The subject property is zoned P-OS, Public and Open Space District. Last fall the City Council approved a text amendment to the P-OS district to allow retail sale of food and beverages within Antlers Park as a conditional use. The city has also entered into a concession agreement with Lakeville Brewing Co, LLC for seasonal operation of the concession stand in Antlers Park. Findings of Fact The applicant proposes using two shipping containers, placed back-to-back, as the concession structure. Surrounding Land Uses and Zoning North – RS-3, existing single family and RM-1, vacant 2 South – RS-3, existing single family East – OP, vacant West – Lake Marion SITE ANALYSIS Site Plan. Antlers Park will be reconstructed this summer in conjunction with the improvements authorized by the successful park bond referendum. The concession structure is proposed to be located adjacent to the new plaza area just west of the expanded parking lot. The structure will be located on the north side of the plaza with a patio adjacent to the west. The patio will feature a fence around the perimeter. South of the structure is the plaza featuring planters and seating area. The new park pavilion will be located south of the plaza. Landscape screening is proposed along the north side of the structure. Three site plans are provided, one that is an overall plan for the park reconstruction and two enlargements with the location notes on the third plan. Parking. As part of the park reconstruction, parking for Antlers Park will be expanded to accommodate uses, including the concession sales, within the park. CONDITIONAL USE PERMIT Use. Retail food and beverage sales in Antlers Park is subject to the requirements within the P-OS Pubic and Open Space District. Section 11-97-7 of the Zoning Ordinance establishes performance standards as follows: License. Lakeville Brewing Co, LLC will be required to obtain required food and liquor licenses prior to sales. Season/Hours. Section 11-97-7.H. 2 and 3 of the Zoning Ordinance limits the operating season to May 15th through September 15th unless extended by the City Council. Hours of operation are limited to 11:00 a.m. to 9:00 p.m. unless extended by the City Council as a part of the CUP. Exterior Building Materials. The primary exterior material includes fiber cement siding “skin” attached to the container. The siding will be painted white to match the predominant color of the pavilion. Order/pick-up windows are provided on the south side facing the plaza and on the west side facing the patio. The elevation plan includes examples of the structure with these windows open and closed. The black areas of the elevation are exposed container material painted black. White and black are the only two colors that will be used for the exterior surfaces. A shed, which is a smaller shipping container with the same fiber cement siding skin, is proposed on the back side of the structure to store oil recovery and related materials that cannot be stored in the concession structure. Section 11-97-7.H.4 of the Zoning Ordinance requires that the exterior building finish be of at least 65% grade A, B or C and 35% grade D, E or F. The elevations meet this by providing 80% grade C material consisting of the Fiber Cement siding. The remaining 20% includes painted exposed metal of the shipping container, which is a grade E material. The fiber cement siding and other design treatments and colors are 3 complementary to the new Antlers Park Pavilion. The proposed materials meet the requirements of the Zoning Ordinance. Signs. Section 11-97-7.H.5 of the Zoning Ordinance allows one wall sign per structure not to each exceed 50 square feet each. The applicant will be required to obtain a sign permit consistent with Section 23 of the Zoning Ordinance. Patio. Section 11-97-7.H.6 of the Zoning Ordinance requires the patio to be in compliance with Section 3-1-8-14.C of the City Code. This will be verified by staff with the liquor license submittal. RECOMMENDATION Planning Department staff recommends approval of the Lakeville Brewing Co, LLC conditional use permit, subject to the following stipulations: 1. The hours of operation shall not exceed 11:00 am to 9:00 pm, seven days a week and the operating season is established between May 15th through September 15th unless extended by the City Council. 2. Lakeville Brewing Co, LLC shall obtain all required food and liquor licenses prior to any sale. 3. A sign permit must be issued prior to installation of any signs. The Planning Commission conducted a public hearing on the conditional use permit application preceded by published and mailed notice. The applicant was present and the Planning Commission heard testimony from all interested persons wishing to speak. FINDINGS OF FACT 1. The subject property is located in Comprehensive Planning District 4, which guides the property as Parks. 2. The subject site is zoned P-OS, Public and Open Space District. 3. Chapter 4 of the City of Lakeville Zoning Ordinance provides that a conditional use permit may not be issued unless certain criteria are satisfied. The criteria and our findings regarding them are: a. The proposed action has been considered in relation to the specific policies and provisions of and has been found to be consistent with the official City Comprehensive Plan. Finding: The proposed retail and beverage concession sales, as an amenity of Antlers Park, is consistent with the guided Park use of the property. b. The proposed use is or will be compatible with present and future land uses of the area. Finding: The proposed retail and beverage concession sales use will be compatible with the existing and future land uses in the area. c. The proposed use conforms to all performance standards contained in the Zoning Ordinance and the City Code. Provided compliance with the stipulations of the conditional use permit, the proposed use will conform to all performance standards contained in the Zoning Ordinance and the City Code. d. The proposed use can be accommodated with existing public services and will not overburden the City’s service capacity. Traffic generated by the proposed use is within capabilities of streets serving the property. Finding: The streets serving this site are adequate to accommodate traffic from the proposed use. 5.
