PLANNING COMMISSION MEETING MINUTES
January 5, 2023 Vice Chair Majorowicz called the meeting to order at 6:00 p.m. in the Council Chambers at City Hall. The Pledge of Allegiance to the flag was given.

3. Approval of the Meeting Minutes
The December 1, 2022 Planning Commission meeting minutes were approved as presented.
4. Announcements
The following items were distributed to the Planning Commission at tonight’s meeting:
• January 4, 2023 Parks, Recreation and Natural Resources Committee meeting motion regarding the Estoria Lakeville preliminary plat.
5. Christian Heritage Academy Vice Chair Majorowicz opened the public hearing to consider the application of Christian Heritage Academy for an interim use permit to allow a temporary classroom structure for use by a private institution, located south of 175th Street and east of Glasgow Avenue. Joel Koski with Christian Heritage Academy presented a brief overview of the project. Associate Planner Kris Jenson presented the planning report. Ms. Jenson stated that the temporary building will be just over 5,800 square feet in area and will be located southwest of the existing school gymnasium building. The property is zoned PUD, Planned Unit Development with a base zoning of RM-1, Medium Density Residential District. The temporary classroom structure is a single story and measures just under 14 feet in height. The floor plan includes six classrooms with a central corridor and an entrance/exit at either end of the corridor. The temporary classroom structure will be in place until a permanent classroom addition is constructed, which is anticipated to occur within the next three years. Planning Department staff recommends approval of the Christian Heritage Academy interim use permit, subject to the four stipulations listed in the December 28, 2022, planning report, and approval of the Findings of Fact dated January 5, 2023.

Vice Chair Majorowicz opened the hearing to the public for comment.
There were no comments from the audience.
Motion was made by Kaluza, seconded by Drotning to close the public hearing at 6:06 p.m.
Voice vote was taken on the motion. Ayes – unanimous.
Vice Chair Majorowicz asked for comments from the Planning Commission. Discussion point included:
• Commission Drotning spoke positively regarding the temporary classrooms, noting that the local school districts have done this in the past. The interim building will have additional classrooms for multipurpose use.
Motion was made by Swenson, seconded by Kaluza to recommend to City Council approval of the Christian Heritage Academy interim use permit subject to the following stipulations, and approval of the Findings of Fact dated January 5, 2023: 1. The temporary classroom shall be placed on the site in accordance with the plans approved by the City Council. 2. The temporary classroom structure must be placed a minimum of 10 feet from the south property line with Crossroads Church. 3. A building permit is required prior to placing the temporary classroom structure. 4. The interim use per shall terminate upon the earlier of the following: 1) issuance of a certificate of occupancy for a permanent classroom addition to Christian Heritage Academy; 2) the discontinued use of the temporary classroom building for a period of six months; or 3) March 31, 2026.

6. Estoria Lakeville Vice Chair Majorowicz opened the public hearing to consider the application of Ebenezer for the following, located west of Ipava Avenue and north of 165th Street: 1. Preliminary plat of one lot to be known as Estoria Lakeville; 2. Conditional use permit to allow a multiple-family building to exceed 45 feet in height in the RH-2, Multiple Family Residential District, and 3. Vacation of drainage and utility easements. Josh Cowman from Estoria Cooperatives presented a brief overview of the request. Associate Planner Kris Jenson presented the planning report. Ms. Jenson stated the applicant has applied for a preliminary plat of one lot to be known as Estoria Lakeville which is proposed to be developed with an 89-unit senior co-op building. A conditional use permit to allow the proposed building to exceed 45 feet in height in the RH-2 District has been submitted as well as an application to vacate public drainage and utility

easements on one of the parent parcels. The property proposed to be platted is currently part of two larger parcels. The Estoria Lakeville preliminary plat consists of one lot on 4.01 acres and is located within the current MUSA. The proposed building is four stories, with a building height of 61 feet. Ms. Jenson stated that building height may exceed the established standard within an individual zoning district by conditional use permit, provided that the site can accommodate the increased intensity of use and that the front and side yard setbacks be increased by five feet for every 10 feet of building height over the district maximum. The request for the additional building height is primarily due to the peak roof over a few portions of the building. Due to the building having a height that is 16 feet above the 45-foot height limit of the RH-2 District, the building setbacks have been increased from 30 feet to 40 feet to accommodate the additional height. The Developer has stated that the peak roof was included in the building design to provide a more residential feel to the structure. Ms. Jenson outlined the exterior building materials, off street parking, exterior lighting and the underground parking garage which meet the requirements of the Zoning Ordinance. A mix of overstory and evergreen trees are proposed along the perimeter of the site that will help buffer the view from the single-family homes south of 165th Street to the Estoria Lakeville building.
Planning Department staff recommends approval of the Estoria Lakeville preliminary plat, conditional use permit and the drainage and utility easement vacation subject to the 8 stipulations listed in the December 28, 2022 planning report, and approval of the Findings of Fact dated January 5, 2023. Vice Chair Majorowicz opened the hearing to the public for comment.
Todd Raberge –16224 Jatos Circle. He is concerned about whether the drainage behind his
townhome will it be altered because of the Estoria Lakeville development.
Motion was made by Zimmer, seconded by Einck to close the public hearing at 6:22 p.m.
Voice vote was taken on the motion. Ayes – unanimous Vice Chair Majorowicz asked for comments from the Planning Commission. Discussion points included:
• The drainage swales between the adjacent Crystal Park townhome property and the proposed site were discussed. The outlet control structure was also discussed.
• The pond behind Mr. Raberge’s townhome is not being altered because of this project.
• Commissioner Zimmer asked about parking and the building height in relation to proposed grades and surrounding uses.

• There was a lengthy discussion regarding the building height and proposed site grades, especially to the west from the Crystal Park townhomes, and the overall comparison of other multiple family projects in the city with a similar building height.
• Proposed landscaping along the west side of the site as a buffer to the Crystal Park townhomes was also discussed.
• The proposed amenities for Estoria Lakeville were described.
Motion was made by Drotning, seconded Swenson to recommend to City Council approval of the Estoria Lakeville preliminary plat, conditional use permit and easement vacation subject to the following stipulations, and approval of the Findings of Fact dated January 5, 2023: 1. The recommendations listed in the December 28, 2022 engineering report. 2. Park dedication with be satisfied by a cash contribution to be paid with the final plat. 3. The parking space on the Hosanna Church property directly east of the sidewalk connection from Estoria shall be striped and signed as “No Parking.” 4. Snow is required to be removed from the site if it cannot be accommodated on the site outside of parking spaces. 5. A security must be submitted with the final plat to ensure the landscaping is completed per the approved plan. 6. A zoning permit must be issued for the proposed fences, including around the pickleball courts, garden, and the dog run. 7. A maintenance agreement for the sidewalk crossing property boundaries (to Hosanna Church parcel to the east of the development site) is required with the final plat. 8. Prior to City Council consideration of the preliminary plat, the tree preservation information must be shown in a table format with the required information on the civil plans.
