HomeMy WebLinkAbout03-16CITY OF LAKEVILLE PLANNING COMMISSION MEETING MINUTES March 16, 2023 Chair Majorowicz called the meeting to order at 6:00 p.m. in the Council Chambers at City Hall. The Pledge of Allegiance to the flag was given. Members Present: Chair Jenna Majorowicz, Vice Chair Christine Zimmer, Pat Kaluza, Brooks Lillehei, Jason Swenson Members Absent: Patty Zuzek, Karl Drotning Staff Present: Daryl Morey, Planning Director (via Teams); Tina Goodroad, Community Development Director; Kris Jenson, Associate Planner; Alex Jordan, Assistant City Engineer; Daniel Licht, The Planning Company; Andrea McDowell Poehler, City Attorney; Tina Morrow, Recording Secretary. 3. Approval of the Meeting Minutes The March 2, 2023 Planning Commission meeting minutes were approved as presented. 4. Announcements The following items were distributed to the Planning Commission at tonight’s meeting: • March 15, 2023 Parks, Recreation and Natural Resources Committee meeting motion regarding the Ritter Meadows preliminary plat. Associate Planner Kris Jenson announced that this would have been Karl Drotning’s last Planning Commission meeting. She gave a brief overview of his term on the Planning Commission of the City of Lakeville and thanked him for his service of 25 years, including six years as Chair. 5. Ritter Meadows Chair Majorowicz opened the public hearing to consider the application of TEG Land Holdings, LLC (Twin Cities Land Development), for the following, located north of 205th Street and west of I-35: 1. Preliminary plat of 30 single family lots, 99 detached townhome (villa) lots, and 127 attached townhome units to be known as Ritter Meadows; and 2. Vacation of a roadway easement. Planning Commission Meeting Minutes, March 16, 2023 Page 2 Ben Schmidt with Twin Cities Land Development presented an overview of the project. Planning Consultant Daniel Licht from The Planning Company presented the planning report. Mr. Licht stated the applicant has submitted a preliminary plat application for seven undeveloped metes and bounds parcels totaling 298.93 acres. The Ritter Meadows development proposes 256 dwelling units consisting of 30 single family lots, 99 detached townhomes, and 127 row townhomes located west of Keokuk Avenue and north of 205th Street. Mr. Licht stated the Planning Commission has some discretion in review of a preliminary plat application but must apply the land use regulations and criteria established by the Subdivision and Zoning ordinances. The proposed residential land uses west of Keokuk Avenue are consistent with the development guided by the 2040 Land Use Plan for the respective land use categories as outlined in the March 9 planning report. The preliminary plat includes a proposed plan for a buildout of the development in three phases which are outlined in the March 9, 2023 planning report. The proposed property complies with the lot requirements of the Zoning Ordinance for the respective zoning districts. Mr. Licht identified the proposed street accesses to 205th Street to be constructed with Phase 1: Keystone Avenue and Kristine Drive. He identified the future construction of Keokuk Avenue, a minor collector, at 205th Street consistent with the Transportation Plan. Mr. Licht stated that Outlot C is a proposed 2.84 acre neighborhood park. The size of this future neighborhood park has been reviewed by the Parks and Recreation Director and the Parks, Recreation and Natural Resources Committee, and is consistent in size with recently approved neighborhood parks in the Legacy and Summerlyn developments. He also explained the proposed sidewalks and trails, which are consistent with the Parks, Trails, and Open Space Plan for this area. Planning Department staff recommends approval of the Ritter Meadows preliminary plat and vacation of roadway easement subject to the 13 stipulations listed in the March 9, 2023 planning report. Chair Majorowicz opened the hearing to the public for comment. Scott Lucus, attorney from LeVander, Gillen and Miller, representing River City Asphalt Inc., which owns the property to the west of the proposed preliminary plat area. Mr. Lucus referenced the packet that was submitted to the City and Planning Commissioners on March Planning Commission Meeting Minutes, March 16, 2023 Page 3 6, 2023 and requested that this agenda item be tabled to allow time for his clients to receive clarification regarding the details indicated in the March 9, 2023 planning report. Mike Kettler from Sunde Engineering provided information on behalf of Mike Dunham and Richard Carron. He outlined the grading issue on the northwest corner of the site encroaching into the River City Asphalt property and highlighted groundwater and pond elevations on the site. Vernon Swing with SSTS Inc. addressed the traffic and transportation. He stated that the right of way mentioned in the March 9, 2023 planning report for Kristine Drive is not in compliance with City Code. The proposed development elevations and the 205th Street access spacing as it relates to the River City property were also mentioned. Mike Dunum, 11513 205th Street, commented on the difference in proposed grades compared to the adjacent properties. He also spoke about the spacing issue regarding his driveway from Kristine Drive. Richard Carron, 16618 Lynch Path, described his business background and living in Lakeville. He provided reasons why the proposed development of the property should not go forward as planned. Peter Thelen, 12119 Lucerne Trail, asked if there is a plan to connect the trail into the existing City trail on 205th Street. He is also concerned about the traffic on 205th Street. Cindy Thelen, 12119 Lucerne Trail, indicated that 205th Street is in poor condition and is a public safety concern. Motion was made by Zimmer, seconded by Swenson to close the public hearing at 7:31 p.m. Voice vote was taken on the motion. Ayes – unanimous. Chair Majorowicz asked for comments from the Planning Commission. Discussion points included: • The developer spoke on the grading issues for the site. He indicated the proposed grading into the River City Asphalt property can be eliminated if they do not reach an agreement with Mr. Carron. • Commissioner Zimmer asked about the retaining walls and asked if that will be part of the proposed easement on site. • Commissioner Swenson discussed the ground water and stormwater issues. • Assistant City Engineer Alex Jordan addressed the issues and questions raised by the neighboring property owners during the public hearing. Planning Commission Meeting Minutes, March 16, 2023 Page 4 • Commissioner Swenson asked about the 10-foot depth of the stormwater pond. Mr. Jordan stated the stormwater ponds meet design requirements. • Commissioner Lillehei thanked Chair Majorowicz on her flexibility and willingness to allow residents to discuss their concerns in detail. Mr. Lillehei extended his recognition for Karl Drotning serving 25 years on the Planning Commission and stated he was a mentor and leader to Planning Commissioners and City staff. He stated Mr. Drotning has had a positive impact on the history and future growth of Lakeville. • Planning Commissioner members expressed their appreciation for Mr. Drotning, and thanked him for his dedication and knowledge of Lakeville. Motion was made by Swenson, seconded by Lillehei to recommend to City Council approval of the Ritter Meadows preliminary plat and vacation of roadway easements subject to the following stipulations: 1. Street right-of-way dedication, sections construction plans, turn lane construction plans, and private drive construction plans shall be subject to review and approval of the City Engineer. 2. The preliminary plat shall be revised to include the proposed public right-of-way for Keokuk Avenue south of Kristine Drive within the area of Outlot D. 3. Trails: a. The developer shall be responsible for 100 percent of the cost of grading and restoration for trail construction. b. The developer shall be responsible for 5/8th of the cost of bituminous for construction of trails within the preliminary plat, except for the trail within Outlot A, which shall be reimbursed 100 percent by the City, including the waterway crossing. c. The developer shall dedicate a public trail easement over Lot 77, Block 10, subject to review and approval of the Parks and Recreation Director and City Engineer. 4. Prior to application for final plat approval the developer shall obtain easements to allow for grading outside of the plat boundaries or the grading plan shall be revised such that all grading occur within the boundaries of the plat. 5. All tree preservation, grading, drainage, stormwater management, retaining walls shall be subject to review and approval of the City Engineer. 6. Outlot A and Outlot B shall be deeded to the City for stormwater management purposes. 7. The landscape plan shall be subject to review and approval of the City Forester and City Engineer. 8. All utility plans shall be subject to review and approval of the City Engineer. 9. Dedication of drainage and utility easements shall be subject to review and approval of the City Engineer. 10. Outlot C shall be dedicated to the City for park purposes. The balance of required park dedication shall be satisfied as a cash fee in lieu of land calculated at the time of final plat approval. Outlot D and Outlot E shall require future application for preliminary plat and final plat approval subject to the procedures established by Title 10 of the City Code. 12. Outlot D and Outlot E shall be subject to park dedication requirements at the time of preliminary plat and final plat approval. 13. Detached townhouse and townhouse dwelling units shall comply with the design and construction standards established by Section 11-57-19 and Section 11-58-21 of the Zoning Ordinance, subject to review and approval of the Zoning Administrator.
