Planning Commission Meeting Minutes
FEBRUARY 1, 2007
The February 1, 2007 Planning Commission meeting was called to order by Vice
Chair Drotning in the City Hall Council Chambers at 6:00 p.m.
Flag Pledge.
Present: Manikowski, Stolte, Drotning, Pattee, Grenz, Ex-officio Gerl.
Absent: Swecker.
Staff Present: Daryl Morey, Planning Director; Kris Jenson, Associate Planner; Jay
Rubash, Assistant City Engineer; Andrea Poehler, Assistant City Attorney; and
Penny Brevig, Recording Secretary.
ITEM 3. APPROVAL OF MEETING MINUTES:
The January 18, 2007 Planning Commission meeting minutes were approved as
presented.
The January 18, 2007 Planning Commission work session notes were approved as
presented.
• ITEM 4. ANNOUNCEMENTS:
Mr. Morey indicated the following items were distributed to the Planning
Commission members and staff before tonight's meeting.
1. The January 31, 2007 Parks, Recreation and Natural Resources Committee
meeting minutes regarding the Fieldstone Creek 3rd Addition final plat
and the Meadowlark Wren First Addition preliminary plat.
ITEM 5. CONSENT AGENDA -FIELDSTONE CREEK 3RD ADDITION FINAL PLAT
Vice Chair Drotning asked if landscaping was added adjacent to the pond located on
the south side of the plat. This issue was raised during the Fieldstone Creek 2nd
Addition preliminary plat public hearing. Ms. Jenson indicated that the landscaping
adjacent to the pond had been addressed and is shown on the plans.
07.03 Motion was made and seconded to recommend to City Council approval of the
February 1, 2007 Planning Commission Consent Agenda as follows:
Approve the application of D. R. Horton for the final plat of 60 townhome units to
be known as Fieldstone Creek 3rd Addition, located in the southwest quadrant of
Pilot Knob Road (C.R. 31) and Dodd Boulevard (C. R. 9).

ITEM 6. MEADOWLARK WREN FIRST ADDITION
Vice Chair Drotning opened the public hearing to consider the application of the
Dakota County Community Development Agency (CDA) for .the. following, located
north of 210 Street and east of Holt Avenue:. A. Preliminary plat of 40 townhome
units on two lots to be known as Meadowlark. Wren First Addition; Comprehensive
Plan Amendment to change the land use designations of portions of the subject
property from Commercial and Low Density Residential to Medium/ High Density
Residential; Zoning Map Amendment to rezone the subject property to PUD,
Planned Unit Development; and Vacation of sanitary sewer and watermain, and
drainage and utility easements. Assistant City Attorney Poehler attested that the
legal notice had been duly published in accordance with State Statutes .and City
Code.
Dan Rogness and Kari Gill from the CDA, Kim Bretheim from LHB Architects, and
Tony Eukel and Peter Glashagel from Jacobson Engineers .and Surveyors were in
attendance at tonight's meeting. Ms. Gill presented a history of the subject site and
an overview of their request. She explained. that the reason for including the one
bedroom units in this development was to help the singles or young couples that
dori t qualify for the two bedroom units.
Associate Planner Kris Jenson presented the planning report. Ms. Jenson stated that
the proposed Meadowlark Wren First Addition development is proposed to have 40
rental townhome units and will include connections to existing 209 .Street and
Upper 209 Street by a public north/ south street to be named Holiday Avenue.
In conjunction with the preliminary plat application Ms. Jenson stated that the
developer is also requesting a Comprehensive Plan amendment to re-guide the
northwest corner of the property from low density residential to medium/high
density residential as well as re-guide the east and northeast parcels from
commercial to medium/high density residential. In addition, a rezoning of the
entire property to PUD will be required, subject to the requirements of the RM-1
District. She also indicated that two existing utility easements are proposed to be
vacated prior to the property being platted. Ms. Jenson stated that there are two
easements which were advertised as part of the public hearing for the preliminary
plat. She indicated that after the public hearing notice was sent, the Engineering
Department discovered a third easement that needs to be vacated. This easement
was for 210 Street and was in Dakota County's favor until the roadway .was turned
back to the City in 2004. Ms. Jenson stated that a public hearing will be held for this
easement vacation at the time of final plat.
Ms. enson stated that the Zonin Ordinance exem is affordable housin

developments such as this from the unit construction, garage size, and landscaping
requirements. The PUD rezoning will allow flexibility for the townhome building

setback to the private drives, consistent with previous CDA townhouse
developments, and the buffer yard berming and setback requirements.
Ms. Jenson stated that with a total of 40 units proposed with this preliminary plat, 20
guest parking spaces are required and 32 are being proposed throughout the site.
Ms. Jenson described the proposed townhome designs. She indicated that all units
are proposed to be a minimum of 25 feet or wider and will have an internal storm
shelter and one-car garage. She also described the exterior building materials.
Ms. Jenson described the proposed access points to 210 Street to the south and to
Upper 209 Street and 209 Street to the west and north. She stated that Holiday
Avenue will be a 28 foot wide street within a 50 foot right-of-way as part of the
PUD. She stated that the developer will construct sidewalks on both sides of
Holiday Avenue. Ms. Jenson pointed out the landscaped island in the center of the
proposed Upper 209 Street cul-de-sac and explained that it will act like a round
about and slow traffic entering the development from the west.
Ms. Jenson stated that a neighborhood meeting was held on May 17, 2006. Four
residents were. in attendance along with Dan Rogness and Kari Gill of the CDA who
reviewed .the project and answered questions raised by the group. She indicated
that due to an error by the title company seven property owners who lived near the
project did not get notices of the neighborhood meeting. The CDA immediately sent
out the notice and offered to meet with these people. on June 27, 2006 to answer any
questions they had. Five residents attended the meeting. The issues raised by the
.residents are listed in the January 26, 2007 planning report.
Ms. Jenson stated that should the Planning Commission recommend to the City
Council approval of the preliminary plat, Comprehensive Plan amendment, Zoning
Map amendment, and easement vacations, Planning Department staff recommends
approval subject to the 19 stipulations listed in the January 26, 2007 planning report.
Vice Chair Drotning opened the hearing to the public for comment.
Dan David, 20924 Holt Avenue
Mr. David is opposed to the CDA building being built in this part of the downtown..
He thought there were enough low income rental units currently in the
neighborhood. He cited traffic on Holt. Avenue and 209 Street and the number of
police calls to rental units in the area as issues to be considered with this
development proposal.

Commissioner Grenz asked if there were any transit plans for this area of
downtown. Ms. Gill stated that she was not aware of any at this time.
Commissioner Grenz asked what the projected rental rates for these units will be.
Ms. Gill indicated that the 2-bedroom units will be $590.00 per month, the 3-
bedroom units will be $645.00 per month, and they haven t yet determined what the
monthly rent for the 1-bedroom units will be.
Vice Chair Drotning asked Sergeant Gerl for his opinion regarding police calls to
rental units versus single family homes in this area. Sergeant Gerl stated that most
rental units in Lakeville participate in the Crime Free Multi-Housing Program,
which require background checks: of prospective tenants. He stated that a police
officer meets at least once a month with the management for each rental project. He
indicated that the police will always try to identify who is actually on the lease for
-the rental units and they are proactive in making sure leasees are the only people
living in that unit. Sergeant Gerl stated that the rental units don t get
proportionately more police calls than single family homes by comparison.
Vice Chair Drotning made the comparison between the CDA developments and the
. absentee landlords of other rental buildings, and that the CDA developments are
much better managed, which reduces crime and maintenance problems.
Commissioner Stolte looked at the positive side of having a CDA rental
development in the neighborhood. He indicated that they take very good care of
their buildings, participate in the Crime Free Multi-Housing Program, and screen all
their potential residents.
The Planning Commission discussed whether the proposed Comprehensive Plan
amendment changing the land use designation for portions of the subject property is
appropriate.
Mr. Morey stated that the subject property was previously used more for industrial
uses. He indicated that the majority of this plat is currently guided for medium
density residential use and to incorporate the entire property for a unified.
townhouse development is both desirable and appropriate. The CDA is conducting.
an expensive clean-up of this site because they felt it was a good opportunity for
residential redevelopment.
The Planning Commission agreed that the land use and density is appropriate and
the townhouse buildings will make a good buffer and a good transition between the
commercial zoning to the east and the single family zoning to the west and north.

Mr. Morey commented that the Findings of Fact for the rezoning were not included
in the Planning report. He indicated that the Assistant City Attorney agreed that the
Plaruzing Commission can forward their recommendation to the City .Council and
staff will prepare Findings of Fact for adoption by the City Council.
07.05 Motion was made and seconded to recommend to City Council approval of .the
Meadowlark Wren First Addition preliminary plat of 40 townhome units to be
known as Meadowlark Wren First Addition, Comprehensive Plan Amendment to
change the land use designations of portions of the subject property from
Commercial and Low Density Residential to Medium/High Density Residential,
Zoning Map Amendment to rezone the subject property to PUD, Planned .Unit
Development, and vacation of sanitary sewer and watermain, and public drainage
and utility easements, subject to the 19 stipulations listed in the January 26, 2007
planning report.

Ms. Gill thanked the neighbors in attendance and stressed that the neighbors keep in
• contact with the CDA on any issues that may arise.
ITEM 8. NEW BUSINESS
Vice Chair Drotning reminded the Planning Commission members about the 2008
Comprehensive Plan. Update Planning District meetings that will be held beginning
at the end. of February and continue through March. He stated that Chair Swecker
would like at least two Planning Commission members to sign up and .attend each
Planning District meeting.
There being no further business, the meeting was adjourned at 6:46 p.m.
