand from the temporary classrooms. The parking requirements will be formally evaluated at the time that the permanent addition to Christian Heritage Academy is proposed. Engineering Division Review. The Engineering Division has reviewed the submitted plans. The storm sewer line that runs under the proposed temporary classroom location is a private line. No other reviews or approvals are required at this time. Engineering Division staff will complete a full review of plans at the time an application is made for the permanent addition to the school building. 3 RECOMMENDATION Planning Department staff recommends approval of the Christian Heritage Academy interim use permit subject to the following stipulations: 1. The temporary classroom shall be placed on the site in accordance with the plans approved by the City Council. 2. The temporary classroom structure must be placed a minimum of 10 feet from the south property line with Crossroads Church. 3. A building permit is required prior to placing the temporary classroom structure. 4. The interim use per shall terminate upon the earlier of the following: 1) issuance of a certificate of occupancy for a permanent classroom addition to Christian Heritage Academy; 2) the discontinued use of the temporary classroom building for a period of six months; or 3) March 31, 2026. The Planning Commission conducted a public hearing on the proposed interim use permit preceded by published and mailed notice. The applicant was present and the Planning Commission heard testimony from all interested persons wishing to speak. FINDINGS OF FACT 1. The property is located in Planning District No. 5 of the 2040 Comprehensive Land Use Plan, which guides the property for public/quasi-public uses. 2. The property is zoned PUD, Planned Unit Development. 3. The legal description of the property is: Crossroads 1st Addition, CIC #649 Crossroads Community Association Unit #1 and interest attributable to common elements, Dakota County, Minnesota 4. Section 11-4-3E of the City of Lakeville Zoning Ordinance provides that an interim use permit may not be issued unless certain criteria are satisfied. The criteria and our findings regarding them are: a. The proposed action has been considered in relation to the specific policies and provisions of and has been found to be consistent with the official City Comprehensive Plan. Finding: The proposed temporary classroom for a private school use is consistent with the 2040 Comprehensive Land Use Plan. b. The proposed use is or will be compatible with present and future land uses of the area. Finding: Provided compliance with the interim use permit, the proposed temporary classroom will be compatible with existing and future land uses in the area. c. The proposed use conforms with all performance standards contained in the Zoning Ordinance. Finding: Provided compliance with the interim use permit, the proposed temporary classroom will conform with all performance standards contained in the Zoning Ordinance. 2 d. The proposed use can be accommodated with existing public services and will not overburden the City’s service capacity. Finding: The subject property lies within in the current MUSA. The expansion of the private school will have no impact on the City’s service capacity. e. Traffic generation by the proposed use is within capabilities of streets serving the property. Finding: Traffic generated by the proposed temporary classroom is within the capabilities of 175th Street and other public streets that serve the property. 5. The planning report dated December 28, 2022 prepared by Associate Planner Kris Jenson is incorporated herein. RECOMMENDATION The Planning Commission recommends that the City Council approve the interim use permit conditioned upon compliance with the planning report prepared by Associate Planner Kris Jenson dated December 28, 2022.
