HomeMy WebLinkAbout10-20-08 CITY OF LAKEVILLE COUNCIL MEETING MINUTES OCTOBER 20, 2008 Mayor Dahl called the meeting to order at 7:00 p.m. The pledge of allegiance to the flag was given. Present: Mayor Holly Dahl Council Member Mark .Bellows Council Member Kerrin Swecker Council Member Wendy Wulff Council Member Laurie Rieb Also Present: Roger Knutson,. City Attorney Steve Mielke, City Administrator Tom Vonhof, Police Chief Keith Nelson, City Engineer ..David Olson, Community/Economic Development Director Dennis Feller, Finance Director Steve Michaud, Parks & Recreation Director Chris Petree, Operations & Maintenance Director Brian Anderson, Assistant to City Administrator Charlene Friedges, City Clerk Mr. Mielke had no additional agenda information. Presentations/Introductions Dave Olson requested the City Council proclaim the week of October 20- 24 Manufacturing Week in the City of Lakeville. He stated the Manufacturer's Luncheon will be held at the Holiday Inn & Suites on October 22nd. Council Member Rieb read the Proclamation for Manufacturing Week. Jack Matasosky and Jeannie Schubert accepted the proclamation on behalf of the Economic Development Commission. Mr. Michaud presented the September monthly report of the Parks & Recreation Department. Chief Vonhof presented the August/September Police Department monthly report. CITY OF LAKEVILLE COUNCIL MEETING OCTOBER 20, 2008 PAGE 2 Citizens' Comments Harley Horsager, 17141 Jaybell Court, asked the City Council to consider approving a resolution in support of participation in a County wide greening initiative. Council Member Swecker stated the Council members have discussed the matter; however, no decision has been made at this time. Consent Agenda 08.92 Motion was made by Bellows, seconded by Rieb to approve the consent agenda items as follows: a. Claims for payment. b. Minutes of the October 6, 2008 City Council meeting and the September 22, 2008 Council work session. c. Receive minutes of the following advisory committee meetings: Parks, Recreation & Natural Resources Committee, October l Economic Development Commission, September 23 d. .Acceptance of improvements and final payment to Heselton Construction, LLC, for Well # 18 pump and controls, Improvement Project 06-15B. e. Acceptance of improvements and final payment to McNamara Contracting, Inca for portions of Donnay's Valley Park 3~d Addition and Niakwa Village l5r and 3~d Additions, Improvement Project 08- O1. f. Agreement with Sno Trackers Snowmobile Club for cross-country ski trail grooming at Ritter Farm Park. g. Snow plowing contract with Pro Turf, Inc. for the 2008-2010 winter seasons. h. Set a special Council meeting for Thursday, November 6, 2008 at 5:00 p.m. to canvass results of the November 4t" General Election. j. Amend the City of Lakeville Paid Time Off policy. k. Resolution No. 08-146 adopting assessment roll and Special Assessment Agreement with Reinhard and Martha Lampat, 19520 lteri Avenue, sanitary sewer and watermain connection charges. L Resolution No. 08-147 adoptingassessment roll and Special Assessment Agreement with Holyoke Crossing, LLC, 20788 Holyoke Avenue, sanitary sewer and watermain connection charges. m. Resolution No. 08-148 calling a public hearing on proposed assessments for weed and grass removal n. Lease with Community Action Council for property located at 201 10 Holyoke Avenue. o. Resolution No. 08-149 amending the 2008 Building Fund Budget. p. Resolution No. 08-150 approving contract with B & B Sheet Metal and Roofing, Inc. for the City Hall reroofing project. q. Resolution No. 08-151 authorizing the sale of City vehicles and fiorfeited vehicles. r. Agreements with Aspen Ridge Lawn Maintenance for snow removal at Galaxie and Kenrick Liquor Stores. s. Agreement with Dakota Communications Center related to National Crime Information Center (NCIC) telecommunications. t. Final acceptance of public streets in Chadwick Commercial 2nd Addition. Roll call was taken on the motion. Ayes, unanimous. Item 7 -Special Assessment Hearing Improvement Project 08-01 CITY OF LAKEVILLE COUNCIL MEETING .OCTOBER 20, 2008 PAGE 4 Mayor Dahl opened the public hearing on proposed- assessments for ..Improvement Project 08-01, street reconstruction in portions of Donnay's Valley Park 3rd Addition and Niakwa Pillage l St and 3rd Additions. The City Clerk attested to legal notices being duly published and mailed. City Engineer Keith Nelson stated the final project cost was $515,848.82, and the actual amount to be assessed is $173,298.32. The single family unit assessment is $1,233.44, and the duplex~townhome assessment is $308.36 per unit. Finance Director Dennis Feller explained that the assessments are levied over a 10 year period at 5.5~ interest. No interest is charged if the assessment is paid within 30 days of adoption of the assessment. Qualifying senior citizens may apply for an assessment deferment. Mayor Dahl opened the hearing to questions and comments from members of the audience. There were none. 08.93 Motion was made. by Bellows, seconded by Swecker to close the public hearing. Roll. call was taken on the motion. Ayes, unanimous. 08.94 Motion was made by Wulff, seconded by Rieb to approve Resolution No. 08-152 adopting assessments. for Improvement Project 08-01, street reconstruc#ion in portions of Donnay's Valley Park 3rd Addition and Niakwa Village l5t and 3rd Additions. Roll call was taken on the motion. Ayes, unanimous. Item 8 -Public Hearing for Certification of Delinquent Utility Accounts Mayor Dahl opened the public hearing on the certification of unpaid water, sanitary sewer, storm sewer and street lighting charges. The city clerk attested to legal notice publication. Finance Director Dennis Feller explained that in addition to certifying the amount delinquent, the City also collects a $25 service charge to cover .the cost of certification and interest at the rate of 18~ per year. The total amount being assessed is $187,243.54. Mr. Feller pointed out that the number of accounts .and amount being assessed has more than doubled CITY OF LAKEVILLE COUNCIL MEETING OCTOBER 20, 2008 PAGE 5 in the past three years. Approximately 5~ of the accounts will be paid prior to the assessment being levied. Council Member Swecker asked who is responsible for payment of utilities on rental property. Mr. Feller stated the property owner is ultimately responsibility. Mayor Dahl opened the hearing to questions and comments from members of the audience. There were none. 08.95 Motion was made by Bellows, seconded by Swecker to close the public hearing on the certification of delinquent utility accounts. Roll call was taken on the motion. Ayes, unanimous. 08.96 Motion was made by Rieb, seconded by Swecker to approve Resolution No. 08-153 certifying unpaid water, sanitary sewer, .storm sewer and street lighting charges to the County Treasurer/Auditor to be collected with other taxes on said property.
