CITY OF LAKEVILLE
PLANNING COMMISSION MEETING MINUTES
June 15, 2023
Chair Majorowicz called the meeting to order at 6:00 p.m. in the Council Chambers at City Hall.
The Pledge of Allegiance to the flag was given.
Members Present: Chair Jenna Majorowicz, Vice Chair Christine Zimmer, Scott Einck, Pat
Kaluza, Brooks Lillehei, Jason Swenson, Patty Zuzek, Ex-Officio member Jeff Hanson
Members Absent: None
Staff Present: Daryl Morey, Planning Director; Frank Dempsey, Associate Planner; Kris Jenson,
Associate Planner; Tina Morrow, Recording Secretary
3. Approval of the Meeting Minutes
The May 18, 2023 Planning Commission meeting minutes were approved as presented.

5. Schuster
Chair Majorowicz opened the public hearing to consider the application of Donald Schuster
for a conditional use permit to allow two detached accessory buildings on a single-family lot in
the RS-2, Single Family Residential District, located at 19390 Iteri Avenue.
Donald Schuster presented an overview of his project.
Associate Planner Frank Dempsey presented the planning report. Mr. Dempsey stated Mr.
Schuster has submitted an application for a conditional use permit to allow the
construction of a second detached accessory building with a combined accessory building area
greater than 1,500 square feet on his property.
The applicant would like to construct a 10’x16’ (160 square foot), 12 foot tall utility storage
shed closer to the house. The shed would be located approximately 30 feet north of the house
and 20 feet from the north property line, both in compliance with setback requirements.

The new detached accessory building will be used to store personal related items and yard
maintenance equipment. Mr. Dempsey outlined the building height and exterior materials for
the proposed building.
Planning Department staff recommends approval of the Donald Schuster conditional use
permit, subject to the 5 stipulations listed in the June 9, 2023 planning report, and approval of
the Findings of Fact dated June 15, 2023.
Chair Majorowicz opened the hearing to the public for comment.
There were no comments from the audience.
Motion was made by Lillehei, seconded by Zimmer to close the public hearing at 6:07 p.m.
Voice vote was taken on the motion.
Ayes – unanimous.
Chair Majorowicz asked for comments from the Planning Commission. Discussion point
included:
• Commissioner Zimmer spoke positively of the accessory building.
Motion was made by Lillehei, seconded by Einck to recommend to City Council approval of
the Donald Schuster conditional use permit subject to the following stipulations, and approval
of the Findings of Fact dated June 15, 2023.
1. The detached accessory building shall be constructed in the location identified on the site
survey/site plan submitted with the conditional use permit application and shall meet the
setbacks required by the Zoning Ordinance.
2. The detached accessory building shall be constructed with the materials noted on the
approved conditional use permit plans.
3. The detached accessory building shall be kept, used and maintained in a manner that is
compatible with the existing single family home on the property and shall not present a
hazard to the public health, safety and general welfare.
4. No door opening in the accessory building shall be wider than eight feet unless a paved
driveway is installed between the driveway of the attached garage to the accessory building.
5. Sanitary sewer service shall not be provided to the detached accessory building and the
detached accessory building shall not be used as a dwelling or as part of a home occupation.

6. City of Lakeville
Associate Planner Kris Jenson presented the planning report. Ms. Jenson stated at the May 18th
meeting, the Planning Commission held a public hearing on amendments to the Subdivision
and Zoning Ordinances to address issues identified in the course of ongoing administration of
the City’s development regulations and review of development applications. Some ordinance
sections were inadvertently left off of the original public hearing notice, so those sections
couldn’t be considered at the May 18th meeting. There were also a few additional items that
arose after the May 18th meeting public hearing notice was published.
Ms. Jenson presented the planning report, providing a summary of the proposed ordinance
amendments, which are described in more detail in the June 7, 2023 planning report.
Chair Majorowicz opened the hearing to the public for comment.
There were no comments from the audience.
Motion was made by Kaluza, seconded by Zimmer to close the public hearing at 6:14 p.m.
Voice vote was taken on the motion
Ayes – unanimous
Chair Majorowicz asked for comments from the Planning Commission. Discussion points
included:
• Commissioner Zimmer asked for clarification regarding the proposed changes to Section
11-16-5.G, platted and unplatted property.
• Commissioner Swenson commented on the proposed changes to commercial kennels in
the office park district.
Motion was made by Swenson, seconded by Zuzek to recommend to City Council approval
of the amendments to Titles 10 and 11 of the Lakeville City Code as presented.

Nays: 0
There being no further business, the meeting was adjourned at 6:19 p.m.
