PLANNING COMMISSION MEETING MINUTES
February 16, 2023 Chair Majorowicz called the meeting to order at 6:00 p.m. in the Council Chambers at City Hall. The Pledge of Allegiance to the flag was given.

3. Approval of the Meeting Minutes
The January 19, 2023 Planning Commission meeting minutes and the January 19, 2023 Planning Commission work session minutes were approved as presented.

5. Timbercrest at Lakeville 10th Addition Chair Majorowicz opened the public hearing to consider the application of NVA-Pet Suites for the following, located north of 185th Street (CSAH 60) and east of Orchard Trail: 1. Preliminary plat of one lot to be known as Timbercrest at Lakeville 10th Addition; 2. Planned unit development amendment to allow an animal kennel in the Timbercrest at Lakeville PUD; and 3. Vacation of public drainage and utility easements. Megan Rogers with Larkin Hoffman on behalf of NVA-Pet Suites presented an overview of the project explaining in detail the specifics of this proposed project. Associate Planner Frank Dempsey presented the planning report. Mr. Dempsey stated the applicant has submitted applications for a preliminary plat, PUD amendment, and easement vacation for one commercial lot totaling 2.03 acres within the Timbercrest at Lakeville PUD. The amendment to the Timbercrest planned unit development would allow the animal kennel use on the commercial guided property as part of PUD development stage plans. The subject property is zoned PUD, Planned Unit Development District and guided for commercial use by the 2040 Comprehensive Land Use Plan. Mr. Dempsey stated the Timbercrest at Lakeville 10th Addition abuts 185th Street and will have shared access at Orchard Trail via a shared driveway with the Speedway convenience store to the west.

Fifty-five (55) total parking spaces are identified on site for the 11,000 square foot building. The proposed building requires 50 parking spaces as a commercial use in the underlying C-3 District. The applicant has requested a deferment of 22 parking spaces due to the anticipated low traffic volume of the proposed animal kennel use. The deferred parking is proposed to be located in the area of the outdoor dog exercise area and stormwater basin on the north side of the building. The Zoning Ordinance allows a deferment of up to 50% of the required parking spaces. Planning Department staff supports the parking deferment. Mr. Dempsey stated the landscape plan includes a combination of overstory trees and tall growing conifer shrubs. Staff recommends additional landscape screening as a visual and buffer screening along the north property line. Planning Department staff recommends approval of the Timbercrest at Lakeville 10th Addition preliminary plat, PUD amendment and easement vacation subject to the seventeen stipulations listed in the February 8, 2023 planning report and approval of the Findings of Fact dated February 16, 2023. Chair Majorowicz opened the hearing to the public for comment.

Mr. Bergarde is an owner of the Northlake Lofts apartments, located north of the proposed
project and believes this project will benefit their apartment residents.
Motion was made by Drotning, seconded by Lillehei to close the public hearing at 6:37 p.m.
Voice vote was taken on the motion.
Ayes – unanimous.
Chair Majorowicz asked for comments from the Planning Commission. Discussion points included:
• Asked if Northlake Lofts allows pets within their building. Mr. Bergarde responded that they do allow pets.
• Commissioner Drotning commented positively on the detailed presentation from Ms. Rogers and felt it was very helpful.
• The applicant’s engineer stated the outdoor play area will have heat tape installed to help prevent freezing of animal waste on the north side of the building. The concrete will also be covered with a special turf.
• Asked about the freestanding sign location
• Commented that additional landscaping along the north property line will reduce noise to the apartment building.
• Commissioner Zimmer asked who owns and maintains the retaining wall? Mr. Dempsey stated it will be privately owned and maintained.

Motion was made by Drotning, seconded by Zuzek to recommend to City Council approval of the NVA-Pet Suites preliminary plat, PUD amendment and easement vacation, and adoption of the findings of fact dated February 16, 2023, subject to the following stipulations: 1. Implementation of the recommendations listed in the February 8, 2023 engineering report. 2. The site and building for Lot 1, Block 1 shall be developed in compliance with the plans approved by the City Council and Zoning Ordinance requirements. 3. The landscape plan shall be amended to include a combination of overstory trees and tall growing conifer shrubs along the north property line as visual and buffer screening. The site plan and landscape plan shall be amended prior to City Council consideration of the preliminary and final plat. 4. All landscaped areas adjacent to the building and parking lot shall be irrigated. Trees and shrubs shall not be planted in street right-of-way. 5. The developer shall submit a $40,000 security to guarantee installation of the approved landscaping at the time of final plat consideration. 6. All signs shall comply with the Zoning Ordinance requirements for the C-3 District or as allowed by the Timbercrest PUD amendment/development stage PUD. A sign permit shall be issued by the Planning Department prior to the installation of any signs. 7. Snow storage shall not take place in required parking spaces. 8. Site lighting shall not exceed one foot candle at the property line adjacent to public right-of-way. All exterior light fixtures shall be down-cast design so as not to glare onto public right-of-way and the north property line. 9. The trash enclosure shall be constructed of materials consistent with the principal building and shall include a durable, maintenance free gate. 10. A Sewer Access Charge determination will be required from Metropolitan Council Environmental Services prior to issuance of a building permit. 11. A parking deferment agreement shall be required prior to approval of a building permit. A minimum of 28 parking spaces shall be provided. 12. The animal kennel operations and management shall at all times be in compliance with State of Minnesota Building Code requirements, Zoning Ordinance requirements and the Planned Unit Development Amendment. 13. Confirmation of a recorded private shared driveway easement over Lot 1, Block 1, Timbercrest at Lakeville 7th Addition benefiting Lot 1, Block 1, Timbercrest at Lakeville 10th Addition shall be submitted prior to final plat approval. 14. A shared maintenance agreement for the stormwater basin shall be submitted at the time of final plat approval. 15. Any roof-top and ground mounted mechanical units must be screened from view of any public street as required by the Zoning Ordinance.

16. A setback less than five hundred feet (500') from any Residential District is allowed with the Timbercrest at Lakeville 10th Addition PUD Amendment consistent with the development stage PUD plans approved by the City Council. 17. Two wall signs, one on the west elevation facing Orchard Trail and one on the south elevation facing 185th Street are allowed with the Timbercrest at Lakeville 10th Addition PUD Amendment.
