City of Lakeville Planning Department Memorandum To : Planning Commission From: Kris Jenson, Associate Planner Date: June 28, 2023 Subject: Packet Material for the July 6, 2023 Planning Commission Meeting Agenda Item: Christian Heritage Academy Conditional Use Permit Amendment Action Deadline: July 29, 2023 INTRODUCTION Appro Development, on behalf of Christian Heritage Academy, is requesting a conditional use permit (CUP) amendment to allow a building expansion to the existing school at 7320 175th Street. The proposed expansion would add space to both wings of the building, for a total of just under 16,000 square feet of additional space. The subject property is zoned PUD, Planned Unit Development with RM-1, Medium Density Residential District as the underlying zoning. A CUP for the school use was approved by the City Council on August 1, 2016. An interim use permit for a temporary classroom structure was approved by the City Council on January 17, 2023, but since that time the school has decided to pursue a permanent expansion of the school building rather than using the temporary classrooms. Site Circulation Map SITE ANALYSIS The applicant proposes two additions to the school building, for a total of 15,871 square feet. The smaller of the additions would be a 3,831 square foot expansion to the classroom wing of the building. The other proposed addition is a 12,040 square foot addition to the south (gymnasium) wing of the building. The existing school building is 29,368 square feet and includes 10 classrooms, a gymnasium, several multi-purpose rooms, and an enclosed connection to Crossroads Church. A CUP for the construction of Crossroads Church was approved by the City Council in 2003, and a PUD amendment for The Pillars of Lakeville senior housing and a CUP for Four Square Preschool and Daycare was approved in 2020. According to Joel Koski, principal of Christian Heritage Academy, the school hopes to begin construction on the classroom wing addition shortly after approval by the City Council, to have the construction completed in time for the beginning of the 2024-2025 school year. The addition to the gymnasium wing would then ideally happen three to four years after that time. Surrounding Land Uses and Zoning North – 175th Street, Crossroads East commercial development (PUD) South – Glasgow Avenue, Crossroads Senior Housing (PUD) East – Crossroads Church, parking lot (PUD) West – Crossroads Commercial development (PUD) Building Setbacks. The proposed classroom additions meet all setback requirements of the RM-1 District. The proposed building additions are both single level, consistent with the majority of the school structure, aside from the gymnasium, and are 16 feet in height. The building will not exceed the maximum building height of 35 feet allowed in the RM-1 District. Exterior Materials. The proposed materials for the building addition are architectural precast panel with a thin brick finish topped with an architectural precast panel with an exposed aggregate finish. These materials are consistent with the existing school exterior materials and meet the requirements of Section 11-17-9 that institutional uses have an exterior finish of at least 65% grade A materials and/or integral color architecturally precast concrete panels with a form liner, tooled, natural stone veneer, brick face and/or cast stone type finish and that not 3 more than 35% of the exterior be Grade B or C materials. Brick finish panels and glass satisfy the Grade A materials requirement and the exposed aggregate precast panel is a Grade B material. The proposed materials meet the requirements of the Zoning Ordinance. Floor Plan. The addition to the classroom wing would extend the central corridor and add three additional classrooms. The addition to the gymnasium wing includes a corridor added along the west side of the gymnasium, a multi-purpose room, and six classrooms. Parking. When the was CUP approved in 2016, the school had an enrollment of 105 students in Pre-K to 8th Grade. The Zoning Ordinance requires one parking space per seven students, which equals 15 required parking spaces. The school currently has an enrollment of 230 students, which requires 33 parking spaces. Based on the other existing uses on site and the required parking spaces for each of those uses, the site requires a total of 285 parking spaces. The entire site currently has 344 surface spaces and 62 spaces within the enclosed parking structure for Pillars of Lakeville, for a total of 406 parking spaces. This leaves the site with an excess of 121 total parking spaces (59 surface spaces) for the current development on the site. With both additions to the school, the enrollment is projected to be approximately 400 students, which would require 57 parking spaces, 24 more than they are currently required for the use. With the requirement of these additional spaces, the site would still exceed the parking requirements for all of the uses on the site by 97 total spaces (35 surface spaces). In practice, the school and church have different times of demand, allowing both the church and school to have additional parking available as needed during their usual demand times. Access and Circulation. As Christian Heritage Academy is a private school, most students are dropped-off and picked-up in private vehicles. School principal Joel Koski estimates that there are 100-115 cars per day coming to the site, with many families carpooling students to and from the school. Exhibit I is the site circulation used during drop-off and pick-up to minimize vehicles needing to queue on 175th Street. The circulation loop is intended to be two lanes through the site to accommodate vehicle traffic. With the additional classrooms and potentially additional families, the site circulation should be monitored to ensure vehicles do not back up onto 175th Street. It may also be possible to use more of the parking lot area to lengthen the queue, should the need arise as the school increases capacity. Landscaping. Foundation plantings are proposed along the perimeter of the additions in the areas adjacent to the public street. The landscape plan also includes a notation that any of the overstory trees along Glasgow Avenue will be replaced if damaged during construction. Because the two additions are likely to be constructed separately, an escrow for landscaping that is adjacent to the building addition must be submitted with the building permit at the time of construction. Engineering Division Review. The Engineering Division has reviewed the submitted plans. There are no public improvements proposed with the building addition, therefore no 4 additional engineering review is required. Engineering staff will review the building permit at the time of application. Expiration of Conditional Use Permit. Per Section 11-4-13 of the Zoning Ordinance, conditional use permits expire if the applicant doesn’t commence the authorized use within one year of the date the conditional use permit is issued. Christian Heritage Academy’s CUP for the school use is in full effect, and per the school principal, construction on the classroom wing addition will begin within the one-year time frame, but construction on the gymnasium wing addition may not happen for three to fours years after that point. Planning staff recommends that the CUP Amendment be in effect for five years to accommodate the anticipated construction schedule of the project. Should the school need additional time for the construction of the gymnasium wing, a request made be made at that time to the Zoning Administrator for a one-year extension. Any further extensions beyond that time require the approval of the City Council. RECOMMENDATION Planning Department staff recommends approval of the Christian Heritage Academy conditional use permit amendment, subject to the following stipulations: 1. The site plan and building additions shall be developed in accordance with the plans approved by the City Council. 2. Landscaping shall be installed consistent with the approved landscape plan. A landscape escrow must be submitted with the building permit for the plantings that will be done in conjunction with each phase of construction. 3. Due to the increase in enrollment associated with the building additions, the circulation of vehicles on site for drop-off and/or pick-up must be revised so as to accommodate more vehicles on site if vehicles are regularly backing up onto 175th Street. 4. A building permit is required prior to commencing construction. The construction shall be completed in accordance with the approval of the Building Official and Fire Marshal. 5. The conditional use amendment shall terminate five years after issuance by the City Council. Findings of Fact for approval of the conditional use permit amendment request are attached. The Planning Commission conducted a public hearing on the conditional use permit amendment application preceded by published and mailed notice. The applicant was present and the Planning Commission heard testimony from all interested persons wishing to speak. FINDINGS OF FACT 1. The subject property is located in Comprehensive Planning District 5, which guides the property for Public and Quasi-Public. 2. The subject site is zoned PUD, Planned Unit Development. 3. Legal description of the property is: Unit 1, Common Interest Community No. 649, Crossroads Community Association, in the Crossroads 1st Addition, Dakota County, MN 4. Chapter 4 of the City of Lakeville Zoning Ordinance provides that a conditional use permit may not be issued unless certain criteria are satisfied. The criteria and our findings regarding them are: a. The proposed action has been considered in relation to the specific policies and provisions of and has been found to be consistent with the official City Comprehensive Plan. Finding: The private elementary and middle school use is consistent with the guided public and quasi-public use of the property. b. The proposed use is or will be compatible with present and future land uses of the area. Finding: The private elementary and middle school is compatible with the existing and future land uses in the area. c. The proposed use conforms to all performance standards contained in the Zoning Ordinance and the City Code. 2 Finding: Provided compliance with the stipulations of the conditional use permit amendment, the existing use and the proposed building additions will conform to the performance standards contained in the Zoning Ordinance and the City Code. d. The proposed use can be accommodated with existing public services and will not overburden the City’s service capacity. Finding: The existing school and the proposed building additions can be accommodated with existing public services and will not over burden the City’s service capacity. e. Traffic generated by the proposed use is within capabilities of streets serving the property. Finding: The streets serving this site are adequate to accommodate traffic from the existing use and the proposed building additions. 5. RECOMMENDATION The Planning Commission recommends that the City Council approve the conditional use permit amendment conditioned upon compliance with the planning report prepared by Kris Jenson, Associate Planner, dated June 28, 2023.
