HomeMy WebLinkAboutItem 05 Ardmor VillageCity of Lakeville Planning Department Memorandum To: Planning Commission From: Kris Jenson, Associate Planner Date: February 22, 2023 Subject: Packet Material for the March 2, 2023 Planning Commission Meeting Agenda Item: Ardmor Manufactured Home Park Conditional Use Permit Action Deadline: March 28, 2023 BACKGROUND Independence Engineering, on behalf of Ardmor MHC LLC, has submitted a conditional use permit application to add six manufactured home units in the RSMH, Single Family Manufactured Home Park District. Ardmor Manufactured Home Park is located east of Cedar Avenue (CSAH 23) and north of Lakeville Boulevard (CSAH 50). The Ardmor CUP plans have been distributed to Engineering Division staff for review. EXHIBITS A. Aerial Location Map B. Zoning Map C. Overall Existing Conditions D. Demolition Plan E. Site Plan F. Grading and Utility Plan G. Project Narrative PLANNING A NALYSIS Existing Conditions. The property is currently developed as a manufactured home park with approximately 340 units. The park was constructed in the early 1970s. The area proposed for the expansion was previously used for RV and boat parking and was surrounded by a wooden fence and gate. The site also includes a mailbox station, across 2 from Caesar Street, that will remain, as well as some off-street parking spaces that will be removed. The existing wood fence will remain along much of Shakespeare Boulevard and will be repaired as needed. The remainder of the fence along Brutus Drive will be removed along with the paved and gravel parking areas and an existing dirt/bituminous/concrete pile within the fenced area. Grass will be established in the areas not covered by concrete pads and parking sites. (Exhibit D) Proposed Units. Ardmor MHP proposes to add six homesites to the existing park, in an area that was previously used as RV parking and storage. Each of the proposed sites includes a 16’ by 66’ concrete pad, a paved off-street parking pad to accommodate two passenger vehicles, and a paved walkway from the parking area to the pad site. (Exhibit E) Adjacent Land Uses. Adjacent land uses and zoning are as follows: North – Single-family homes (RS-3) East – Undeveloped land (City of Farmington) South – Undeveloped land (C-2), East Branch of South Creek (P/OS) West – Cedar Avenue (CSAH 23), Detached townhomes (RST-2) Lot Setbacks. Section 11-55-15.B.8 establishes individual manufactured home lot setbacks based on when the park was created. For Ardmor MHP, all manufactured homes must be a minimum of 20 feet from a street surface and a minimum of 20 feet from an adjacent manufactured home. The proposed units all meet these setback requirements. MUSA. The Ardmor MHP is located within the current MUSA. GENERAL P ERFORMANCE STANDARDS A conditional use permit application has been submitted to add units to a manufactured home park in the RSMH District. Section 11-4-7 lists the following performance standards for conditional use permits: A. The use and the site in question shall be served by a street of sufficient capacity to accommodate the type and volume of traffic which would be generated and adequate right of way shall be provided. Brutus Drive and Shakespeare Boulevard are private streets of sufficient capacity to serve the site, including vehicle trips generated by six additional homesites. B. The site design for access and parking shall minimize internal as well as external traffic conflicts and shall be in compliance with chapter 19 of the Zoning Ordinance. Access to the sites will be from Brutus Drive. No vehicle access to the homesites will be from Shakespeare Boulevard, which serves as a private collector road within the park. C. If applicable, a pedestrian circulation system shall be clearly defined and appropriate provisions made to protect such areas from encroachment by parked or moving vehicles. 3 Not applicable. D. Adequate off-street parking and off-street loading shall be provided in compliance with chapters 19 and 20 of the Zoning Ordinance. Two paved, off-street parking spaces are being provided for each of the new homesites. This complies with Section 11-19-13, which requires two off-street spaces per single family home. E. Loading areas and drive-up facilities shall be positioned so as to minimize internal site access problems and maneuvering conflicts, to avoid visual or noise impacts on any "adjacent" residential use or district, and provided in compliance with chapter 20 of this title. Not applicable. F. Whenever a nonresidential use "is adjacent to" a residential use or district, a buffer area with screening and landscaping shall be provided in compliance with chapter 21 of this title. Not applicable. G. General site screening and landscaping shall be provided in compliance with chapter 21 of this title. There are some existing trees within the expansion area, mostly along the south property line, that will remain on site. No additional plantings are proposed at this time. H. All exterior lighting shall be so directed so as not to cast glare toward or onto the public right of way or neighboring residential uses or districts, and shall be in compliance with section 11-16-17 of the Zoning Ordinance. No additional lighting is proposed to be added to the site. I. Potential exterior noise generated by the use shall be identified and mitigation measures as may be necessary shall be imposed to ensure compliance with section 11-16-25 of the Zoning Ordinance. Not applicable. J. The site drainage system shall be subject to the review and approval of the city engineer. The Engineering Division has reviewed and determined that no changes to the site drainage system are required. K. The architectural appearance and functional design of the building and site shall not be so dissimilar to the existing or potential buildings and area so as to cause a blighting influence. All sides of the principal and accessory structures are to have essentially the same or coordinated, harmonious exterior finish materials and treatment. Not applicable. 4 L. Provisions shall be made for daily litter control, an interior location for recycling, and trash handling and storage or an outdoor, enclosed receptacle area shall be provided in compliance with section 11-18-11 of the Zoning Ordinance. Each homesite is responsible for their own trash and recycling removal. M. All signs and informational or visual communication devices shall be in compliance with chapter 23 of the Zoning Ordinance. No additional signage is proposed to be added with these units. N. The use and site shall be in compliance with any federal, state or county law or regulation that is applicable and any related permits shall be obtained and documented to the city. Not applicable. O. Any applicable business licenses mandated by this code are approved and obtained. Not applicable. P. The hours of operation may be restricted when there is judged to be an incompatibility with a residential use or district. Not applicable Q. The use complies with all applicable performance standards of the zoning district in which it is located and where applicable, any nonconformities shall be eliminated. Not applicable. R. All additional conditions pertaining to a specific site are subject to change when the council, upon investigation in relation to a formal request, finds that the general welfare and public betterment can be served as well or better by modifying or expanding the conditions set forth herein. Not applicable. RECOMMENDATION Planning Department staff recommends approval of the Ardmor MHP conditional use permit, subject to the following stipulations: 1. That the site be developed in accordance with the plans approved by the City Council. Findings of Fact for approval of the conditional use permit request are attached. The community is located in the RSMH Single Family Manufactured Home Park District, at the main address of 20990 Cedar Avenue. The two parcels that cover the property are listed as 22-02700-51-010 and 22-02800-76-010. The only area for proposed development at this time is the current RV storage lot located at the southwest corner of the community. Existing Conditions The site for development (the existing RV parking area) is currently mostly vacant with some existing impervious pavement and fencing. The site does include a 40 ft utility easement off of Shakespeare Boulevard, though it does not interfere with the area for proposed new mobile homes. Utilities run along the frontage of the site off of Brutus Drive, including underground telephone, gas and electric lines. The area for development is bounded to the south by the park’s property line and trees, and bounded by Shakespeare Boulevard to the west and Brutus Drive to the east, with the two roads joining at the north to create a triangular lot that has been used as an RV and boat storage lot. Shakespeare Boulevard is the community’s main passageway, and its access point to Cedar Avenue. Brutus Drive is a residential circle that continues east beyond the subject vacant lot. All utilities are available to be used. The site in the area for development currently drains from west to east towards Brutus Drive, and from north to south towards the bottom of Brutus Drive where it then continues east. Drainage appears to continue east along Brutus Drive’s sloped curb and gutter, and there are storm inlets around the bend at the southeast part of Brutus Drive. Proposed Conditions Lakeshore Management proposes to add up to six new mobile home units to the triangular area between Shakespeare Boulevard and Brutus Drive, each lot complete with paved private off-street parking for two cars and a 3 ft wide walkway from the driveway to the home’s entrance. The existing paved area where the RVs and other recreational vehicles currently sit will be removed and replaced with grass in all areas applicable. The two existing off-street parking areas will also be removed and replaced with grass and new curbing and/or new private driveway as noted on the site plans. The general flow pattern of this area will remain the same, with consideration of the new impervious cover, for the proposed condition. Soil Types The soils information for the site can be found on the USDA Natural Resources Conservation Service’s Web Soil Survey, located at http://websoilsurvey.nrcs.usda.gov. The single soil type in the site’s area for development is indicated as Udorthents, wet (1027). This is the same soil type as is present in the rest of the Ardmor Village community. EXHIBIT G 1 CITY OF LAKEVILLE DAKOTA COUNTY, MINNESOTA ARDMOR MANUFACTURED HOME PARK CONDITIONAL USE PERMIT FINDINGS OF FACT AND RECOMMENDATION On March 2, 2023 the Lakeville Planning Commission met at its regularly scheduled meeting to consider the request of Independence Engineering, on behalf of Ardmor MHC LLC, for a conditional use permit for a manufactured home park use in the RSMH, Single Family Manufactured Home Park District. The Planning Commission conducted a public hearing on the proposed conditional use permit preceded by published and mailed notice. The applicant was present and the Planning Commission heard testimony from all interested persons wishing to speak. FINDINGS OF FACT 1. The subject property is located in Comprehensive Planning District 5, which guides the property for Manufactured Housing. 2. The subject site is zoned RSMH, Single Family Manufactured Home Park District. 3. The legal description of the property is attached in Exhibit A. 4. Chapter 4 of the City of Lakeville Zoning Ordinance provides that a conditional use permit may not be issued unless certain criteria are satisfied. The criteria and our findings regarding them are: a. The proposed action has been considered in relation to the specific policies and provisions of and has been found to be consistent with the official City Comprehensive Plan. Finding: The six additional manufactured home pad sites are consistent with the guided manufactured housing use of the property. b. The proposed use is or will be compatible with future land uses of the area. Finding: The six additional manufactured home pad sites are compatible with the existing and future land uses in the area. c. The proposed use conforms with all performance standards contained in the Zoning Ordinance and the City Code.
